Exide — Rude behavior coupled with negligence in service in replacement of defective car battery

On 9.4.2015 van staff replaced the defective battery with a loan battery. It was informed that if defect is curable on testing then it would be delivered within four days otherwise it would be replaced by new one. Nothing was heard from company after four days. I called Batmobile again one customer care officer replied that battery was incurable therefore by a new battery the defective one shall be replaced. But there was no stock of new one. Customer care requested me to contact after three to four days. On 20.4.2015 in the evening at 18.12 hrs I called Batmobile in telephone number 22844564, one customer care officer described himself as Ajit Das informed me that new battery is available and asked me to bring the car at Entally Padmapukur. I express my problem to bring the car to the address instead I demand home delivery. Ajit Das replied that company shall inform as to when same shall be delivered to my home. I enquired about date and time of delivery, In reply he said in their time they will deliver, he refused to specify date and time. I exclaimed after hearing the reply but he emphatically said that it is the way they served the customer. That officer in an unacceptable attitude insisted that they shall deliver the battery as and when their time permit. he added further by saying that I should not forget that defective battery was replaced by a loan battery promptly rather on the day when complain was made. For that I should be grateful to them. I could not stand the attitude and disconnect the line. First of all there was a delay in replacement of defective battery for nearly ten days and I have been plying car with a loan battery. Instead feeling sorry for such delay company showed their attitude as if I am at fault. How a customer care officer of company say like this that a customer should be grateful for prompt service. Why the date and time for home delivery should not be specified. Why home delivery should be at company's sweet will. I have not asked for any favour from company. I bought the car Renault Duster and took delivery on 12.6.2014. Car plied about 10623 Km. Now a defect in battery has been cropped up. It is well within the warranty period. It is therefore my right to get prompt service under consumer protection act. Why I should be grateful for prompt service and that too for a loan battery, why I should ply my car for long ten days with loan battery. Why a bonafide customer tolerate unacceptable attitude of a customer care officer when there was a complain of delay in delivery. I therefore demand a prompt action in this regard and a compensation for negligence in service and for my mental agony and harassment failing which I need to approach consumer forum for redressal.
