I asked for a refund of 660000 INR which i paid as installment for my flat in cameilla garden 1 bhiwadi but they simply refused to give my money back.
I went for some inspection in camilla garden 1 bhiwadi (Rajasthan) but the work was dead slow, seeing this i applied for a refund but still after approx one year i haven, t received any amount.Please help/suggest best path possible.

This is to bring to your notice that I Mrs. Durgesh Arora is a 60 year old senior citizen. I had invested my hard earned money to book a villa of 2500 sqft. @ 1460/- per sqft on 1st Feb. 2007 with M Tech Developers Limited, at Camellia Garden-I – Bhiwadi project, In this regard I had paid 3.65 lacs which include the booking amount and installment. The details of the payments are as follows:-

I had received nothing since then from M Tech developers for allotment of my said villa at Camellia Garden-I Bhiwadi, no documents have been submitted for approval and no construction has started for the said villa. As on today the project is abandoned. This is cheating and fraud.
Even my advocate sent a notice to M-Tech Developers on[protected] for reply / allotment / refund but they never replyed.
I had submitted the refund form with all the required documents as requested by M Tech developers on 12/06/16. I have visited the Bhiwadi Site and M-Tech Developers regestered office in New Delhi, many times to find a solution or refund but still they are fooling us. I have been regularly following up with M.Tech developers (Mr. Sharma, Mr. Amit Jha, Mr. Chanchal & Mr. Arvind Aggarwal) for the refund of the money, But they refuse to pay the money.
On account of your aforesaid non allotment of 2500Sq.Ft. villa at Camellia Garden-I Bhiwadi. M Tech Developers are hereby liable called upon to –
Refund my deposited amount of Rs. 3, 65, 000/- with 18% per annum interest.
Pay compensation for the mental agony / injury suffered and financial loss due to your negligence & travelling expences in sum of Rs. 2, 00, 000/-.
As I live in Bareilly (U.P.) and it’s very difficult to come to delhi every now and then for followup of refund, I request you to kindly takeup this matter on one time basis and inform me at all my contact details given below.

In view of the above kindly register my this complaint also against this company. I further request that the delay on my part in making this complaint may please be condoned and my this request may please be listed along with other complaints already registered at your office. I sincerely hope that the matter will be appropriately investigated and my hard earned money will be recovered from this company at the earliest.
I request the Economic offences Wing and Competition Act commission to take strict action against the M Tech Developers Limited for this cheating and fraud.

I had booked a 2 bedroom flat at Camellia garden vide advance registration application dated 11/Dec/2006 and paid Rs. 1, 20, 000/- through cheque. Then I get a demand note on 19/01/2007 of 1st installment for an amount of Rs. 1, 80, 000/- and paid the same through cheque. Then I get provisional allotment letter dated 24/12/2007 of flat no 103, 1st floor 1200 sqft in tower ALPHA-2. Then we signed the Buyer agreement dated 20.11.2008. I have also paid 2nd installment of Rs. 1, 50, 000/- vide cheque on 22/05/2008. They were to hand over the flat in 36 months i.e. November 2011.

It is unfortunate that developer has not even started the work of tower I have booked into and does not reply to the query. May time I have asked for refund but they do not respond. What to do?

I deposited Rs 3, 00, 000 for a plot in Camellia Phase-II, Bhiwadi with M-Tech Developers limited in Sep 2006. They faltered on the allotment of plot. When I asked for the refund they are making excuses and not refunding the amount. I deposited the requisite papers asked for but they are still not making the refund. Need to pursue and willing to join any group of likewise affected parties with the objective of putting joint pressure for the refund.
Let me know if there are such forum available for a joint fight with the developer.

I have bought a plot of 200 sq yds from M-Tech Developers in Camellia Garden-II, I have paid 2 Lacs to M-tech Developers in 2007 but till date I have not received my money back. Dear Sir, This is to bring to your notice that I, Ashok Kumar Ex-serviceman from Indian Air Force, had invested my hard earned money to book a Plot of 160 sq yard @ 4250/- per sq yard on 29 Aug 2006 with M Tech Developers in Camellia Garden-II, Bhiwadi. In this regard I had paid Rs 1, 60, 000 towards part payment on account of provisional registration of Plot vide cheque No 005935 dated 09 Aug 2006, State Bank Of Patiala for RS 70, 000 and second cheque of Rs 90, 000 vide cheque No. 820833 dated 09 Aug 2006, State Bank Of India. The above payment is acknowledged vide receipt no P1, 198 Dated 29/08/06. There are no documents that have been submitted for approval and no construction has started for the said Phase. As on today the project is abandoned. This amounts to cheating and fraud with me. I have been regularly calling up M.Tech Developers staff - Mr. Arvind Aggarwal for the refund of the money, but staff at the M Tech developers limited do not respond to my calls. I have been harassed constantly. On account of your aforesaid non allotment of Plot measuring 160 sq at Camellia Garden-I Bhiwadi. MTech Developers is hereby liable called upon to – 1. 1. i have booked a plot in camellia garden 1 Bhiwadi by cheque No113264 dated 04/04/2007 amounting Rs 425000/-(four lac twenty five thousand) of Corporation Bank as 50% advance money for a 200sqyds plot .

2. From the year 2007 in my area rate of property is in five fold. if i invest this money in any area around me then rs.425000/- will be above 20lac.(i have pro, because even govt circul rate of agriculture land in my tehsil was rs 125000/- and now rs 6500000/-per acre)

3. but till the date i have not received any plot from M tech developers.
i have not received any interest from there.
after two year i have received only rs150000/-( without any interest)
and till the date i have not received any balance money or interest or any compensation from company.

I had booked a shop in M Tech Developer's Spice Mall Project in 2007 and paid a sum of Rs. 8.26L. The project hasn't taken off at all and has been cancelled. Despite that and repeated requests to the builder to refund the money, there has been absolutely no response from the builder.

Dear Sir,

I had applied for Provisional registration in your Bhiwadi Project vide above mentioned Receipt no 8574 dated 12/12/2006.

Initially I have given the amount of Rs 1,20000 vide cheque No 993749 dated 14-Nov-2006 Bank Indian Overseas Bank on account of flat @1250/- size 1200 sqft at CG-1 in Bhiwadi.

After that I have surrendered the Provisional in your Project dated 12.05.2007. It was communicated me to get money back with in Six Month.

In the Year of 2008 I Used to call at your office they have assured me to refund the money with in next six months.

Then in the year of 2009 same assurance was given to me. Then I Got confirmation on my Surrender Certificate that I will get the amount in Three installment in OCT NOV DEC 2009.

But so far I have not received any amount from your end.

You are once again requested to please give my money back against the Surrender of Provisional registration in your Bhiwadi Project.

But still now the builder has not started the work of the 3 BHK & there is no visibility for the same. Builder has not demanded any money and not giving any information about the construction. Dear All,

We have booked five 2 BHK flats in Camelia Garden 1 Bhiwadi in M tech developers project in the year 2006. In total we have made 10 lacs as initial deposits and installments... But there is hardly any progress or construction on the site. we have made numerous visits and phone calls to the office, but the fruad company is not ready to listen and refund the money back to us... after 5 years there is no developments. I will request every one who is suffering due to m tech developers to join hand and take the happiness of the builder.

I have deposited a sum of Rs 1,75,000 vide receipt no: M1281 dated 11th November'2006 to M. Tech Developers P. Ltd for a 2BHK Flat booking in their project M-Tech Heights , Bhiwadi. Their project never took off as promised by them and therefore I wrore to their G.M. Corporate Communications-Sushil Vats asking for refund in the year 2008 but sicnce then I have exchanged umpteen letters with them but they are asking me to submit the original receipt and therafter wait for atleast 1 year as they will pay back the amount in installments wheher monthly monthly or yearly no one knows..I have also visited their office but they are absolutely non-committal.
I wish to file a consumer case against the builder for not only getting my deposited amount but also the interest and compensation for consumer harrasment that has been metted to me since last 4 years.

Subject: Non Refund of Deposited Cheque against insufficient fund and doing undue/ wrong favor by our National banks to M-tech Developers in their financial scam/ fraud in name of real state business.

An account payee multi -city cheque of an amount of Rs. 1, 24,000/- bearing Sl. No.940432 Dated 28.11.2010 of oriental Bank Of Commerce, Naraina Branch, New delhi was issued by M-Tech Developers Pvt. Ltd. , New Delhi in name of Shri Vijay Dubey against refund of booking amount of 200 sq. Land in Lucknow project
The above issued cheque was deposited in SBI, Hotel De-Paris Branch, and Varanasi (U.P.) on 29.11.2010. As per the SBI, saving bank statement (Enclosed) the amount of Rs. 1,24,000/- was credited on 30 November & the same amount was debit on 01 December 2010 and reason was mentioned insufficient fund.
On 2nd December I was immediately get in touch regarding above with M-Tech develops Mr. Tarun (mobile number [protected] ) who’s is PA to Director Shri Amit Jha. He had assured that he will represent and arrange to clear the deposited cheque in day or two and regarding the same he had already given instruction to the concern bank.
At the sometime I was in get touch with with SBI, Hotel De-pairs Branch, Varanasi-UP where cheque has been deposited to gather exact information regarding same. But it is said to mention that no information was provided by SBI and they just said that the deposited cheque was sent to the clearance house. In this regard written request through speed post was sent to SBI on 22.12.2010 and also e-mail on 23.12.2010 at branch mail ID: sbi.[protected]@sbi.co.in. I have also submit on-line complaint on OBC website on 21.12.2010 regarding information of above cheque
Here it is pertinent to mention that M-Tech Developers is doing financial fraud in name of real state business i.e. First they take booking amount and do not giving the booked plot/flat even after 2-3 years. When customer put pressure then they refuse to provide either flat/ plot or money and encourage surrendering and returning money without interest since no other option left with customer other than to get refund back booking amount. It’s very strange the issue cheques are not being cleared many number of times due to many reasons ie. So this is NOT the first case and its also impossible to do the this kind of fraud activity on routine basis without the help/ undue favour of banks.
In my case it’s very strange that why the deposited cheque was not clear and If there is insufficient money then why cheque (Instrument) was hold in clearing house against the bank /RBI guidelines and NOT returned to undersigned. It’s very strange after putting my repetitive verbal communication & written request /complaints banks are again NOT taking seriously and simply diluting this case and intending to show this case as missing of cheque just to favour M-Tech Devlopers rather finding the facts and arrange to return the cheques for further legal proceedings against M-Tech Delopers within stipulated time . This is as per verbal discussion with Branch Managers OBC, Naraina, New Delhi & SBI Hotel-De-Paris.
In nutshell I submit to following:-
1. Kindly arrange to return the bounce cheque (Instrument) as per bank statement to undersigned with objection memo at the earliest without any further delay for further legal proceedings.
2. A senior level committee/ officials may be deputed / nominated to find out the facts regarding the continuous fraud done by M-Tech Devlopers with the help of banks and how and why the banking/RBI guidelines norms getting violated specially incase of M T-Tech Devlopers and no action is being taken in this regard.
3. This is in also in interest of image of National bank because only due to few officials could not play with banking image and to avoid big scams in future and to protect the customers.
4. Since more than 22 days sufficient time has been already elapsed and undersigned is lot of financial and mental pressure because of the same. Considering request to expedite the case and arrange to resolve within next 7 days.

I HAVE BOOKED A PLOT IN MTECH DEVELOPERS LTD'S BHIWADI PROJECT AND GIVEN A CHEQUE OF RS. 1,60,000.00 FOR 160 SQ. YARDS PLOT THREE YEARS AGO.

ANOTHER CHEQUE WHICH THEY HAVE GIVEN ME FOR NOV,10 HAS BEEN BOUNCED DUE TO INSUFFICIENT FUND IN THEIR BANK ACCOUNT. STILL THEY ARE HARASSING ME AND DO NOT GIVE ME THE CHEQUE OF BALANCE MONEY. I have paid booking amount of 175000 (By Cheque) in september 2006 to M-Tech Developers for flat in project MTech heights, but till now they have not provided any document, not refunding my hard money after sending multiple reminders to them. I have visited their office a no. of times but still they are not paying my money back.

We paid a deposit for 5 villas in Goa in Dec 2006 to M Tech Developers Ltd. This was booked pre launch.
After 18 months it became obvious that they are not going to fulfil their commitment and we requested a refund of the deposit.
We have dealt with Mr susheel Vats who their GM of Marketing. Despite all the promises, and after nearly 4 years, they have refunded 1.5 out of 5 deposits but now they seem to ignore all requests. Susheel Vats is in my opinion a disgrace to the company (but no better than Mr Gaurau and Mr amit Jha). They promise but never action the refunds.
I would advise anyone thinking of dealing with this company to avoid them if they do not want to have lsot money.

This complaint is against the M-Tech Developrs Ltd, I had booked one flat in M-Tech developrs in Daruhera project which is situated in Gurgaon , Haryana. I had booked this flat in march 2007 and paid the bookind amt via chque. after some time i had paid first installment to the builder as per edmand schedule and builder comitted to us that he will give the possession in 2010.But after a year or more when nothing is happing on the project site , i visited to builder office in Ashram and asked them to refund my money back.For same purposes i have visited so mant times but nothing is done till date even they have promised me to give the chqeue but nothing is happening.

Beside this now when i visited their office , staff not behaive peoperly and use the aboused language.

The appellant is Social, Consumer, Human right Activist and Have been appearing as Authorised representative in six Consumer Cases pending Consumer disputes redressal Forum –X against M-Tech Developers. It is only Through RTI application the appellant Come to know that38 cases are stil pending against M-Tech Developers apart of 22 cases decided by Consumer Disputes Redressal Forum-X. and a complaint case C-09/127 titled as Jyoti Swrup Arora Vs M-Tech Developers is pending before State Consumer Commission Delhi.
That Respondent PIO in present RTI application under Appeal had replied that FIR NO. 160/09 u/s 420/120-B IPC have been registered against M-tech Developers at PS EOW and the investigation are pending.
That Appellant had also been informed that SHO PS Roop Nager has received two Complaints against M-Tech Developers and enquiry is pending in both of them.
That Appellant was also informed about Transfer of Complaints received by PS New Friends Colony to E.O.W.
Besides these informations exact Number of Cases u/s 138 Negotiable instrument Act as well as Consumer Complaint Cases out side Delhi including at Gurgaon are yet be Known against M-Tech Developers.
The Appellant had present RTI application on 15/10/09 to get a copy of FIR No. 160/09 dt.1/08/09 against M-Tech Developers Who had duped ordinary investors in estimated tune of more than 50 million rupees. The appellant also sought information about number of complaints against the accused by E.O.W. Point wise queries to know present status of investigation,any seizure /raid conducted also whether any accused arrested ,granted bail or abscondening? were also raised in the RTI application.
A period of more than 30 days had been no information/reply have been received from respondent. Hence the Present Appeal
Any other/further grounds /arguments at the time of hearing.

That the respondent/PIO’s may kindly be directed to supply the sought information .Strict penal action may be recommended against respondent as per RTI Act .

That PIO no.14 in present RTI application under Appeal had replied that FIR NO. 160/09 u/s 420/120-B IPC have been registered against M-tech Developers at PS EOW and the investigation are pending.
That PIO no.4 had informed that SHO PS Roop Nager has received two Complaints against M-Tech Developers and enquiry is pending in both of them.
That PIO no.12 had informed about Transfer of Complaints received by PS New Friends Colony toEOW.
That the remaining PIO’s had informed that no cases /enquiry is pending against M-tech Developers as per available records with them.
However the Respondent/PIO responded like an police officer of British era. The information sought is denied by wrong fully citing Section 8 of RTI Act as well as section 11 of RTI Act.

Besides this the PIO sought information about Name & parentage with residential addresses of directors of the said Company from the appellant which itself contradicts his earlier mentioned arguments. However this information can be obtained by the police from the given Regd. Office address of company.
I Challenge the PIO no.3 to prove the personal interest of appellant in seeking the Sought information as alleged by him. It is Sorry to state the persons who allegedly duped ordinery public in tune of Crores of rupees are provided Cover by higher Law enforcing Authorities. Further it is Police Who inform all about solving of Criminal case though Media including the identity of accused but have all hesitation to provide information under RTI Act regarding Notorious Scamsters.The Conduct of PIO is similar to Police men who had been suspended in Kidney Transplantation Case.
The appellant is in process to gather information about cases against M-tech Developers in Gurgaoan HARYANA ASWELL AS details of cases u/s138 of Negotiable instruments Act all over India.
Any other/further grounds /arguments at the time of hearing.

I had booked 2 plots with M Tech developers in their Lucknow & Camellia Phase II, Bhiwadi projects respectively in pre launch offer in Nov2006 and given them around Rs. 4 Lacs as initial amount for booking.

It has been three years now and still their projects have not been launched. Inspite of repeated follow ups with the senior management of the builder nad assurances from their side, the projects have still not been launched till date.

Now i have lost faith in their abilities and intention and would like to get my booking cancelled and expect my initial booking amount along with interest from them.

Please guide me as on the way forward approach i should adopt.
