Lakozy Builders Pvt Ltd — Not getting possession even after all the payments | |||
I (Ved Prakash Lal, Mob-[protected]) purchased a flat no, OA-501, on 5th floor, A-wing, Building- Orchid, Anchor Park, Sector F, Near Achole Talao, Vasai-East, Thane -401209 from Lakozy Builders Pvt Ltd, Mumbai. Indiabulls Distribution Services Ltd was its marketing partner. The sale was registered on duly registered on 1st Nov, 2013. I contact Mr Anirban Bhattacharya (Mob- [protected]) for any communication regarding this flat. In the agreement nowhere it is mentioned that Indiabulls is the marketing partner. The payments are in the favor of an Escrow Account maintained between Indiabulls and Lakozy Builders.The building was under construction and demand letters were linked with the stage of construction. The last demand letter was raised on 22-July-2014 asking for the last payment of Rs 172, 757/- and in the letter itself it is mentioned as “On Possession”. When I visited the site, I found Occupation Certificate was not received and so I delayed the payment for about 2 months and then after payment a receipt was issued on 8-Oct-2014.I received another letter for demanding Interest payment dated on 15-Oct-2014 that arbitrarily computed Interest of Rs 213, 421/-. On contacting Indiabulls they said, it was very high because intermediate payments were not paid on time. But in the last demand letter no such Interest demand was mentioned.The building became inhabitable only later and I received a letter dated 29-Oct-2014 for possession. So effectively, they asked last installment of Rs 172, 757/- in the name of possession, but the building was ready for possession only about 2 month after this. I already paid the amount demanded before the building was ready for possession. So effectively there should not be any interest penalty for late payment.Even after all the payment I have not been given possession of the said flat. I was planning to shift there for inhabitation, but I am unable to do so now. For possession I am asked to pay Rs 213, 421/- in the name of interest penalty. I have spent in total about Rs 40 lacs including stamp duty, registration, extra charges, but possession is not being given to me. Builders' phone nos are [protected], [protected]. Yes, I am also one of the same victim. Lakozy Builder is one of the fraud, worst Builder. So, people are requested not to buy property from this Builder.

You are not the only one who is suffering from such high handedness of the builder . I too have paid the full amount as per the agreement but have still not received the possession .Initially the demand letter send by the builder mentioned the final possession amount to be paid to escrow a/c now we received letter from them stating that the amount has to be paid directly to builder & not to escrow although we have already paid the amount & the same has been debited from our a/c . Moreover they do not have OC & also after providing possession letter they are not providing the keys . Its already been months since all the payment have been done but neither Indiabulls nor Lakozy builders are responding to the mails or phone calls . Looks like they want to just fleece the customers .Also they were asking for some interest amount but have provided nothing in writing . -Mahesh [protected]
