Godrej Properties — Unethical ,Insensitive ,Fraudulent behaviour by the team of Godrej Seven ,Joka ,Kolkata

I booked a property in Godrej Seven, Joka
Tower 1 Flat code G7P1A2U0802(2.5 bhk) in Joka, Kolkata in the month of February, 2020. I visited the property on 17.02.2020 and loved it .It was exactly as per my requirement except few including one structural point. i clearly communicated my requirement of the changes required to the Sales executive Subho Chakraborty ( my requirement was to get the second common washroom in the attached form with the second bedroom, it meant both of the washroom to be directly attached with both of bigger rooms) as my primary condition to book the property.. Mr Chakraborty talked with somebody over phone and confirmed me verbally that it was a very minor modification which could be done without any issue..I confirmesd him that once i receive the written confirmation from him my first cheque as booking amount INR 50000 would be ready. the same day Mr Subho sent confirmation mail with the changed plan(annexed here) giving the green signal for my required modification. On 18 .02.2020 i met Subho and handed over the first cheque of INR 50000 as booking amount.

here I should have mentioned I cleared Mr Subho on the first day that this is my dream project which would be our Future home and it is a confidential one too, as I had plan to gift it to my Husband
So I have kept my self sole owner of this unit to keep it Confidential and a surprising gift. so obviously I am financing it alone, too (along with a partial Bank loan).Before applying for Godrej Properties I visited almost all the new projects in Joka area along with some other projects in Tollygunge and Behala area. I did my small research about each of the developer from sources available .I could have purchased a flat of similar size from any local promoter with my customized requirement and at a much lesser prices. Financially that could be much convenient for me, but I did not dare to trust any small promoter and developer because I used to believe that at the time of getting the first payment there will be no dearth of fallacious statements even some would be beyond my expectation but at the time of hand over and 5 yrs down the line scenario might be totally different .

So I wanted a not only a big but also a trustworthy developer whom I can entrust with my dream home even at quite a higher cost.After my little research on all the developers whose project I visited Godrez properties(2.5 bhk to be modified with my requirement) seemed trustworthy, Transparent and Customer friendly, But by now all of these good adjectives have been found totally false for authority of Godrej Seven Joka

Since the very begining of my interaction with my Relationship Managers mainly Mrs Suchitra Das i kept on informing them that to take care of my required modification verbally, over whatsapp(annexed the screen shot) their legal people during ATS Registration process.Everyone kept on telling '"MADAM DONT WORRY, YOUR REQUIREMENT WILL BE TAKEN CARE OF" until i chased Suchitra very strongly during February'2021.the very reason was behind this was I have been sent the demand note on completion of the 8 th floor slab of the tower, my flat is itself on the 8 th floor so I went to visit the site and could realise all of my Relationship Managers kept on fooling me until i chased Suchitra very strongly during February'2021 that, what was the specific status of my prime requirement, to chkk that and let me know it over mail.when without getting any option probably she actually started to follow up with her seniors and designing team, the undernoted story came in front

She told me though this washroom modification was prerquisite of my booking yet due to HIRA regulatory act it can be done only after getting the CC .I accepted it but I wanted a mail from her as her statement deviated from the initial confirmation. Then she told that she would not able to send any mail as HIRA rules deters developers to send official correspondence on this issue otherwise Godrez Properties might be penalized

In reply to that I sent my first mail on 13.3.2021 and second one on 16.3.2021 addresising Suchitra Das and copymarking all of the those people, whom i met through Godrej Seven and intimated about my required modifications
though the mail did not come but my RM made me talk with her seniors who also talked to me in the same tune rather in little louder form referring to HIRA rules.My RM also forwarded me the Escalation matrix based on which i escaleted the communication to their Regional Head east Mr Subha Chakraborty copymarking other seniors to Ms Suchitra Das. i received no reply over mail from any of them but a meeting was arranged among me and immediate seniors of Suchitra Das in their Joka office on 20.04.2021. In this meeting obviously due to my mails they remained very cautious about their statement and kept it same what Suchitra told me about HIRA issue, they were insisting /requesting me to get the modification done after getting the CC which i flatly refused, ultimately they told me that then it had been updated in their record and after getting the CC they would facilitate this modification process and it would be done by them before my unit is handed over to me (and Maintenance will not be charged before this modification is done)

Though, just few days after this meeting Suchitra called me and requested that if i would have agreed to put my required door (as a second door to the controversial bathroom) after getting CC Godrej would have compensated my expenses in the form of Gift vouchers.Then we had discussion over this and i prepared an estimate, too. but later on i found it would be very tough for me to execute. I informed the same to Suchitra, I guess she realised the practical issues and promised to talk to her seniors if after CC it could be facilitated and done by Godrej as discussed in the meeting on 20.04.2021.

Despite all of these i kept on remitting my installments on time beleiving Suchitra's words(on record) and mostly trusting that though the Salesguy has committed the mess but senior people like Regional head east of Godrej Properties would have definitely found out some sensible solution to this . i thought of complaining to HIRA authority but still gave him time and Money to the Project on time.

Till 01.11.2021 I have transferred them INR 3359294 out of total INR 4299315 except, legal fees, GST and financing cost for my partial loan from SBI. after remitting this Payment on 01.11.2021 i cleared Suchitra that until i get any concrete official inputs from her seniors i would not make any further Payment .as till that date infact till today i have not received any single mail from Godrej Seven people referring my complaints

whatever, ultimately day before yesterday she arranged a call with her senior Mr S ganguly . Mr Ganguly told sorry several times for whatever has happened but also told very smartly that Godrej would not facilitate the modification process, but he can try to compensate my expenses to some extent if i would have agreed to put the door myself.I felt that it is not THE DEVELOPER, rather it is me who have committed some wrong and if i agree to put the door myself he would have done me favor by compensating my expenses to some extent.though i repeatedly told him regarding my problem in doing that and comparatively their ease in doing the same I found him bit insensitive in his response, speciallay when i told that almost all of the conversation with them i have kept on record including yesterday's one .He kept on telling me sorry repeatedly but it did not neutralise his insensitive attitude.

So then I decided to cancel my order, they as ked me to send a mail today .I have sent the mail mentioning the cancellation the purchase of G7P1A2U0802 and claming for the full refund what i have paid to Godrej properties till date, the financing cost of my loan from SBI which i have been bearing and the Legal fees what I paid to their Lawyer during ATS registration process.

after sending this i was thinking of filing a complaint to HIRA authority but i was also looking for a platform to raise a Consument Complaint and to reach to higher authorities of Godrej Property. Luckily during searching net I found this forum .

I have claimed from the Moneytary amount but what about the my emotional attachment with the propertyI developed, mental pain which i have been bearing for the BREACH OF TRUST and ultimately for the value of Time.
Till now, I have not receiveed any written response from Godrej Seven, Joka against any of my mails .I hope this can compel the authorities of Godrej Properties to give the right response to me

In reference to my original complaint I would like to state that after getting your first response almost two week's have passed .
During this period one conference call was arranged by my relationship manager Mrs Suchitra Das with her senior Mr S Ganguly on 14 .02.2022 .During the call Mr Ganguly told me very politely that though i finalised my booking on the basis of confirmation mail from(REGARDING ATTACHMENT OF MY SECOND BAHROOM WITH THE SECOND BIGGER BEDROOM) Godrej's Sales Executive yet Godrez will neither be able to make that modification, any facilitation nor to refund me whole of my Monetary expenses related to this project(AMOUNT PAID TO GODREZ SEVEN, AMOUNT PAID TO THEIR LAWYER DURING ATS AGREEMENT, FINANCING COST OF MY BANK LOAN etc). But he can try to refund me the amount paid to Godrej Seven only. I asked him to send me a official mail mentioning whatever he told me over phone .i also asked him that previously Suchitra asked me that Godrej can compensate me by reimbursing my expenses if I would have agreed to make the modification myself after getting the Completion certificate. Though I repeatedly told Suchitra that it would be very inconvenient for me to make this modification myself and the cost could may come higher just to break one wall and put one door. Still she requested me to quote a cost considering all the charges just to keep a rearest option. I officially mentioned the amount(considering the inflationary charges) in my mail sent to Godrez Seven on 04.02.2022.During our discussion on 14.02.2022 I asked Mr Ganguly just to check if I would have opted for that rearest option will Godrej bear it fully or not.
Mr Ganguly and Suchitra told me over phone that by the end of the week I would have received the Official mail from them briefing our discussion by the end of last week, but till date I have received no concrete official mail from any of the person of Godrej Seven.

I posted my complaint here expecting that for a huge brand like Godrej who are working pan India basis particularly any branch or region may work reluctantly to destroy Customer’s trust and to ruin Company’s reputation but when addressed to the head office they must have gone through the genuineness of the issue and render adequate service to eradicate Customer’s pain and keep Brand’s trust value
PLS YOU PEOPLE EXPLAIN ME THAT WHEN YOUR SALES PEOPLE SENT ME OFFICIAL CONFIRMATION ON BEHALF OF GODREJ PROPERTIES HOW CAN A BRAND LIKE GODREJ AND YOUR STAFFS CAN REFUSE TO PROVIDE THAT SERVICE.INSTAED OF ASKING FOR WRITTEN APOLOGY AND TO HONOR THE ORIGINAL OFFICIAL MAIL THE PEOPLE FROM GODREJ SEVEN ARE GIVING THEIR MOST UNPROFESSIONAL COMMENTS OVER PHONE .
Yesterday I received both of message and mail for feed back over my experience regarding the purchase in Godrej Seven.I have submitted the true feed back which I should have submitted a long ago. Hope it reaches to the right person/authority.

I checked from net that during MAY, 2021 Supreme Court gave some verdict against HIRA in support of RERA and on July, 2021 the West Bengal Government has taken the first steps towards implementation of RERA in the State by notifying rules governing the Real Estate Regulatory Authority in the state. I don’t know the exact current status, but I would like to know as the project is registered under HIRA is that the reason that somebody dare to behave with consumer in such a nasty way.
Noboby can see Future, but it is always considered that a good Brand always does their best to keep their Reputation irrespective of any odds. That why I trusted Godrej over local promoters.
WAS IT WRONG ON MY PART. I WANT WRITTEN CONCRETE REPLY FROM GODREJ PROPERTIES.
