[Resolved]  Godrej Properties — Pending refund of Rs 5 Lakh deposited as EOI money for Godrej Palm Retreat Sector 150 Noida j

We had given a Cheque of Rs 5 Lakh as EOI for Godrej Palm Retreat, Sector 150, Noida on[protected].

Later on[protected] we applied for unit GDPRC1-0502 by signing a cheque of Rs 12 Lakh and an application form provided, filled and retained by Godrej Empoyees. Nobody from Godrej had signed or acknowledged any of the document.

On[protected] we requested the Sales Manager through email that we will not be able to continue with our application due to some unfortunate circumstances and requested to stop processing of our application, not to bank the cheque of Rs 12 Lakh and to refund our deposit of Rs 5 Lakh. Since then, we have telephoned and emailed the Sales Manager, the project head, their official email and higher management. We also stopped the payment of Rs 12 Lakh cheque.

We haven't entered into any contract or agreement. We haven't even approached to get signed any agreement, registering of any document is not even in sight.

Considering all this, we are entitled for 100% refund of our money (Rs 5 Lakh), but they are saying that the same will be forfeited.

Through this forum, we once again request the Godrej Authorities to recheck the case and return to us our money.

I have visited their site office in Nov'21, the project seems good but prices were a little bit costly, so I couldn't make my mind.
We have got this feedback from one of our well-known too, but we have faith in Godrej Brand. But now we need to rethink. This is an eye opener.

The location and project are very good, problem is the promoters need to be more transparent and fair in dealing, and I hope they will do.
I have read in another feedback that the actual developer is some local builder and Godrej is just marketing this project.

Though we dealt with only Godrej personnel, but later we realised that it is a joint venture of ACE infrastructure and Godrej properties

I have messaged you.
As per UP-RERA the developer has to return all the amount paid by an applicant if the agreement is not signed and registered at sub registrar office.
This is common with all the builders. Once you pay the token money, you are in a trap. To save your token money, you will pay more and more. They will suggest you to keep paying and exit at higher price and that will not going to happen as they have already factored in the appreciation of the coming 4-5 years in the price.
Knock the doors of rera that's the only way. Loop in their top management.

To protect the rights of buyers, the booking amount should be deposited in an Escrow Account and should only be transferred to the developer on registration of builder buyer agreement as per RERA. If the agreement is not registered within the given time, the money should be refunded to the buyer.
