I want to bring a case of medical negligence to your notice. The said medical negligence was conducted by Dr Priyanka Chauhan Garg who is practicing as an obstetrician and gynaecologist at Max hospital, Dehradun. Dr Priyanka Chauhan Garg conducted a procedure for removal of intrauterine contraceptive device (IUCD) for my wife and charged us relevant fee for that and follows ups. However, it turned out that she never removed the IUCD which caused several complications in my wifeâs pregnancy, including two episodes of ###l bleeding, hospital admission and severe stress and trauma, both physically and mentally. We were also informed that because of Dr Priyankaâs failure to remove IUCD, we were at a risk of losing our unborn child. She subsequently also changed and falsified the hospital records to hide the facts.
Due to her abovementioned acts which constitute of medical negligence, providing incorrect medical advice knowingly and with malice, as well as falsification of medical records with an intention to commit fraud, we request you to revoke Dr Priyankaâs medical license and take other appropriate actions against her.
The events that transpired are as elaborated below.
1. We are a young couple residing in Dehradun where I conduct business and my wife is a home maker (house wife). My wifeâs maternal home is in Jakarta, Indonesia. On 26 June 2020 my wife underwent a procedure for insertion of IUCD at RSPI Pondok Indah hospital at Jakarta, Indonesia. The procedure went on smoothly and my wife did not experience any discomfort from the procedure. On the second follow up, she had got the IUCD string cut short as it was irritating during intercourse. She had regular follow ups after that and everything was okay. After starting to live in Dehradun, Katarina also went to Dr Luna Pant for follow up in 2021, where Dr Luna Pant also said that IUCD is placed normally and everything was okay.
2. Subsequently, we decided to plan a family together. My wife and I went to Max Hospital, Dehradun on 30 April 2022 where we consulted with Dr Priyanka Chauhan Garg for removal of my wifeâs IUCD in order to conceive. We wanted to consult Dr Luna Pant but her appointment was not available and so we were told by the hospital staff that Dr Priyanka is from Dr Lunaâs team and we can consult with her. During the same consultation, Dr Priyanka advised us that the process of removal of IUCD is a relatively basic process and it could be conducted immediately by her. Trusting her advice as a doctor at a reputed hospital, my wife and I decided for her to get her IUCD removed. Dr Priyanka took my wife to the labour room and conducted a process in which she used her tools to pull out the IUD from her ###. The entire procedure took 2 minutes while I waited in her office for it to get done. She went on to assure my wife that she had removed the entire IUCD from my wifeâs body. My wife asked Dr Priyanka that she did not feel anything as it should have hurt or she would have at least felt something when it was removed which she did not but Dr Priyanka assured her that she had removed it completely but did not show it to her. When my wife asked to see the IUCD she mentioned that she threw it straight in the dustbin, which is not a common medical practice. In any case, we trusted her and left. The removal of IUCD was also recorded in the records maintained by the hospital, however, we have come to know that Dr Priyanka has changed those records as well and now the records only indicate that she went to Dr Priyanka for check-up. 3. On 29th May 2022, my wife took a pregnancy test and it came positive. We were ecstatic to have conceived. We decided to consult Dr Priyanka for the pregnancy check-ups as Max hospital is only a few kms from our house and is a reputed hospital. We thought it would be convenient in case of emergencies for us and also as visits become more frequent. Also, since we are new in Dehradun and do not know any other ob-gyn in Dehradun, we thought it would be a good idea to consult someone we are already have consulted once. However, when we attempted to take an appointment with Dr Priyanka at Max, her schedule seemed busy and the only way we can consult with her is to visit her clinic at Vasant Vihar, Dehradun on 30th May 2022. Since we were keen on getting the initial check-up done to confirm pregnancy and get a consultation for my wife, we decided to consult with Dr Priyanka at her clinic. During the consultation, she advised my wife to get an ultrasound done to check the pregnancy in 5 days. She also recorded that the IUCD had been removed on 30 April 2022. Please find attached a copy of the prescription and consultation dated 30 May 2022 wherein it is mentioned that IUCD had been removed.
