I am writing to express my profound dissatisfaction and demand immediate resolution regarding a recent order placed on the Flipkart platform. On [[protected]], I placed an order for the [Nike Asuna 2], eagerly awaiting its arrival. However, I was shocked to receive a notification stating that the seller had unilaterally canceled my order without my consent. This unilateral action not only breaches the trust I placed in Flipkart but also constitutes a violation of consumer rights under the Consumer Protection Act, 2019.
Furthermore, upon further investigation, I discovered that the very same product I ordered is still actively listed on the Flipkart platform, albeit at a significantly higher price. This apparent price manipulation raises serious concerns regarding unfair trade practices, as outlined in Section 2(21) of the Consumer Protection Act, 2019, which defines unfair trade practices as any deceptive act or practice affecting consumer decisions.
Moreover, Section 2(47)(z) of the Consumer Protection Act, 2019, defines a "trader" as any person who sells or distributes goods through any method of retail or wholesale, which includes online platforms like Flipkart. By allowing such opportunistic price manipulation to occur on its platform, Flipkart may be considered complicit in unfair trade practices, as it fails to fulfill its obligations as a service provider, as outlined in Section 2(47)(x) of the same Act.
