[Resolved]  Kia — Complaint Against Kia, Mohali, Punjab for Delayed Delivery and Financial Harassment

Dear Sir/Madam,

I am writing to officially lodge a complaint against Kia, Mohali, Punjab., detailing the circumstances of a transaction that has resulted in considerable inconvenience, mental distress, and unwarranted financial burdens on my part.

My grievance concerns the booking and subsequent delays in the delivery of a Kia Seltos base model, which was initiated on 29th September 2023. A payment of Rs. 25, 000 was promptly made through the Kia Automobile application. However, the confirmation of my booking was only provided on the 3rd of October, along with a booking receipt dated the 4th of October, bearing the booking ID - B[protected].

In the following steps, I engaged with the local dealership situated in Mohali and Panchkula, wherein Mr. Ankur from the Mohali dealership committed that the vehicle would be delivered on either the 1st or 2nd day of Navratras. Unfortunately, the dealership subsequently informed me that the delivery date had been extended to the 21st of October.

Meanwhile, my banking institution, Canara Bank, sanctioned a loan of Rs. 11, 50, 000 for the vehicle and issued a demand draft amounting to Rs. 11, 51, 000 based on assurances that I would take delivery of the car on the 21st of October. To my great disappointment, the delivery date was again postponed to the 27th of October. In response, I made an additional payment of Rs. 1, 65, 000 on the 26th of October into Joshi Kia's account.

Despite collecting the demand draft from the bank and depositing it into their own account, the dealership denied the car's delivery on the 27th of October, stating that it would take an additional 4 to 5 days.

In an astonishing turn of events, on the 2nd of November, the dealership informed me that the car would be delivered by the 10th of November. Yet, when I personally visited the showroom on the 6th of November, I was informed that delivery would take over a month, resulting in financial complications due to interest charges levied by the bank from the 20th of October.

These repeated delays and inconsistencies have caused considerable distress, not only to me but to my family as well. I have two daughters, and their Diwali celebration was dependent on the timely delivery of this car. Their disappointment has been palpable, and their Diwali celebration will be affected due to the repeated delays in car delivery.

It is pertinent to note that I had the opportunity to receive the car as early as the 15th of October from KLG Kia Panchkula. However, I deliberately chose to book the car from Punjab as I believed that the tax benefits ought to remain within the Punjab government due to my residency.

Since the 20th of October, I have incurred daily expenses on cab services due to the extended delay in car delivery. Despite this, the dealership had already received payments for the ex-showroom price, insurance, and road tax well in advance.

In light of the above circumstances, I am seeking intervention and resolution through the Consumer Court Portal to address the following issues:

1. Delays and financial burdens caused by Kia, Mohali, Punjab
2. Mental distress and inconvenience caused due to the delay in car delivery.
3. Compensation for the financial harassment, including bank loan charges/interest and cab charges incurred due to the dealership's actions.

I kindly request the Consumer Court Portal to investigate this matter thoroughly and facilitate the prompt resolution of these issues, ensuring that the dealership upholds their commitment and delivers the car without further delay. Additionally, I seek assistance in addressing the financial burden I have incurred as a result of these delays.
