Sub: complaint against supertech builder “eco village 2 project plot no. Gh01, sector16b, greater noida west” for layout plan changes without my/our consent; seeking cancellation of the increase in the floor area ratio (“far”); withdrawal o[censored]ndue/illegal charges and penalties

Respected sir,

1. Background
1.1 the undersigned is a buyer of an apartment in the eco village 2 project plot no. Gh01, sector16b, greater noida west (“project”) constructed by m/s supertech ltd. (“developer”), of which building plans were originally sanctioned by greater noida industrial development authority (“gnida”).
1.2 it has come to my knowledge that pursuant to the original sanction of the building plans and layouts on the basis of which i had entered into an agreement with the developer to purchase apartments in the project, the developer without my consent as required under the uttar pradesh apartment (Promotion of construction, ownership and maintenance) act, 2010 (“apartment act”) has made certain changes in the plans and layouts of the project.
1.3 increased far has enabled the developer to encroach upon common undivided open areas and thereby reducing the open area that was disclosed at the time of booking.
1.4 the builder has imposed certain charges that were earlier not part of the builder buyer agreement (Bba). The law provides an inalienable right to a buyer to know what is being purchased, the numerical value of the area that he is being charged for and the liability for other charges.
1.5 the activity of the builder so far has been suspicious for its lack of transparency and communication, which in turn has led to various incidents of irregularities and violations.

2. Submissions / objections
2.1 increase in far area: any increase in the far of the project or any change in the original building plan and layout is likely to affect the interest and rights of the buyer and accordingly their consent are required for any such major change. I strongly object to the increase in far of the project on the following grounds, which are without prejudice and in addition to each other:
I. No consent of the buyer: prior permission of the buyer was not obtained for the purchase of additional far in accordance with the apartment act and hence, the same is in violation of the apartment act.
Ii. Contempt of allahabad hc: any increase in far without the consent of the buyer is a contempt of the directions issued by the hon’ble high court in the apartment act judgment. The allahabad high court has also issued a notice in this regard to the greater noida authority chairman on december 16, 2015 stating that no builder should be allowed to change the floor area ratio of their apartments without prior consent of the home buyers.
Iii. Adverse effect on population and encroachment: the increase in the far is likely to have adverse effects on the population density of the plot thereby straining the common amenities in the plot.
Iv. Allahabad court judgement: the aforesaid points were reiterated in an allahabad hc judgment with regard to implementation and enforcement o[censored].P. Apartment (Promotion of construction, ownership & maintenance) act, 2010 by hon’ble mr. Justice sunil ambwani and hon’ble mr. Justice bharat bhushan in civil misc. Writ petition no.33826 of 2012; m/s designarch infrastructure pvt. Ltd. & anr. V. Vice chairman, ghaziabad development authority & ors[7]. The judgment amongst other points specifically dealt with this particular problem and came to this particular conclusion:
“the far or any additional far is a property, appended to rights in the property on which the building is constructed, and is thus a property in which the apartment owners have interest by virtue of the provisions of the up apartment act, 2010. The purchase of additional far is not permissible to be appropriate by the promoter without any common benefits to the apartment owners. The consent of the apartment owners obtained by resolution at the meeting of the apartment owners by majority will be necessary for purchasing additional far. Its utilization will also be subject to the consent of the apartment owners.”

V. Violation o[censored]p apartment act, 2010:
• proviso to section 4 prohibits any alteration without previous consent and section 5 states that the percentage o[censored]ndivided interest of each apartment owner in the common areas and facilities shall have a permanent character and shall not be altered without the written consent of all the apartment owners. Both the sections, though deal with two different time periods in the life of an apartment owner, but have the same effect, i.E. Without permission no alterations can be made in the original sanctioned map.
• the competent authority has failed to enforce the act and demand the promoter/ builder to furnish the consent of the buyers. This leaves buyer completely unaware of the amendment in the map and therefore open area and facilities guaranteed under the layout are drastically reduced.
• the enforcement of an act becomes paramount and in this regard the builder and competent authority have failed to follow the 2010 act as well as the 2011 rules and enforce them in the true sense that it was required. The aforesaid provisions clearly indicate that any change in the building plans, specifications including far without the consent of the buyer is in violation of the apartment act.

2.2 newly introduced pre-possession letter is foreign to allotment letter:
I. There is absolutely no reference of due date/ number of days it will take to offer possession, after payment of dues in the pre-possession letter. Any possession related formalities without any firm deadline for possession o[censored]nits is meaningless, superfluous and simply a tactic of delay and extort money from the buyers.
Ii. Status of completion/occupancy certificates applied by supertech or approved by gnida-being a statutory compliance which is missing in this case.
Iii. The site visit clearly indicates that the essential committed facilities are not in place and possession without such benefits is meaningless.

2.3 suspicious activity of supertech, court judgements and inordinate delay in projects
I. Supertech’s application dated 15.12.2014 to gnida for issuance of completion certificate for ev-2 was rejected on 19.12.2014 by gnida.
Ii. Because of flouting building norms allahabad high court and supreme court had held supertech guilty of violating the state laws and norms in supertech’s emerald court, sector 93 a.
Iii. The possession has been delayed without any notification and providing any reasons for such delay. The buyers were invited on 28.2.2015 for possession ceremony and mr. Mohit arora, md of supertech publicly declared that the possession will be offered within 30 days. Further, many allotees have paid 100% of the amount but even after a wait for more than a year, they have not received any possession letter.

2.4 illegal/unduly charges:
I. In regards to the additional compensation charges, i would like to draw your attention to the rti number 10045 dated 27.11.2015 and the response by gnida. The rti states that the builder will not hold the buyer to pay for an increased farmer compensation charges and no such order was passed by gnida. It has been further stated that there is no such resolution passed in this regard which requires the buyer to make this payment.
Ii. Any request for the payment of remaining 5% is invalid at the time of pre-possession.
Iii. The buyers have been charged with “park facing plc”, but to our surprise there are no parks that were promised in the original layout. The park has been replaced with either new towers or other permanent structures.
Iv. Why is the builder demanding additional compensation when they started selling the flats in 2012 with a whopping of 50% increased rate? The builder buyer agreement (Bba) doesn’t mention any such charge or the liability of buyer to pay for such charges.
V. The labour cess has to be paid by the builder. Why is the builder passing all these costs to a buyer?

2.5 discriminatory practice: the actions of the builder have always been discriminatory. Some of the allotment letter contains an escalation clause, while some of them don’t.
Cape town is a project of supertech situated in sector 74, noida where the recent protest by the buyers compelled the builder to reduce the maintenance rate from 2.50 per sqft to 1.70 per sqft. The current rate for eco v2 is 2.50 per sqft which is unfair.

2.6 intentional delay in oc/cc: the developer is involved a dirty game, wherein they are not providing us the completion certificate from the gnida. Instead of obtaining the completion certificate they have started offering possession to buyers. There is a possibility that the illegal flats will get registered with the revenue department. Several rti applications filed by the rwas of many group housing projects including supertech have revealed that developers have built more than the sanctioned number of flats.

2.7 housing is a basic human necessity and the quality of the house as well as its environment plays an important role in the growth of individuals, both physically and mentally, which comes within the mandate of article 21 of the constitution. Any interference with such a right will be against the principles of article 21.
3. Requests
3.1 in light of the aforesaid submissions, i request you to pass the following orders:
I. Cancel the approval for purchase of additional far granted by greater noida industrial development authority to the developer.
Ii. Not grant any further approval for purchase of additional far by the developer in the absence of my consent in accordance with the directions of the hon’ble high court in the apartment act.
Iii. Direct the developer to seek prior consent of the apartment owners for any change in the original buildings plans, layouts, specifications, etc.
Iv. In view of the above, the pre-possession letter being extraneous in reference to the agreement, without any oc/cc and having undue/illegal charges is vitiated, redundant, and meaningless. Supertech should therefore withdraw the pre-possession letter and issue “offer of possession” along with the copy of oc/cc from gnida, indicating firm date of possession and schedule of completion/availability of facilities committed by supertech.
V. The builder should provide status of percentage (%) of open landscaped area and restoration of 82% open area.
Vi. Please update the buyer on status of park facing flats.
Vii. Withdrawal o[censored]nduly and illegal charges, such as:
• purported increase in super area which is vitiated and illegal.
• increase in the super area generally originates from the increase in common area. In our case the common area has eroded and 5 new structures have been built in the project. As an aggrieved buyer, i demand extra 10% compensation should be paid to each individual buyer and cancel the fictitious claim of increased far area charges.
• late interest payment, escalation charge, labour welfare charges, and additional compensation charges.
• the maintenance charges are very high and should be fixed at a nominal rate of 1.50 per sqft keeping in mind the recent decision at supertech cape town project (Mentioned above). The location of noida extension is relatively cheaper from noida and such adjustment should be made in the maintenance charges.

    Para 31 (Iv) of rules – noida-phase ii housing scheme, dated 20/01/1997 of central government employeew welfare housing organisation, presided by the secretary, department o[censored]rban employment and poverty alleviation, ministry o[censored]rban affairs & employment, pronounced, ”facilities like stair-cases, passages, terraces, parks, lifts etc. And common spaces and services, will be utilized by the beneficiary, along with other beneficiaries of the scheme and no one will have exclusive right to their usage, nor make any alterations thereto”
    Sub-lease deed pronounced:
    Para 12: the third party shall not without the sanction or permission in writing of the lessor erect any building or make any alteration or sub-divide or amalgamate such transferred leased dwelling unit.
    Para 14: the second/third party shall not in any manner whatsoever encroach upon the common land area and facilities and services not handed over to them. All unauthorized encroachments made by the second/third party shall be liable to be removed at his cost.
    Para 15: the second/third party shall on the determination of the sub-lease of the land, peaceably yield up the said land unto the lessor after removing the super structure within the stipulated period from the land.
    Para 16: the allottee has/shall become a member of the kendriya vihar apartment owners association, formed by the lessee for the purpose of maintaining and managing common areas of the flat. In case of any conflict, direction issued/discretion taken by the lessor shall be final.
    The hon’ble constitution of india in article 14 pronounced equality before law. And also in article 51a pronounced fundamental duties – it shall be the duty of every citizen of india (A) to enable by the constitution and respect its ideals and institutions...
    Above all, the master plan strictly warn not to demolish base wall(S) of building structure for two reasons 1) noida region is earthquake prone; (2) base-wall & supporting beam of a building being its backbone.     Started demolishing, i reported the matter in writing immediately to kvaoa office to come & do something. But kvaoa officials did not respond. Hence, the inmate of b-566 not only comfortably demolished base wall but also opened an outdoor & kept about 40-plant-pots all around to encroach entire common space meant for parking of vehicles. This is blatantly illegal.
    A passive or even tolerant attitude of kvaoa and the ceo, noida authority on this, encouraged other ground floor allottees as well for such unlawful demolitions and encroachment leaving no place for convenient parking of vehicles among blocks (Acknowledgment no.[protected], no.[protected], no.[protected] refers) so, onus rests with them of panic in upper floor inmate for untoward incidence caused, if any, due to this manmade earthquake hazard.

            In Block A Sec 122 Noida there are about 100 plots which are vacant.Bushes and shrubs have grown in these plots and many a times snakes and other rodents have been spotted.These plots are also used by labourers for defecation.Garbage and malba is also lying there.Mosquito breeding is also very common which poses a great threat of vector borne and other diseases. The electric poles on the streets have been removed by someone and there is darkness at night and many theft cases have been reported from here. So you are requested to take appropriate measures to clean the area aswell as make arrangements for street lights so that chances of thefts are minimised.

              I went for a movie yesterday evening at the Wave City Centre Mall on my bike. At the foot entrance of the Mall (next to the Radisson Hotel), the Noida Authority authorized parking guy asked for Rs. 50 as parking fee (that too in advance) for parking my motorcycle! All the charges printed in his entire receipt book were blacked out and he told me that the authority had authorized him to charge Rs. 20 for the first hour and Rs. 10 for each subsequent hour for motorcycle parking! I was told by that parking assistant that the parking contractor is someone named Mr. Chauhan in that area. This extortionist behaviour of authorized parking contractors needs to be checked, esp., the one next to the Radisson Hotel at Wave Mall's foot entrance. The other bike riders in the area tell me that this quite common in Noida and is probably very well known to the Noida Authority as well. No wonder the "Parking Mafia" is doing well in the city. I wonder if the DM of Noida is listening to the complaints and problems of the common man.
              Please confirm if noida authority parking charges outside RTO. Are Rs. 40 for 44 minutes. As I had to pay accordingly today, 4th December 2020. Adding image of the exit parking receipt.
              Noida authority parking at Sector 18 charges excessive amount. Rs 100 for 45 minutes. Time captured by the machine is wrong. instead of 6:45 it captured 4:45 and exit time is after 45 minutes.

                I would like to bring to your attention that there is a house behind ours where the family is engaged in commercial activity. They moved to this house in October 2013. Since the very first day, they have been washing clothes everyday. For couple of months, we were thinking that the family might be huge in count. But that's not the case. We finally got to know that they are running dry cleaning business and wash all the clothes here. They have couple of machines which creates intolerable noise. We requested them last month(January, 2015) to stop the machines or if they want to run, Take them inside the house from their backyard. But it didn't happen. Family sounds like illiterate and creates noise all the time. A complaint letter was handed over to Residents welfare association but no action was taken. It looks like they might have connections around.That's why they are doing it. I am not sure complaining to Police will have any impact on them. I would like someone from Noida Authority to look into this and take appropriate action.

                If you people can't take any action, then update whom should i get in touch with get this matter sorted out.

                  I am approaching you in regard with the Unauthorised Commercial Activity on Govt Encroached Land.
                  The lane between BSNL exchange tower complex Ganga Shopping Complex AVI Club in 29 Sector on one side and Park view apartments on the other side. Width of approx 15 fts plus. This area has been encroached by the 3-4 residents of park view by construction of one/two room set in 200-400 Sqft approx on this government land. These rooms have been leased out on monthly rent of Rs 100000 each approx.The encroachment is very prominent with proper with unauthorised electricity and water connection.
                  The construction is causing problem to co residents for parking. Moreover a charity school in the small shed is been run as a eye watch for 1-2 hours daily . I am under the impression that the matter is in knowledge of NOIDA Auth but no action has been taken for the reason well known
                  My request is to kindly resolve the issue of
                  Encroachment on Govt land left as a fire lane for safety been used for monetary gains
                  Unauthorised Electric and Water connection putting load on the supply and why no action by concerned authorities.

                    Sir, My House no.A139 Sector mu-1 Greater Noida scheme BHS06 was handed over to me in August-14. There is very poor work done & used poor material in finishing. 1- Plaster of walls getting damage within 5 months after possession. 2- Water leakage problem is continue from day one after possession. 3- Wooden work is very poor. 4- Marbles & tiles are broken in many places & top roof is also getting damage. 5-Accessories of house not completed. 6- Toties are not fitted properly & resulted water leakage.                           Hi Team, I am a resident of Plumeria Garden Estate, GH 01, Sec Omicron III (sec 34), GB Nagar, Greater Noida. We have collectively raised this issue multiple times and there has been action, however note the following: 1. Stellar Citi Homes Project is being developed in the vicinity of our plot 2. There is a clear increase in vehicular traffic of the heavy variety on the same route that leads to our plot. We do understand and appreciate the development, however would request the authority to ensure that the heavy vehicular movement does not further damage the already bad state of roads leading to our plot. 3. Other than this, there is normally an issue with street lighting leading up to our plot from the "Chimney Chowk" near Wipro building). This has to be resolved and kept in excellent working condition as there is a safety issue if this is not in place. This area is considerably less populated and if it dark, it normally leads to a breeding ground for anti social activity 4. Our complex has 700 plus flats and there are more than that in the Omaxe complex just a stone throw away from our plot. Stellar project should be adding a couple of hundred flats to this number. There are a few independent houses in the sector too. The issue is that despite this large number of residences, this area is not well covered by the following public utility services, namely BSNL for telecommunication, Indraprastha Gas for PNG etc. While Aicher village that is around the closest "known" inhabitation and market place for us Plumerians and other areas close by, it has all these mentioned utilities. Request that this be done at the earliest to provide us with some choice w.r.t service providers in these areas. Currently there is a monopoly and that is not beneficial to the residents. 5. State Owned banks could open operating branches or ATM's for the benefit of residents and also increase the visibility and convenience factor, along with property rates in this area. 6. State Owned gas stations could also help in increasing the resident status in this area by providing for outlets 7.

                          I am a resident of plot no 652, village bisrakh, greater noida west, gautam Budh nagar.My Concern is that, no street light is in working condition on the pole standing in-front or near by my house.

                          As the area is under developed and houses are vacant so the reptiles have been seeing around many times which creates fear in children and us, especially in winter season (Now) whereas lots of fog and darkness.

                          Request you to kindly repair the street light on the pole standing in-front of my house.

                            I am Rajeev Lochan Dubey from Ghaziabad. I am facing problems due to delay in physical possession of my house. I have already sent a letter via Speed post and an email to DCEO. I had purchased 200 square meter house on resale on the 22nd of May’2014, which is situated in Block A of Sector XU-1. We had then applied for physical possession in the first week of June’14. Since then, I have been in regular touch with the concerned persons (Mr. Dharamraaj and Mr. Shamimul Islam) from GNIDA who are said to be responsible for handling the physical possession of houses. In spite of my regular requests to the aforementioned concerned people, it is very disheartening to see that not an iota of work has been started till now. I have to shift in the new house within the best realm of possibility but it looks like your representatives or officers or supervisors will take another one year to handover the house to us. Sometimes, supervisors say that work has not been started due to shortage of labour etc while sometimes they say that contractor is not giving them money. Due to delay and uncertainty of house handover, we are under huge financial burden due to ongoing house rent and payment of additional compensation money to GNIDA. We have paid our hard-earned money and are paying loans and interests to the bank.

                              Good Afternoon, This is Prabhat Pandey from Delhi. I am writing this application in connection with the refund amount which I got from Greater Noida Authority after much delay and a lot of mental harassment from the authority officials. I applied for the authority's BHS17 Housing scheme in December after going through its advertisement on authority's website. I applied for 2 BHK Deluxe Flat (Area 83.38 sq m) and deposited the 10% amount of the mentioned cost of the flat which was 3.89 lacs rs. (Registration Money). I had been allotted a flat in this scheme and I got the allotment letter. But by then we have visited the proposed site of this housing project which is far away and we found that connectivity to Delhi and other important places is not so great. also, terms and condition of the payment plan are very harsh. So we have decided to withdraw from this scheme and decided to apply for the refund. According to the allotment letter and scheme's browser it was necessary to apply for the refund within one month of the issuing of allotment letter. Please note that the letter was issued on 29 January and I got this letter at least 2 weeks after the issue date but it was not taken in to the consideration. Never the less we apply for the refund on 19 February. And we have been told that we would get our amount in one month. Then our long struggle to get our refund started. Even after one month we did not get our amount. Repeated attempts to reach concerned officials and employees of the authority failed. I even e-mailed my complaint and query to various authority officials but got no response. I even visited greater noida authority's office but did not get any satisfactory response. Finally on 14 may I got a letter of the society which has issue date of 9 may and a cheque of rs 3, 50, 100 as our refund. 10% of the registration money we deposited had been deducted by the society. Reason for this deduction was not explained to us. Since no services from the society have offered to us, the deduction was beyond my understanding. We lost our valuable money and we would have got substantial interest on the amount if we would have got it earlier. I request you to kindly accept my complaint and do the needful to take steps so that we can be compensated for the delay in refund and the mental harassment.

                                It is really a menace on the road in front of 3C's Green Boulevard and DLF's building in sector 62 as the cars of employees of offices in these building are parked on the road. It becomes very difficult to move/drive on this road even to come back to my own house. The worst part is that a traffic police vehicle is usually seen parked at a distance of 50 mts but they never bother to get the road cleared of taxis and cars. Please take a needful action for the same so as the residents of the three society can also move on the road. Anuradha Rao.

                                  Hi, I am sure I am not the only one on this. We considered ourselves lucky to be allotted a flat in the above scheme. Original possession was due in September 2012 and we were told that it should not get delayed any later than December 2012. We paid the entire amount upfront (through a bank loan) and are currently paying high rate of interest; all this while hoping to get timely possession. To our horror, when we reached the site earlier this year, we were told that construction work stopped for about a year and a possession may only happen in year 2014 or 2015. When I decided to lodge a complaint against the delay, I visited the GNIDA office however there was no one available assist me with complaint process and I was told to write to the CEO (GNIDA) through email. Even before I could have done that we received a letter advising of an escalation of INR 168000. Why escalation? We opted for the project in 2009 and the pricing of the project was advised then should not have been changed. If it has to be changed, where is our option to walk out of this contract without suffering any losses. Now due to time limitation, we paid the INR 168000 also. Now we received another letter asking for INR 220000 ( app.). How did we, in any way, gained by trusting the local government. This is now becoming worse than placing our money on a shady builder. When we participated in authority construction, we were only expecting timely possession and no unnecessary rise in the costs but none of this actually happen. We feel completely disgusted and cheated by the GNIDA. Such a shame to have chosen you.                                     The SLF project at Noida Sector 123 is dangerous for nearby village and NOIDA sectors like 121, 117, 119, 122 - residents. Hope NOIDA authority should understand and scrap this SLF project at Sec.123. This prime location land may be used for other purpose like transport Hub/ Commercial space like shopping complex etc.

                                      We are residents of Block A sector 40 noida. There are a lot of stray animals in our society incluyding dogs and monkeys which create nuisance for all the residents.

                                      From last 6 months the roads of B Block sector-9 are damaged and didn't get repaired after the sewer work has been completed and people are suffering a lot due to this,so please I request you to take appropriate action against this and try to repair the road as soon as possible before the monsoon .

                                        ATTENTION All the allotee of Sector-3 built up housed...

                                        I have gathered some information about BHS 09 sector 3 houses...which are ready from last two years...but authority is not willing to give the possession...in anyway...

                                        As per October 2011 allahabad high court decision/order/ the authority is bound to give 64% increased compensation and 10% land to farmers...

                                        Builders of Noida extension has arranged money anyhow and given to farmers through Noida authority to complete the delayed project as soon as possible...and the construction is going on of the builders project now.

                                        but the project like sector 3 BHS 09 is still pending...you know why? The authority is not willing to comply the allahabad high court order...

                                        instead of giving the compensation to farmer authority have challenged the order in supreme court....now farmer of patwari and surrounding area also went in supreme court to comply the order of allhabad high court...

                                        Greater noida authority said to me that we can not give you possession untill the SC gives final decision.

                                        now the matter is pending in supreme court...but irony is that both the parties authority and farmers, not even mentioned the appeal filed in SC in six month back (last year).

                                        Mentioning means saying SC to listened the matter on priority basis...but both parties in the court have joined hand to exploit the original allottees of Sector 3.
                                        .
                                        It means both the parties are not interested and do not want to resolved the matter as early as possible. this is mutual understanding between farmers and authority.

                                        They just want that original allottees compel to sell the built up houses in lower prices and then the investor in project could earn lack and lack. on our hard earned money and lucky allotment in 2008.

                                        This is the whole story i have find out...Please tell me what to do now...as both the parties are in court and enjoying on our EMI and Rent paid by all o[censored]s.

                                        Please suggest what to do now to get our built up houses as soon as possible...because the condition is getting deteriorated of ready housed without maintenance.
