Case of selling defective product and fake/ duplicate/ possibly used product and flipkart refusing accountability and refusing return
I purchased the samsung a6 on 30th july 2021 from flipkart for my mother. The phone reached me on 3rd august 2021. We opened the phone on saturday, 7th august and tried to set it up. All of saturday and sunday we were trying to start it but it showed network error and would not get any network...even after trying to put 4 different sims in it. Finally on monday, we called the nearest samsung service center to check with them what the issue could be and if the issue could be solved with the warranty. I gave them the imei no of the device and was shocked to hear what they said, they said this particular device has been first activated in feb 2019, so which means its warranty expired in feb 2020. Hence the product oibviously is not only not covered in warranty but also coule be a used device since it has been activated before. They advised me to immediately return the piece. Imagine if the piece was working fine and 2 months later would have an issue. We could come to know only then is a warranty expired and used product and by then it would also be too late to return on flipkart!!!
Same day morning on monday, 9th august, i raised a return request with flipkart and as per their process, a visit by their technical person was arranged. The technical person visited our residence on 9th august evening and during his check also realised that the imei no in the device and the bill are different! This confirmed my doubt that the seller has sold me a duplicate/ fake/ used/ defective product.
Few hours later i see an update on my flipkart app that the return has been cancelled!! Without any valid reason without any explanation! That too when the return has been raised from my side well within the return window and the situations mentioned above clearly indicates that we have been a sold fake/ defective/ duplicate product!!!
I want to file a case here against flipkart and the seller for selling fake goods and cheating the customers and esp against flipkart for not taking action against such sellers, not blacklisting them and continuing them to allow selling on the site even though they are frauds.
My wife incidentally has also been a victim of this few days back since she too purchased a phone from flipkart and faced similar issue of receiving a tampered product. Only after this episode we got to know that in both cases the seller is the same. And only after consumer forum intervention did flipkart revert to her and solve her issue and provide resolution. They were not co-operative in her case also until she filed a complaint in the consumer forum. I want my refund and i want to file a mental harassment suit against flipkart for not taking action against such sellers and allowing them to sell and also not co operating with customers in situations like this. Attached are 2 images- 1. Of the bill sent by seller which has different imei no and 2 is the imei no in the device which is different.
Trust consumer forum intervention will happen asap in this case and will also help blacklist such fraud sellers!! Was this information helpful? |
