Indus Towers — Tower Rental Agreement Expired & Breeching and No Response from Indus Tower

Good Morning

In our Premises located in Old Washermenpet, we are the landlords (G.V. Janarthanam / G.V. Punniyakotti / B. Saraswathi / C. Prabhavathy / D. Thilagavathy) given our premises for RENTAL to INDUS TOWER (ID. No. CHM758 and Korukkupet – 4) from 2006 until 29-SEP-2021. We gave a clear notice to Indus Tower before 6 months from the date of rental agreement expiry dated on 29-SEP-2021, stating that we are not interested to RENEW the rental agreement. But Indus Tower representative requested to extend for One Year from 30-SEP-2021 to 30-SEP-2022 as a “Short Term Rental Agreement”. Also, Indus Tower made 3 times extension for short term rental agreement without taking prior permission from any of the landlords mentioned above.
We requested an Indus Tower representative to provide a proper “Rental Agreement” for One Year extension, but until now agreement is not submitted by Indus Tower.

Now one year extension is also completed on 29-SEP-2022, but until now cellphone tower belongs to Indus Tower is “Not Evacuated or Removed” from my premises. Also, I am trying to contact Indus Tower representative through “Normal Phone Call / Whatsapp Call / Whatsapp Message / E-mail” for past 3 months, but until now “No Response” from Indus Tower representative Mr. Shakir.

The above behaviors done by Indus Tower are not acceptable and making trouble to us. Because we tried to support Indus Tower for a short term rental agreement, but Indus Tower didn’t follow and breeching the agreed statement. Now Indus Tower is running a cellphone tower in my premises in a ILLEGAL manner.

We are officially notifying you that Indus Tower should evacuate or remove cell phone tower in our premises and close all our recommended points within 15 days from today or else we will take respective LEGAL actions.

Overall Communication Details are given below:

1. Rental agreement RENEWAL not interested notice given by all landlords – 23-MAR-2021

2. Rental agreement from 30-SEP-2016 to 29-SEP-2021 expired on – 29-SEP-2021

3. Short Term Rental Agreement from 30-SEP-2021 to 29-DEC-2021 requested by Indus Tower – 28-JUNE-2021

4. Short Term Rental Agreement 1st Extension from 30-DEC-2021 to 30-APR-2022 without landlord permission - 31-JAN-2022 Only Request Letter Submitted

5. Short Term Rental Agreement 2nd Extension from 01-MAY-2022 to 24-JULY-2022 without landlord permission – 24-MAY-2022 Only Request Letter Submitted

6. Short Term Rental Agreement 3rd Extension from 25-JULY-2022 to 31-DEC-2022 without landlord permission – 23-SEP-2022 Only Request Letter Submitted

Until now we didn't receive the F&F settlement paper from Indus Tower and also no further steps were taken by Indus Tower.

Kindly go through the above concern and take respective actions.
