[Resolved]  Flipkart — Exchange rejected

I have purchased moto x play under big billion day exchange offer. i have read all T&C of exchange there was mentioned that phone should be in working condition but nothing mentioned about physical damage. I've got mail from flipkart there was also nothing about physical damage. When i call customer care they told me its "common sense". Person who came to pick the phone has nothing in written from flipkart that phone should not be physically damaged. My phone's screen is crack but touch is working fine which was even verified by courier person. If you people dont want to physical damaged phone, mention that in your T&C. This was the T&C: " Important things to remember: STEP 1: Ready for pickup Please ensure that the old-item that you have promised is ready for pickup. If old-item requires uninstallation, we request you to get it done before the scheduled delivery. If you have opted for uninstallation services while placing the order, an engineer will visit you for the same, post which pickup will happen. If possible provide us original box or else a suitable box in which product can be safely transported back to us. Do not seal the package as the contents will be verified, packed and sealed by our Courier Executive. STEP 2: Sign Declaration Form Courier executive will give you a declaration form, which confirms the details of the old item and also confirms that you are handing over old item as part of exchange offer. Please sign the Declaration form and return it back to the Courier Executive. Please read the terms and conditions carefully. Please retain the acknowledgment slip (Proof Of Delivery) provided by courier partner, for future reference. STEP 3: Receive the Moto X Play On successful pickup, courier partner will deliver the item/s to you. Please feel free to contact us in case you have any questions or need further assistance. Terms and Conditions for offer: By making this purchase you have agreed to all the terms and conditions of the offer as mentioned below/website: You are the sole and absolute owner and/or user of the product mentioned above and the product is not stolen or subject to any litigation, administrative proceedings or investigations. Further you also undertake and declare that the product has not been used in any illegal activities or unlawful purposes and you shall be solely responsible for all damages, inquiries, investigations resulting due to such illegal or unlawful activities prior to date of this letter. Product which you are exchanging under the exchange program is a genuine product and is not a refurbished or counterfeit product, free from any and all encumbrances, liens, attachments, disputes, legal flaws, exchange or any Agreement of sale etc. and you have got the clear marketable title of the said product. In spite of erasing/resetting the data manually/electronically, if any existing data still accessible due any technical reason, WS Retail shall not be responsible for the same and you will not approach them for any retrieval of the data. You hereby give your consent that your personal information that you have provided in connection with this exchange program might be processed, transferred and retained by the retailer and other entities involved in managing the program for the purposes of validating the information that you provided herein and for the administration of the program. You agree to indemnity and keep Flipkart.com, WS Retail, its affiliates, distributors and any future buyer of the product indemnified against all or any third party claims, demand, cost, expenses including attorney fees which may be suffered, incurred, undergone and / or sustained by Flipkart.com, its affiliates or any future buyer due to usage of the Handset by you till date and you undertake to make good the same. You also understand that once a product is sent to Flipkart, in no scenario can this product be returned back to you."
