I am writing to escalate a serious grievance regarding my recent purchase from Flipkart.

Immediately after delivery on 12th Sept (late evening), the handset shut down within a short time o[censored]se and only displayed the Tecno Spark logo. I raised a return request the same day.
On Flipkart’s advice, I visited the authorized Tecno service center in Andheri West. To my shock, the service team informed me that the device provided to me is refurbished, even though it was sold as a brand-new product on Flipkart.
Despite repeated follow-ups:
Flipkart support asked me to obtain a written report from the service center, but the service team categorically refused, stating they do not issue such reports to customers.
The service center confirmed that the brand has denied replacement, as the product is refurbished. I have a recorded conversation as proof, where the technician has clearly admitted this.
Flipkart and the service center are passing responsibility back and forth without providing any concrete resolution.
This constitutes mis-selling and a breach of customer trust, in addition to causing me stress and harassment. The refund/replacement window closes on 19th September, yet no action has been taken despite my complaint being raised on 12th September and escalation emails sent to Flipkart support and their Grievance Officer.
I therefore request your urgent intervention and direct Flipkart to:
Immediately process a full refund for this fraudulent sale.
This experience has been extremely disappointing and amounts to unfair trade practice under the Consumer Protection Act, 2019. I request immediate resolution.
