HTC — Desire 826 touch issue

I bought htc 826 desire 40 days back and now itx touch became unreponsive i bought it from flipkart so i want to file a complaint for both companies htc as well as flipkart because i have seen so many reviews on flipkart regarding this product and all saying they having touch issue still htc and flipkart is selling this product . I want my phone to get replaced i can pay little bit more money to upgrade my handset but i dont want this model again as its a faulty model. Resolve my problem as soon as possible.
