Everest Commodity — Cheating by the employees promising returns

Sub: Fraud committed by www.everestcommodity.com by misrepresenting and misleading into paying money to their representatives on their behalf for Profit Packs advertised on their website. The total profit committed and not paid was Rs.65 lakhs for which payment of Rs.12, 19, 993 was paid to their representatives' bank accounts (Shubra Gaur and Paras Kapoor).
During the first week of May 2020, I learnt about the Commodity Trading consulting services offered by www.everestcommodity.com. Thereafter, I visited their website and reviewed the services offered by them along with their back ground details. After that, I registered my mobile number on their website. Soon after, I started getting messages on my mobile phone from www.everestcommodity.com everyday 4 to 5 times about their daily tips, their recommendations and the resultant profits made in commodity trading on Multi commodity Exchange (MCX) and suggesting to join their profit recommendation schemes. These messages were received for more than 15 days continuously. I then decided to speak to them and find out more about the trading related advisory services. Before speaking to them I reviewed in detail their website www.everestcommodity.com where they had set out the details of their services and modes of communication by customers. Accordingly I got in touch with them in the beginning of the third week May 2020 by contacting them on the phone number [protected] [which was then provided in the website https://www.everestcommodity.com for enquires and discussions relating to sales].I had discussed at length on the said phone number of Everest Commodity with a female person who introduced herself as Ms.Urvashi. Thereafter, I was discussing about the trading consulting services with Ms.Urvashi from the third week of May 2020 and more so relating to the services to be provided by www.everestcommodity.com.
After lot of discussions, and believing the promises and commitments made by Ms.Urvashi’s advice, I had agreed to subscribe to the Profit Packs as advertised in their website, for which I was asked by Ms.Urvashi to invest money upfront. Under these profit Packs, I was informed by Ms. Urvashi that www.everestcommodity.com will be trading on my behalf (as I did not possess the knowledge and expertise), and the resultant share of profit will be paid directly into my bank account in 10 to 14 days. All these communications happened through the phone number [protected], which was then provided on their website for sales. When I had insisted that they send the details on mail, they gave petty excuses for not being able to do so. In addition to the voice communication, I had also communicated with Urvashi on Whatsapp on the same number [protected] from May 3rd week.
After a weeks’ time around the last week of May 2020, Urvashi introduced me to a person whose name was informed as Vikas (phone no -[protected]) over a Whatsapp conference call. She told that Vikas is the head of www.everestcommodity.com. and he wanted to talk to me as I am a very important customer to their company. During the telecon, Vikas also promised good returns on the Profit Packs as many customers are registered with them and requested me to invest for very good returns on our investment. Thereafter, Vikas and Urvashi were in touch with me over Whatsapp and continuously followed up my investment.
After this they were continuously following up with me through Whatsapp from the numbers as above to pay the moneys for commencement of the trading under profit packs. They suggested payments through credit card, and also directly into bank accounts of Shubra Gaur and Paras Kapoor, whom they informed are their MCX brokers and I should pay the monies directly into their accounts. I was promised a total profit of Rs.65 lakhs on the investments made until June 3rd week 2020. Accordingly, I remitted in total an amount of Rs.12, 19, 933 in total for the Profit Packs during May 2020 to June 2020 in multiple instalments.
After making the payments, I was continuously following up with Urvashi and Vikas them for the invoice for all the above payments. They kept postponing giving the invoice on some pretext or the other. However they confirmed receipt of only Rs.60, 000 on May 25, 2020 from their mail id [protected]@gmail.com Also, in spite of the delay they had committed to pay profit share of Rs.65 lakhs on July 10, and thereafter postponed endlessly and kept on dodging. I was continuously following up with them since June but they were repeatedly dodging and avoiding our calls. During the telephone conversation on July 29, 2020.when I threatened them with a police complaint, Vikas told me that ‘you can do whatever you want to’ and he does not care .In the last week of July 2020, both Vikas and Urvashi had blocked my mobile number too and hence was not able to communicate with them over phone. Thereafter I had called the other telephone number [protected] (displayed on the website) on July 31, 2020, a new person by name Ashish took the call and told me that he is the MD of the company and that there are no employee by name Uvashi and Vikas working in his company, and that that www.everestcommodity.com is not responsible for the payments made by me as these payments are not made to the company’s accounts. He then gave his mobile no as[protected]. When I was following up with Ashish on the above mobile number, he said he does not care and that we can do whatever we want to.
This was a huge shock to me and then I realised I was cheated and defrauded by www.everestcommodity.com by misrepresenting and misleading through their website. On enquiries, I understand this is their modus operandi with an intention to advertise, lure customers and cheat customers all over the country and is a nation-wide cheating network. I tried to reach out to them as prospective customers through another mobile number and their methodology was the same. They advertise their services through social media like twitter (everestcommodi1). They have since changed the number on their website since I started threatening them with legal consequences.
