[Resolved]  Flipkart — Items missing from the order - I want a refund

I had made an order through Flipkart OD[protected] on 9-Oct-2013. The phone LG-G2 had a freebie called "LG Quick Window case". The order was delivered to me on 11-Oct-2013. The problem started after that. I raised an incident[protected] immediately saying the flip cover has not been received yet. On 14 Oct, I got the following response from Flipkart: ====================== Hi Anand, Order ID: OD[protected] Product: LG G2 (16 GB) (Black) We apologise for the inconvenience caused. We would like to inform you that the free "Quick Window cover" will be delivered to you in 7-10 business days. Your patience is appreciated. Did I solve your problem? Please click here to let me know. Please write back to us should you have any other questions or need further assistance. Regards, Preetham Praneeth Customer Support =========================== After 10 business days, I checked again with the customer support. They opened a new incident[protected] again instead of following up on the same incident[protected]. This time the response is given below. ============================ Hi Anand, Order ID: OD[protected] Thank you for writing in. We have escalated the issue to the concerned team and you will be getting an update in 24 hours in this regard. Hope this helps with your concern. Did I solve your problem? Regards, shreyas.r Customer Support ============================ No one from Flipkart contacted me in 24 hrs. After 3 days, I check with the customer service again. They again give the same frustrating answer that they will get back in 24-48 hrs. As per the Flipkart's Free & Easy Returns policy, they will issue a refund if the product is 'Damaged', 'Defective' or 'Not as Described'. The product is definitely not as described. I expected a Flip Cover as promised in the offer - they haven't given one so far. I have finally asked them to give me a refund today. I would like the consumer court to intervene to ensure either: 1. Flipkart refunds the entire amount after I return the product 2. Flipkart gives me compensation for making me wait so long for the supposed freebie.

Flipkart issued me a new mobile as replacement which was supposed to contain the Quick Window case. The irony was that this was not present even in the replacement shipment. At the end, they provided me a store credit of Rs 3000 corresponding to the price of Quick Window cover at Rs 2999 as advertised by LG. With this, I think the complaint can be closed. Though it is not to my entire satisfaction, the following traits are commendable: 1. Willingness to replace the item even when it was not defective 2. Providing options to compensate rather than playing blame games with the manufacturer
