Dear Sir/Madam,
This letter serves as a formal legal notice regarding a serious instance of fraud, cheating, and deliberate non-rendering of services associated with my payment made through your platform.
A payment was collected from me and marked as “paid” on JustDial; however, no service whatsoever has been provided to date. This constitutes:
Cheating under Section 420 of the Indian Penal Code,
Unfair Trade Practice and Deficiency of Service under the Consumer Protection Act, 2019,
Negligence under the IT Act, 2000,
And a violation of consumer trust and your obligations as an intermediary.
Your platform has failed to exercise due diligence, thereby enabling a fraudulent service provider to take payment without fulfilling the agreed service. This is a direct contravention of the obligations placed on digital intermediaries under Indian law.
I hereby DEMAND the following actions immediately:
Initiate a full-scale investigation into the service provider involved.
Temporarily suspend or blacklist the service provider during the inquiry.
Refund the complete amount collected from me without delay.
Provide a written justification for the lapse and the failure of your internal controls.
Outline the corrective actions JustDial will implement to prevent similar frauds.
Failure to comply with the above within 48 hours of receiving this notice will leave me with no option but to initiate stringent legal and regulatory proceedings, including:
Filing a case before the District Consumer Disputes Redressal Commission for compensation, damages, and costs,
Lodging a formal complaint with the Cyber Crime Cell,
Reporting the matter to MeitY, Department of Consumer Affairs, and other governing bodies,
Pursuing civil and criminal action against the service provider and, if applicable, JustDial for negligence and enabling fraud.
This notice may be used as evidence of prior intimation in all subsequent legal proceedings.
