[Resolved]  LIC Housing Finance — Co-applicant name removal request

Respected Sir I am Jaya R Patil the main applicant of the Housing Loan # 61702592 for Rs.35, 00, 000 in the year 2007. I got married to Mr. Poovaiah Thimaya Chendira on 26.08.2005 at Gundlupet near Mysore at a Krishna temple and the marriage was registered on 15.10.2005. We have two daughters aged about 8 and 6 years who have been residing with me and I am solely taking care of my children. We finalized a property and applied for LIC housing loan in March 2007. LIC at Indiranagar suggested to attach a co-applicant salary slip due to which I got my husband’s salary slip attached. I then did not realize the complications of this in future. My husband got his name added to the property without my knowledge during registration. In the interest of saving the marriage and not get into any disputes I went ahead on the join property registration. The moment the property was registered in my name, Mr. Poovaiah Chendira never paid any EMI from day we took loan. He is not staying with us since 2008 onwards. The loan repayments were completing on me from the beginning we took loan and I am been paying from my Axis bank account # [protected]. You may check your statement which clearly defines the loan repayments from my bank account. This also means I am capable and eligible to pay loan on my own and hence I am here to request for removal of co-applicant name from the housing loan. There has been lot of cruelty and ignorance towards 2 minor children whose responsibility is also on myself. I am working in IBM Pvt Ltd as Portfolio Manager and I am earning enough to repay the housing loan as well as take care of my 2 girl children. Mr. Poovaiah Chendira had neglected and abandoned me and had failed to discharge his duties as a husband and also as a father to 2 minor girl children. Mr Poovaiah also failed to contribute his share of the equated monthly installments towards discharge of the housing. Mr. Poovaiah Chendira forced on me to make me pay the housing loan repayments. Had I not paid the housing loan EMI promptly as I am legally liable to pay back the bank, this would have been already into legal issues and further more financial loss to impacting me drastically. To avoid legal issues, I promptly making payments and abide by the same till date. Mr. Poovaiah had also failed to support me and the child financially and had infact deserted us without providing any financial, moral support to great trauma and cruelty. Since Mr. Poovaiah had abandoned us during my 2nd child pregnancy I was constantly humiliated and made snide comments about my character in public, thereby maligning my reputation and standing in society. Having been subjected to tremendous stress and on being severely tortured by the Respondent, emotionally, physically and financially, I filed for divorce before the Principal Family Judge, Bangalore in 2008. In addition to taking care of all the household expenses and the expenses for my two minor girl children, I am also paying Rs 34, 887/- per month toward the monthly installments towards the housing loan jointly availed. Mr. Poovaiah Chendira has not made any payment towards this housing loan despite the fact that he is a co- applicant towards this property. Being single parent, I work evening times till morning and then take care of my kids to cook, send them to school and their lunch, homework, dinner, etc. While they were at school so that she could be there for them the rest of the day till going back to my office work by 09.30 pm after putting the children to bed. I also work every Saturday as I am in the technical field to carry out change implementations which can happen only during week end server maintenance window. I single handedly paying the loan installments towards the flat and car loan as well as taking care of all the day to day needs of the children and their school expenses. Due to these reasons, The learned Family Judge granted divorce decree dated 13.09.2013. The marriage between dated 15.10.2005 was dissolved by a decree of divorce. Therefore, I make a kind request to LIC Housing mgt team for removal of Mr. Poovaiah Chendira name from the loan account and help me to further secure this property into my name I am the sole payer against the property loan.
