Mumbai Traffic Police — Levy of charges by vakola division for offence not committed | |||||
I was travelling from andheri to vile parle station via western express highway today about 6.00 pm. While i reached the turning of sahara star hotel to take a right turn towards vile parle station, one traffic police constable asked me to show my licence. There was no signal violation as i was standing on the signal itself to take a right turn. I asked him as for what reason he needs to see my licence. He alleged that i was talking on mobile phone, which i was not at all doing.in fact i had just passed my phone to my co-passenger to answer the same as i was driving. Still the constable demanded the licence and papers of my car. I showed him the registration papers, valid insurance papers and a valid puc also and politely told him that i was not carrying my driving licence as i had forgotten my wallet in my office. He made me park my vehicle under the bridge and gave me a slip mentioning various offences, which i took on the belief that i was not carrying a valid licence. I was shocked to see four offences listed in the said ticket which was generated through a device. The offences mentioned in the challan generated are not committed by me, except for not carrying a valid driving licence at the time of driving. I am a law abiding citizen of the country and i trusted the constable for levying fine for not carrying driving licence. He has levied a total fine of rs 2200/- under various sections mentioned as follows. I was not even told at the time of issuing challan that what kind of offence i have committed. 250 (A)/177 mva rs 200/- using mobile phone while driving (I was not at all talking on the mobile phone) 184 rs 1000/- driving dangerously. (I was not at all driving dangerously, infact i had halted at the signal for my turn to take a right turn) 179 rs 500/- fine for disobedience of orders, obstruction and refusal of information. (Which i have not committed, i was already halting at the signal) 3 (1)/181 rs 500/- for not carrying driving licence (Yes i agree to it as i had forgotten my walled at office) Total rs 2200/- The above challan was issued by the constable on duty, whose name or number i did not note at all. I just accepted the challan because i was not carrying my driving licence. Does the acceptance of challan amount to disobeying the orders or refusal of information. I honestly accepted that i was not carrying my driving licence at the time of driving. Is the traffic police given a certain target to collect fines without the motorist committing any offence. I feel cheated by the above act of your police constable who has willfully levied charges without any offence being committed by me. I am enclosing herewith a copy of the said challan issued by the constable and request you to kindly delete the charges levied erroneously/purposely. I am very much willing to pay the fine for the offence committed by me for not carrying my driving licence, which i had accepted to pay.
