Ref: Reminder to our letter dated 6th January, 2014 and 13th February, 2014

Sub:- Order No. JL/49/MH01/00243/E dated 03/03/2012

Sir,

We undersigned the developers engaged in business of Development and Construction of buildings and we have to state as under:

We state that this letter is reminder to our above referred letter dated 6th January, 2014 and 13th February, 2014, and we are repeat and reiterate whatever states therein as part of this letter.

We state that by the above referred subject order No. JL/49/MH01/00243/E dated 03/03/2012 we have purchased/engaged you to Install Four Lifts at our project at Prathmesh View Residency, CTS 365, Nahur, Mumbai as mentioned therein.


We state that after our continuance request and follow up with Mr. Mayur Koli over phone for installation and completion of work of said four lifts at our said project, there is no work has been started by you and it is appears that your only wants to prolong the work of said four lifts at our said project without any genuine reason.

We state that we already informed you by our above reference letters that flat purchaser are keen for obtain the possession of their respective flats and they have taken admissions in Schools of their children near the our said project as we committed them to hand over possession of their flat on 1st week of April, 2014. If we failed to do so, we have to pay rent for alternative accommodation for 11 months, which you please note.

We state that due to your failure to complete the work of installation of four lifts at our said project as agreed and committed by you, we have to pay a sum of Rs. 5, 00, 000/- (Rupees Five Lac Only) towards rent for alternative accommodation for 11 (Eleven) months to the flat purchasers commencing from 1st April, 2014 on account of not handing over the possession of flats to flat purchasers on due schedule.

In the above circumstances, we hereby state that we are suffering loss of Rs. 5, 00, 000/- (Rupees Five Lac Only) per month due to your failure to complete entire work of the said four lifts within the said time schedule. Thus you are solely responsible and liable for the same, which you please note.

We further state that we are unable to hand over the possession of flats to flat purchasers till installation of the said four lifts at our said project by you.

We hereby request you to complete the installation of four lifts at our said project at the earliest and we are ready and willing to extend our full support and cooperate to you.
