Gonoise.com — ear shots _ delay in refund as well defective product

I had ordered noise ear shots sports with case wherein it didn't worked and i am following up with them from 8.8.19... They haven't confirmed on the receipt of defected piece neither are giving the refund. They say that refund does not fall under their policy... Pls help it's been too long now... I do have trail mails ([protected]@yahoo.in) i am following with them to get back the refund since it was an online payment they now come back saying that refund is not within their policy and are giving a replacement... I have ordered their new product although and hence is the reason why i do want the refund now... Pls help me with getting the refund at the earliest...
