Karnataka RDPR — unauthorized construction of temporary sheds under misguidance of gram panchayat member

1. Request for marginal land of 15 to 20 ft. For villagers, walking path and to maintain distance between private land on sy. No.88 and govt. Land on sy. No.89.

2. Request for removal o[censored]nauthorized construction of temporary sheds by land grabbers in govt. Land on sy. No.89, chunganahalli grama (Gantiganapalya) kasaba hobli, chikkanayakanahalli taluk, tumkur district.

3. Unauthorised temporary sheds were constructed during april 2018.

1) i, the undersigned s. Viswanath, alias gundappa, s/o. Late. Subramanya, aged 73 years, sr. Citizen, is having acquired above mentioned (Ancestral) agriculture property at chunganahalli grama bearing sy. No.87/8, 87/9, 87/1b, 88/3 to an extent of 3.25 acres of land is in my possession & enjoyment with clear titles and records in my name.

2) i had acquired the above mentioned ancestral property through registered partition deed dated 05.09.2015 bearing m. R. No: t10/2015-16 and khatha no.178.

3) when i started to develop the land in 2016 by putting barbed wire fencing, bore well and obtained t. C. (Transformer from bescom) for electricity after getting my land surveyed by govt. Survey department, a small group of villagers of gantiganapalya were deliberately misguided by the present grama panchayath member (Dayananda s/o. Huchappa) started harassing me using his supporters by destroying boundary fencing, breaking supporting stones and cutting off fencing wires, needlessly trespassing my land etc. This was being done with crooked and malicious intentions.

4) in the above circumstances, i appealed in chikkanayakanahalli court against the trouble makers and obtain a permanent injunction order and declaration of the title suit property in my favour there by permanently restraining the trouble makers [viz.in the court of sr. Civil judge and jmfc c. N. Halli, tumkur, vide ref. No. O. S./19/2017 suit was filed on 08.06.2017 the case was disposed off on 08.03.2018. ].

5) after the court order declaration, the above mentioned grama panchayat member along with others (Dayananda s/o huchappa, vardaiah s/o kenchappa, shivanna s/o lingappa etc.) with criminal intent, provoked other villagers to build temporary sheds
(In sy. No 89 which his govt land) just abutting to my land (Which is sy. No.88) in the vacant space left for roads, walking path etc. The sole intent of vacant land left by the government is for common use of myself and the villagers.

Please refer to village (Nakshe) map of chunganahalli. As per the map, there was marginal land left between sy. No 89 and sy. No.88/3 which is now being encroached.

Ideally there should be a minimum distance of 15 to 20 ft. For common use by the public. They also restricted entry to my land by constructing thippegundi right in front of entry point to my land.

6) name of the villagers who has constructed the sheds are as below:
A) g. L. Mahesh s/o. Lakshmaiah
B) lakshmaiah s/o. Late. Giriyappa
C) nataraja s/o. Moodalagiriyappa.
D) thimmaiah s/o. Late giriyappa and others.

It is to be noted that, all the above mentioned villagers already have their own houses in govt. Land sy. No.89 and also having agricultural lands in chunganahalli grama under various sy. Nos.

7) the above act of constructing temporary sheds by them directly indicates deliberate act of harassing and troubling me with malicious intentions since i am single person with family under minority community in this village. This is a pure land grabbing activity with long range plans of converting the temporary constructions of sheds to permanent structure.

In view of the above issues and with best interest of the villagers and myself, i hereby with this letter, request you kindly take action by removing the unauthorized temporary constructions, save the govt. Land, make way for entering my land in unobtrusive manner and oblige.
