Jaiprakash Associates — Jaypee Kosmos sector 134 Project Delay

My name is Saurabh and working as software engineer. I am buyer of flat (1280 sqft) in Jaypee Kosmos. All the buyers of Jaypee Wishtown are feeling cheated due to huge delay in project and additional demand of money for increasing area, service tax and delay penalty. People purchase flat with wish to get multiple things in package but it goes destroy when builder start playing. I want to highlight few points below.

1. Project Delay - I purchased resale flat (1280 sqft, JP Kosmos, Sec 134 Noida) in Oct 2012 with the hope that this is Ready to Move property which was started in Dec 2009 and projected to complete by Dec 2012. But, my own house dreams ruined by waiting since now. I received possession letter in Feb 2015 end, but there was no date was mentioned for possession and also included additional area charges of INR 3 lacs (around) which was heart attack for me. I asked these questions in JP office but they don’t have any information of possession dates and I also checked my flat where I found below problems in flat but they are asking money for possession.
a. No electricity wiring
b. No toilet seat, sink, taps etc.
c. Poor quality and bend doors which is not possible to close.
d. No wooden shutter doors (Mentioned in papers)
e. Poor quality wall paint
f. Ground floor area is untidy and open steel rods used to cover plant which is harmful to play for child.
g. Building outer paint is very bad and looks an old building.

2. Additional demand of money for increasing super area – I asked for additional demand to JP office and as per them area get change post completion and I can verify with Noida Authority. It feels cheated and shows fraud strategy of JP to make fool to common people. They are not even ready to measure with some authorized person. They have increased super area about 8% and asking about INR 3 lacs additional money which does not look fair.

3. Service Tax – Service tax was not levied in year 2009 when people purchased this property but as per govt rules in year 2012, buyer need to pay service tax about 1.2 lacs which additional burden on people.
This is all very heart breaking and sleepless but I feels other buyers were also feeling similar thoughts. I am helpless to handle such situation and no direction that what I should do.
