Honourable Sir/Madam,

I am Nilesh Bhate age 38 resident of Thane (Maharashtra). I subscribed to a premium service of no broker (Comprehensive Property Management Services) in which they are supposed to advertise, find tenants, arrange a visit and convince clients to take my property on rent, and update me on the progress. I paid Rs. 6, 000/- to NoBroker for these services on 18th June 2021. They had given a money-back guarantee that if they are unable to find a tenant they will return Rs.6000/- (see attached proposal email point no 3 under refund conditions)

Starting next week every week their relationship manager called me to update the progress but they couldn't arrange any visits or find any tenant who would be ready to move in till early July. Around the first week of July prospective tenant (Mr. Darpan Mohite) approached me directly who found my details on (99acers.com - a competition to Nobroker) (see email) as I had posted this property on many other real-estate & social media websites and finalized the deal after multiple visits and negotiations.

After few days when Nobroker person called me again, I told him this property is no longer available and I have found a tenant through another source so please refund my Rs. 6, 000/- as per your initial promise. However, no broker person told me you have to tell us the tenant name to process a refund so I told the tenant's name transparently after knowing that name they suddenly started saying this was our client and we are the ones who brought this for you. I asked him what is the logic behind this since you never mentioned this name or brought this person for a site visit nor told me about his interest till now and “when I told you the name" suddenly you have changed your tone? On which he said we see that this person has visited your property “on our website” so this is our lead and we won't be able to refund you money.

I was surprised, I told them I don't mind paying you but you never mentioned this person you are only saying when I told you to name do you have any proof that this was your lead? On which till now they haven’t shared any info and only kept saying that this person visited your property on our website so you are not eligible for a refund. Later on, when checked their site dashboard I found that they had this person's name mentioned as “rejected prospect” saying this person is not interested and they dropped it even this also was not communicated by them to ever in their entire period of 30-40 days they woke only after I told them a name.

Their junior executive was adamant on this part so I escalated this matter as per hierarchy to their team leader (Mr. Shahid) who called me and promised to sort out this matter in 1-2 days but the next day blatantly closed my service as "rented via no broker" and you are no longer eligible for a refund for which I raised multiple objections but they are neither replying to my emails, not calls (see attached)

Since it was a premium service no broker was supposed to advertise, find tenant, arrange a visit and convince clients and update me on the progress I never interfered in their process however they themselves have marked this as "rejected" in their system and committed that if property rented via another source they refund my money but now denying it.

I request the honourable consumer forum's intervention to get my money back with interest from Nobroker and penalize them for doing such malpractice and avoid future issues like this
