Msx Mall Pvt Ltd — deviation from the layout plan and violation of agreement in payment of assured return

I filed complaints in up state consumer dispute redressal commission, lucknow regarding violation of agreement in payment of assured return and deviation from the approved layout plan. I booked shop no. 216b, an area of 312 sq ft at the rate of 9000 per sq ft. As per agreement, 14% annual return on down payment amount of 95% of basic sale price. Msx mall gave this return for 17 months and then reduced the amount of assured return and finally stopped the return after 26 months whereas msx mall is to give me return for 48 months. They never replied any communication from me. Finally they changed the location of my shop and increased the area of the shop by 50 sq ft without my concurrence. As per agreement, if deviation takes place without the concurrence of allottee, the allottee can exit from the project and the developer shall return the down payment amount and to continue with payment of assured return till down payment amount is returned. I went to court since the down payment was not returned to me.
