[Resolved]  Fintrade Financial Services — Fraudulent misrepresentation

The entity called me up for availing a personal loan. They claim to be a nbfc.in their letter. But they are not even a company, login fee is asked for and documents. The loan is sanctioned just within one day. Then they ask for processing fee. Several calls are received for depositing the processing fee. Then the drama of fraudsters begin. They send documents for execution. The documents were not stated in sanction letter. They ask for letter for employer to deduct the dues from pf. Employer can give undertaking to a bank/nbfc. A body of individuals are not entitled to get such undertaking. Then they ask for witness verification. The witnesses are asked to sign on revenue stamps. These are all fradulent tactics to misappropriate the processing fee. It is not known whether they have moneylender licence. They might have duped thousands. Time to call their bluff and initiation of legal action

After much delay, the legal representative called yesterday and advised that there is some pendency in the document. He has e-mailed today the details and promised to send scanned cAs per your commitment, your representative will visit 5 days after the completed document reaches you for disbursement. The scanned documents of the deficient portion will be sent by today evening from your end. The witnesses will not sign on revenue stamp .However, they will sign. It is not an essential as they are not discharging any money matters. While your organisation can have your own norms, they should confirm to the prevailing law. Other deficiencies will be sorted out. You have to advise what matter is to be filled in. For example, the letter of guarantee says Director of ... .She is not a Director. then how it will be filled in. The execution of the remaining portion will have additional expenses. I do not know why the deficiencies were not intimated for more than a month while I have made so many calls and sent e-mails. Availing loan is not a matter of right. But after issue of loan disbursal letter and submission of documents, you have a contractual obligation to disburse the same. I have been put under tremendous mental pressure as I had withdrawn the loan application to HDFC Bank and it takes 90 days cooling period for applying again. Loan is needed at a particular time for a particular purpose . I had to borrow at exorbitant rate of interest as you failed to disburse in the nick of time. Though I am not convinced fully, I am withdrawing the complaint based on the assurance by Shri Abinash I will be glad if everything works out. I have also offered to accelerate the repayment to Rs 50000/- per month for first 4 month and Rs1.00 lac per month for six months thereafter y

I got a telephonic call from Shri Rahul(designation unknown) assuring that the loan cheque would be dispatched tomorrow. Though it has not been confirmed through e-mail, I accept it at face value. I have also asked them to accelerate repayment schedule with Rs50, 000 for 4 months and Rs 1.00 lacs for 6 months plus interest commencing from exactly one month after credit of the amount to my A/c. The commitment is binding on me.

I would close the complaint once the loan amount is credited to my A/c. Meanwhile, I would request you from further follow-up for resolving the matter till 31.05.2017 the latest date by which the amount should be credited provided the cheque is dispatched tomorrow.

I would inform you the developments on 31.05.2017.

Yesterday, I had got a call from Mr Avinash, legal adviser, who had advised that there is some pendency in the loan agreement. As per his commitment, an e-mail has been received from the organisation. However, the information should have been given earlier

As per the mutual agreement, I am withdrawing the complaint for the time being. My e-mail to the organisation is as under: "As per your commitment, your representative will visit 5 days after the completed document reaches you for disbursement. I hope they will abide by their assurances. The disbursement should be completed by 10th June.

I had not seen the comments by the organisation on May 26th ( they call it a company fradulently) that I had refused to provide a guarantor. But your legal dept has advised pendencies in the guarantee document? Who is right ? I[censored] do not have the knowledge, you should have checked out with your organisation. I demand an uncondtional apology for making such false statement

we wants to intimate you that you applied for a loan in our company for that company have already released whole the documents included your loan loan agreement but you do not want to complete the loan agreement and your are refuse to provide the guarantor to the company.
you cant take the loan amount without guarantor. Company is ready to refund your amount which you have deposited in the company our legal executives are trying to contact you to refund your amount but you also don't want sign the loan cancellation letter.
1st you have to sign the loan cancellation letter then company will refund your amount.

A FIN TRADE executive called me by today and said the full amount will be refund to me within three days.

The above said complaint was resolved.

First of ll, you are not a company at all. Describing your entity as a Company is a fraud under Company Act and I reserve the right to file a fraud case for such misrepresentation o not only as a Company but also NBFC. You are misleading potential loan applicants by such comments

You had never mentioned about the nature of documentation in your loan disbursal letter. You demanded processing fee (which is advance interest) after issuing loan disbursal letter. Then you suddenly said the documents which were not part of sanction. You demanded a letter fro employer undertaking to deduct the amount from PF. An employer can give undertaking to a Bank/NBFC not to moneylenders. Then you asked e to submit the guarantee agreement.

Guarantee agreement was given .. You sent back the documents without any prior information . There was only one column not filled in. Again, I sent the documents. Guarantor was verified, Your representative insisted on verification of witness. I refused to provide the mobile no. The documents are done before notary and the witnesses are given by him. It was required tha your representative should have been present at the time of documentation. Verification of witness is the job of Hon'ble court and you are trying to arrogate yourself to the role of Hon'ble court.

The witnesses were asked to sign on revenue stamp. Revenue stamp is for discharge of money matters. Neither guarantor nor witnesses are supposed to sign on revenue stamp. Such unlawful conditions are iposed to dupe the customer with processing fee without any intention to give loan.

I have sent around 20 emails but not a single e-mail has been replied. One Rahul had promised that representative would visit by air to hand over the cheque. But it never materialised. After lodging the complaint, he called me up and promised to send the loan cheque latest by Saturday. On the same day, you have made the statement here.The telephone calls are all sweet promises.

I am constrained to assume that your entity is a dubious one with the only purpose of duping the loan applicants of processing fee and login fees. Public interest demands that the matter has to be taken up with RBI/CLB as your act reeks of criminality.

You have not answered. These are the simple questions

I) Whether you are a Company registered under Company Act and a NBFC?

ii) Whether your loan disbursal letter says about documents required?

iii) Did you state in your loan disbursal letter about the type of guarantor required?

iv) What was the defect in the guararantee offered by me ?

v) Whether you have any power to cross-examine the witnesses who are signatories to the document over phone? Is it not a violation of law?

vi) Revenue stamp is for discharge of a debt.Why you are insisting upon the the signature of guarantor and witnesses on revenue stamp?

vii) Do you have a policy of not replying to e-mails?

viii) Why you are not revealing the name of Director and his contact No?

ix) Why you have made false promises that the representative would go by air to hand over the cheque? In case it is false, why you have not contradicted me when I have confirmed your statement in e-mail?

x) Why should I sign a loan cancellation letter when you have failed to disburse the loan and failed in your comittment?

Then they ask to send the agreement on their Ajmer office address after that for 15 days no one contact me so I called them and they said agreement is checking by their legal department and some sing is pending.I have called them to return the agreement but every time I m getting different answer Mr.Ankit said agreement sent to you Mr.Vikas said we are going to send the agreement and Mr.Navin Sharma said send me your mail id which I have send 5 to 6 time and every time they ask for some time but no one is contacted me after sms send on his number from different number Mr.Amit who introduce himself as a branch manager ask me one hour time to check my details and call me back but no one called me from last 15 days.today Mr.Navin Sharma called me and said cancel the loan application and you will get 20.% of amount return because the application cancelled by me but no one is replies on my mail they said nothing will done on mail call on our company number but no one is answering the call and it's continue even after 50 days of advance payment done.

Don't trust on them i m thinking to file a case with consumer Court and in RBI against the FINTRADE i have all the call recording of their call in my mobile.
Mr Sushil you submit the detalls including your address and purpose of loan here. I withdrew the complaint based on their assurance. But they do not have the intention to keep their words. I am making it a point to teach a lesson so that the frauds do not recur. To paraphrase the words of Narendra Modiji" We will not do any fraud nor we will allow any fraud to happen"

This is THE WORST WORST agent. One of the agent called me and told the process that within one week i will get a loan. I asked for sure within one week can i get she said yes. So i applied loan. Process started and agent said mam you are eligible to continue the process you need to pay 1800 as processing fee in favour of company.. i asked them is that amount refundable she said mam if company canceeled the loan process then company will refund to you but for sure it wont get cancelled.So i paid them and within one day i got my loan confirmation letter.They said to pay 5500₹. And this amount will be reduced in principal amount i said give me 15 mnts time.So exactly at 14 th minute they called me mam can u please send the money i[censored] send the money today itsel[censored] will get a loan within 5 days and that amount will be refundable if the loan was cancelled.I paid them and i got a receipt.

Here the drama begins.
They sent me one confirmation letter. I need to fill and send back.
WHILE TEELUNG THE PROCESS THEY DIDNT INFORM ME THAT I NEED TO FILL CONFIRMSTION LETTER WHICH INCLUDE SO MANY THINGS LIKE GUARNATOOR SIGN, ADVOCATE, COMPANY MANAGER SIGN, THAT LETER HAS TO BE NOTOARIED...
AFTER SENDING THE LETER THEY DIDNT ANSWERED MY CALL.I CALLED SO MANY TUMES AND DRAFTED MAILS.
AFTER TWO DAYS THEY ANSWERED MY CALL AND SAID MAM FILL AS MUCH AS YOU CAN.. HERE WE CAN MANAGE..
BEFORE FIILING THE FORM I INFORMED THAT SOME COLUMNS I CANT FILLED. THEY SAID NO PROBLEM AS DISCUSED WITH THEIR SENIOR MANAGER.
SO I FIILED WHAT ARE THE COLUMNS I CAN AND I SENT.

FROM THEN ONWARDS THEY ARE NOT ANSWERING MY CALL. IF THEY ANSWERED ASLO CAN U PLEASE CALL AFTER 20 MNTS OR 30 MNTS...

There are so many companies operating in Ajmer and all over Rajasthan. I want to compile a list of people who have applied for and loan has been rejected without the fees being refunded. I got the money after threats which is time-consuming. I will write to RBI about all those Companies for blacklisting them
I have received a complaint about Canopus. Their reply was threatening. They must be stopped from their tracks

I also want to know whether anybody has received loans from these companies. It must be investigaged the source of their fund
