RESPECTED SIR

THE REGISTRATION OF MY FLAT IS GETTING DELAYED EVEN AFTER PAYING FULL AMOUNT INCLUDING REGISTRATION AMOUNT IN THE MONTH OF MAY 2010-

NO REGISTRATION TILL DATE.

NO CORRESPONDENCE FROM THE COMPANY IN THIS REGARD.

COMPANY OFFICIAL BLAMING SIDCUL FOR NOT PASSING THE FILES FOR REGISTRY.

EARLIER THE OFFICIALS TOLD THAT WITHIN 02 MONTHS OF FULL PAYMENT THE REGISTRATION WILL BE OVER..

I DECIDED TO BUY FLAT FROM OMAXE BECAUSE I TRUSTED THE COMPANY, HOWEVER MY TRUST HAS SHATTERED AS THE OFFICIAL LOOK BLANK WHEN CALLED OVER PHONE. THEY NEVER CONVEY ANYTHING REGARDING THE HURDLE IN REGISTRATION.

I AM AFRAID THAT MY 18 LAKHS OF RUPEES HAVE GONE DOWN THE DRAIN. MOREOVER I HAVE TAKEN LOAN OF 13 LAKHS FOR WHICH I HAVE STARTED PAYING EMI 03 MONTHS BACK.

WHAT TO DO? I M SICK OF THESE OMAXE PEOPLE..OONCHEE DUKAAN FEEKA PAKVAAN.....NAAM BADE AUR DARSHAN CHHOTE.........IS THERE ANY OFFICIAL WHO CAN TELL ME WHAT IS THE STATUS OF VICTORIA B FLATS?

PLEASE MINE IS HARD EARNED MONEY WHICH I HAVE INVESTED IN UR COMPANY'S FLAT....I DONT HAVE BLACK MONEY LIKE U PEOPLE.....PLS DO SOMETHING
ATLEAST TELL TRUTHFULLY WHAT IS THE MATTER? ASK SIDCUL WHY THEY AREN'T GIVING NO OBJECTION CERTIFICATE.....

    I had booked a plot in OMAXE II Indore in May2007. However, even after two years the company has not got the plot registered on my name.

    Rather, they have not developed the township. There is no power, no drainage and no water supply system

    Kindly help as I had purchased the plot on DOWN PAYMENT.

      CORRECTION IN STATEMENT OF ACCOUNTS


      1. Reference is made to my discussions with Mr Manu Kaushik and Mr Anil Kumar on 27 Sep 10 with respect to correction in final statement of accounts. This is to inform you that I have applied for a plot measuring 300 yds in your Omaxe City Jaipur project on 12 Jan 2005.

      2. All the payments against the plot were made well in time even before the development could finish in the area. Still I was allotted the plot in Phase – II No 1186 for the reason best known to company. As per advance registration terms and conditions signed on 12 Jan 05 and were subsequently accepted at your end, It was agreed that -

      “ In the event your intimation about availability of Plot is made to me after 6 months a simple interest @ 10% p.a. shall be paid to me for the period beyond 6 months on the amount paid by me up to the date the said offer of allotment is made in the confirmed project.”

      3. Keeping the above-mentioned criteria and the interest on following amount stand to be paid by you and need to be corrected in the final letter of statement of account issued by you dated 31 Aug 10.

      4. As per terms and conditions of allotment letter signed by both parties on 20 Jun 10, the project was planned to be completed within 2 yrs, extendable upto 6 months. But eventually after 4 yrs on 05 Sep 10, a letter was received from your end to take over the possession of the plot. Once an amount of 95% was paid by 15 Sep 08. The next plan was to take over the possession after 3 months after paying balance of 5 % amount. Which could not happen due to no development in the area and an amount of Rs 10, 04,750 was held by you without assigning any reason. As per terms of agreement in case of default in payment the interest charged by you is 18% for the first month and 24% for the subsequent period of delay and for allottee is at the basic rate of 10 % interest on the delay in handing over the project as enumerated below -

      5. So you are requested to credit a total interest of 33,925 + 1,25,593 = Rs 1,59,518/- in your last statement of accounts - as such a large amount was blocked at your end for such a long time.

      6. My previous cheque despatched to you on 15 Sep 10 of Rs 98,264/- dt 20 Sep 10 may please be returned. It is only after receiving the correct final statement of account will it be possible to make final payment and take possession of plot no 1186.

      7. Presently I am undertaking a service course at CAW, it may not be possible to me to visit your location due to service exigencies. Still I will take leave and visit the site only on getting confirmation from your end to further confirm on the development in the area where you have allotted me the plot. Hope you settle the above-mentioned issues at the earliest so that the visit goes fruitful and not mere wastage of time and effort.
      8. I request you to confirm the development work execution within the Omaxe city as per as per the terms and conditions of the seller- Buyer agreement for the Facilities & Amenities. To be legally right, Kindly forward the satisfactory completion certificate of the project cleared by Municipal corporation as per approved plan /map.
      9. If all facilities and amenities of the project go well then I would like to take over the possession of the plot and allotment of patta from JDA. Hope that we are able to resolve the issue at the earliest without taking it to higher authorities and consumer courts. Request provide feedback on my e mail address mentioned above at the earliest.

        irresponsibility and neglegency
        This mail i have wrote to the cmd of the group on 27th of August 2010 , since than i was waiting to hear from there side as i am writting my concern to the owner of the company , while the people who are here at this project not responding , but the surprising fact is still the situation is same and no one has approached me regarding my concerns .if you go through this mail , you will definatelly figure it out as they are playing with our emotion and finances .

        I am writing this letter with very heavy hearted ,as i have trusted Omexe being kind of reputation and commitment they were having with there customers and after that i decided to buy one flat at your Derrabasi project . At the time when i bought this flat in Mrach 2010, its resale purchase and i have been committed that Tower no 2 and flat 213 will be ready in a May or June 2010, and i made the 95% payment along with other charges 2 lakhs and 5 thousand as being asked , while i trusted Omexe and there people and i further decided to move in on rental accommodation seeing the time tenure i got to have my flat possession.I am even the first resident who moved in with my family in month of June 2010 on rented accommodation but after moving in , i experienced worst kind of treatment i received here and things made my life hell ,

        Since than i am requesting and fighting for survival , i was forced to consume water from tanks , electricity was a major issue there at that time , cleanliness is a big concern , lifts are not working , over and above residential place turned in to hostel .
        As i have spoken to Mohit on these issues when i got helpless from the concerned people here at Omexe on dated 20th July and he asked to give him time till 30 th of July, i again called him back on 1st of August , as he still asked weeks time and even assured me Tower No. 2 will be ready by 31st of August and i told him this is some thing very challenging but he assured me.

        0n 19th August , i called him again and update him regarding the situation having here , but he was assured by his construction people that things are pretty well here and under controlled and even congratulated him as Mohit told me about ,but after having discussion he assured to make a visit on Weekend.
        again i callled Mohit on 25th of August as he didn't make it .

        But said part is while during all my conversation , which i feel no one is taking things seriously here, even no one try to approach me after being intrecting seniors.

        As i received a call from Mohit same day on 25th of August and he start asking whether i am abusing labour at construction site , as he was told by the construction people. what i believe ,it is just to retaliate not being doing there work properly and on time , they start talking these excuses with Mohit.

        surprised for me is , reacting on such incidents which never happened and without knowing the facts, i found it very irresponsible and immature way to behave and while i have send a message back to him just to clarify the things as he stop responding the phone calls. i never got a return call , which means whatever people saying here Omexe is agreed with it and my concerns having no values .

        Here i am writing you to pls clarify the things in black and white, regarding the possession of tower 2 and amenities will be up by what time and what compensation will we get for being delayed .

        I am sending you a mail along with this,which i wrote long back to the post sale cr department , till date no one responded back
        I am pretty hopeful you can take these things seriously and would appreciates understand the concerned , its not far when residents from here start taking things in to there hand and will reaches to you everyday if things will not get improve.

        Thanks for being so concerned and i would like to bring in your kind notice that at Omexe Green they don't have fresh water supply , we are consuming storage water from tank and its hard to even use that water for bath so u can very well understand how hygienic is this to drink .

        Here i would like to bring in notice that being the single resident at Omexe Green at this time , i am very disappointed from the company side while there was natural calamity happened last week and since than i am talking to person here to help me to get back to normal life as i believe this is prime responsibility of your company . Since than we have NO WATER ,NO ELECTRICITY , i am residing in hotel from last one week with my wife and two little daughters, instead to expedite the restoration work , i am always getting the reply what we can do , we are trying our best but still i am not sure how long it will take and whether company will bear my cost of living .
        I hope you people can very well understand the situation and to avoid the legal hassles please look in to it otherwise i am not left with no other option to approach the PUDA and local authorities.

        Complaint against Omaxe Palm Greens, Greater Noida – refund demanded

        I would like to bring to your kind notice harassment through which I am going through due to Omaxe Builder.
        1. In 2006, I booked an apartment with M/s Omaxe Buildhome Pvt. Ltd., and till now have made payment of Rs. 29, 84, 828/- without any delay in installment.
        2. In 2007, I was allotted Flat No. 202, in Tower Peach Palm A, 2nd floor in Palm Greens project in Sector MU, Greater Noida, vide Allotment Letter dated 21/09/2007, having reference no. OBPL/COMM/MU/GN/584
        3. I have been paying Omaxe regularly, without delay even during recession and have paid approx 30 L till noe.
        4. Even after 4 years, I am surprised to see that still not even structure of towers are ready. It has been 4 years since that flat was booked and till date, the company has not been able to erect even the structure of apartments.
        5. At the time of booking of this project and in Builder Buyer Agreement, the project size mentioned is 50 Acre. But Omaxe reduced the size of plot drastically by more than 50% to only 23 Acres, without even informing their customers.
        6. After reducing size of the project, Omaxe added future projection towers in between the under construction towers, making the overall project too cluttered with buildings. Omaxe also reduced Project features in the new layout thus reducing it from 16 features to only 8 features. What was supposed to be the USP of this project, is no where in the new layout.
        7. The builder is also forcing me to sign the Builder Buyer Agreement of 50 Acre, which I believe, is drafted very heavily in Builder’s favour. I have registered my protest against this with various officials but nothing has been done in this regards.
        8. I have written several mails to them, visited their office many times and wasted complete day just to discuss my case with the concerned person. I gave them option to switch me to any other ready to move project and I will pay the differential amount right now. But non one listens to my request.
        9. Omaxe has now come up with Orchid project in same area, where in cost of the project is further deuced and is all inclusive of parking, club facility etc, for which I am being charged in tune of 7 L approx. Since this project has kicked off, means Plam greens project wil be further delayed.
        With support of your services and in the light of the aforementioned facts, and that the builder is not doing construction to complete this already delayed project, I request you to take appropriate actions against the builder and help me in complete refund along with interest.

        I am also in the same boat. Deposited all their demands and now they say they want to shift me to another tower. I am prepared to join together to fight this injustice.I am asking for refund of my money but to no avail.

        I have similar experience with this builder having invested in the same project. I never expected this from a reputed company whose chairman is the President of National Real Estate Development Council (Naredco.
        I have paid Rs. 21, 00, 000 so far. It is a hard earned money and it pains to see this being in the grabs of an affluent builder.
        This company has no customer ethics. They do not pick-up calls, would not keep promises to call back, will arise voice at their customers, will deny saying things they ahve said. I have all the details of email communications with them. Unfortunately, no details of telephone communications due to obvious techinical reasons, which could exposed their appalling behaviour with customers.
        I fully support Mr Singh’s complaint and hopefullly it brings justice to us.

        Had booked 4 bhk in Gold Palm -B. Paid booking amount 1.5 years ago.
        Now The building is not going to be constructed. Instead ORCHID will come up there. This all being done without our notice.While on phone they are telling that they are starting construction in a few days
        Let us get together. Higher a known Lawyer who is really known or relative of some one known. I am ready to contribute money for the fees. Let us get our money back. This project is in mess. And perhaps
        will take another 5 years to get delivered. They are just cheating us

        Complaint against Omaxe Ltd for refusal to refund booking money

        I had booked a 3 BR flat with Omaxe North Avenue II at bahadurgarh and paid an amount of Rs 2, 80, 000.00 towards booking amount for the said flat whose ref no. is OL/3BR/BHF/P/569. I had got a bank loan approved for the same but after my loan got approved and the bank asked for various documents from the builder, Omaxe ltd. kept dragging the amtter but did not provide the loan and finally after checking with the bank, i came to know that In 2009 I came to know that the Omaxe had scrapped the plan for construction of 3BR towers. after this I started asking the builder for the details of the project through various wrriten and verbal communications but they kept delaying teh matter on one or the other pretext but did not provide me with any concrete details. After waiting for long for company’s response, i decide to take a withdrawal of my booking amount and applied for a refund.
        Now, after about a year of application for refund, the company fails to give any response on the same and is also denying to make any refund. Since I am in need of the money urgently to support my old parents and my family, with the help of my legal advisor, I have sent three legal notices to the company for refund of money. Till date, the company is not responding to any of my communications and on the refund money, which clearly shows their wrongful intentions of dishonestly misappropriating the booking money and convert the said money for their own use. I request to the members of the forum to support me in getting the refund amount back from Omaxe ltd., if possible.

        Complaint against Omaxe – Omaxe Ltd delays refund of booking money

        I had paid Rs 300, 000(Rs Three lacs Only) towards pre-booking amount of flat for Omaxe’s Ajmer Road, Jaipur project thru second purchase from Mr. Vishal Gupta vide receipt No 7700088 dt 27/06/2006. The title assignment was duly registered by Omaxe in my my wife Mrs RUCHIRA SRIVASTAVA’s name. The builder did not even acquire land for the project. On enquiry about status of project Omaxe employee’s always gave false assurance of project getting started soon.
        Fed up with their lies, finally on 12/03/2009, I applied for refund of money alongwith interest and deposited all necessary documents alongwith original receipt. So far neither Omaxe has refunded money nor any satisfactory reply is given by their employees. On telephonic enquiry they say that Company does not have money and as when Company has money- refund will be processed. I complained at their web-site twice but nothing happened. On calling telephonically at their H.O- Delhi- line is put on hold for long.
        Despite mails to Mr. Rohtas Goel, Sunil Goel MD ED- no response from company.

        Omaxe refuses to refund money on Omaxe Heights, Bhiwadi project

        I invested in project “Omaxe Heights (G+9) at Bhiwadi” in 2006, paid Rs2, 50, 000.00 as advance registration amount in 2006, receipt 55002882 dated 9th June 2006.
        Paid second installment of Rs1, 32, 950.00 receipt 309866 dated 27th May 2008 against the allotment letter of flat No. 305, Tower Carnation A, in Residential Township Project “Omaxe Heights (G+9) at Bhiwadi” dated 29th April 2008.
        I was alloted flat No. 305, Tower Carnation A, in Residential Township Project “Omaxe Heights (G+9) at Bhiwadi” on 29th April 2008 and post that no communication on further status to till date.”
        But there is no progress in project till date and there is nothing on ground for that project, the project is inconclusive and appear to be abundant till date. As on date because of extra ordinary delay I am not in position to cope up further with this unreliable company. Hence I requested them to refund my money. In response to my refund request, they don’t respond to my emails and also they made me visit multiple times to there Head Office in Kalkaji, New Delhi and to add on to my suffering they don’t behave properly to a Senior Citizen.
        To add to my irony, the refund formalities they have given to me are not as per the realty of there extraordinary delay but are actually required for the cancellation of allotment in case the customer is at fault which is not the case here.
        I am Senior citizen and Heart patient and cannot follow up any more as I was doing in past. Hence I request ICF body to help me in getting refund of my investment with interest from this fraudulent company. With due regards it is to submit that I shall be greatful if given a chance to present myself with complete records available with me to the competent authority in NCR region.

        Omaxe Heights Cheating
        April 6, 2010

        1. Omaxe, vide letter dated 23 Mar 10, has intimated that instalment number 11 of Rs 2, 38, 562.50 is due on 08 Apr 10 for Omaxe Heights, Faridabad.
        2. As per Agreement, instalment number 11 was to be paid only on completion of Flooring. However, during my visit to the above mentioned site on 21 Mar 10, I found that Flooring work has not started. Further, internal plaster has also not been completed, which was linked with completion of instalment number 10.
        3. Also, marketing representative at Omaxe Heights was very pessimistic about the progress. He did not arrange the site visit and told me to speak with the security guard to take me around; while he was reclining in the Sofa. I had to plead repeatedly for the site visit and only after major altercation, I was successful in visiting the work-site. Also, I observed that the pace of work at the site was very slow and hardly any manpower was being employed. This proves that the Project is heading towards further time-overruns, and Omaxe is totally non-committal.
        4. In view of the above, I am doubtful of the progress of the Project.
        5. I requested Omaxe to provide me proof of completion of Flooring to enable me to make the payment linked with this stage of completion. However, the same has not been provided.
        In these circumstances, I should not be responsible for any delay in payment and associated interest.

        Professional Movers and Packers, New Delhi — Noncommittal of promises

        Dear Sir/madam,

        Please find the mail below send to the professional Movers and Packers for claim of damage incurred during the transportation. Please do the needful. I am ready to provide all the evidences. Looking for justice through you.

        I booked my luggage on 6th of February, 2011, from Delhi to Patna. I declared an amount of 56,000 for my luggage and paid 3% value of it for insurance coverage. I was assured to get my insurance receipt though mail but till date, I did not get the same. I got my luggage delivered to my residence on 12th February around 11:30 p.m. I gave receiving for the same to the concerned person. As it was very late at nighttime, i did not go for unpacking of things, but when we are unpacking our things slowly, we found that there are a lot of damage, which is summarized below:

        Dent in fridge.
        Dent in Washing machine.
        Dent in microwave.
        Broken cover of sewing machine.
        Broken glasses and tray.
        Broken fridge stand.
        Broken 2 bucket (2-3 kitchen utensils are missing, which was kept in these buckets).
        Bending of vegetable stand.

        Please allow me to have compensation of these through insurance coverage for the same.

        Looking forward for the best cooperation from your side in the most professional way.

        I faced same issue with Agarwal Packers and Movers who claim that they are India's best with ISO certification and expertise in highly professional way of handling packing and moving of house hold goods. Not only was my washing machine completely broken when delivered but also APM dealt the entire matter in a highly UNPROFESSIONAL manner. I have sent the board members an email with all my complaints but as I had guessed they also lack the basic professionalism and courtesy to deal with customers. They must be brought to the court of law and I will see to it.
        Friends, i have also booked a house in Omaxe Palm geers, Greater Noida in 2006. I have realised the intentions of the builder in first 6 months itself and so I have applied for a refund in Aug 2007, which they have denied. After repeated communication, then they did not responded, I filed a case against them in Consumer court. Its been 3 years and now in final stages. Lets see what happen.

        BUT its not just me, there were 15 cases against this builder, which were heard on the same date. 15 is a number on one days, but i am sure there are 100's of them injust one consumer forum. Story is same for everyone.

        OMAXE is one of the biggest cheats in this trade, so beware to all your friends and relatives. Whatever happened with us, should not happen with others.

          I do hold a flat no 3 in Bay hill Towers , NRI City , Putting Green Greater ,Noida for which I have made the full and final payments in Mar 09 .

          I have been doing follow up with multiple peoples Since then to get my flat ready for handing over to me but all of my efforts are in vein .

          I have visited my Flat last month and I have not seen any progress /efforts to make my flat ready for the procession. It is in pathetic state with lots of seepage all around.

          I have been getting response from your staff that as of now the registry by Greater Noida Authority is on hold and we need to wait till further communication from GN Authority in this matter. I have also Checked with Greater Noida Authority and understand that the Omaxe has not made the payment of their dues to Greater Noida Authorities due to which the registration of the Omaxe properties are in question .

              Omaxe demanded a payment towards "Completion of Flooring" but on visit, I found that flooring was not done and there were many other shortfalls as well, which I informed and shown to their site executives and they acknowledged and promised to complete it ASAP and will inform me to inspect before making payment.

              On the very same day 29-May-10, I also visited OMAXE Delhi office (Kalkaji) and submitted a letter stating above concern. This is really surprising that no action has been taken till date and OMAXE has sent a reminder letter with same old due date of 28-May-10.

              Since OMAXE has not completed this CLP milestone (Completion of Flooring), hence any demand for payment toward this milestone is not valid. Subsequently no interest can be levied or imposed on cusotmer.
              They are really making our fool and nothing else. We have to be together and make a case against them. We have called them and mailed them so many times. They don't pick up the phone and they dont reply on email as well. Which type of customer service they are providing to us. They don't even bother to give correct information. I am really fed up from their behavior as well as from their service. They have committed us to give the flat in march 2010 and still no information is passing to us.

                Unethical practice of Omaxe in Omaxe Heights, Bhiwadi

                Even I booked a flat in May-06 and allottment was done in May-08 in Omaxe Heights, Bhiwadi. Already deposited around Rs. 5.17 lacs but no courtsey shown by OMAXE to provide the status of my allottment. I had paid several visits to Project Site Office (Bhiwadi) and Head Office (Kalkaji, Delhi) but no one could provide me the correct status of project.

                Customer Care is pathetic and behaviour is not all cusotmer friendly. Very...

                1. I made a full down payment for my flat as at the time of purchase i was told that the work is almost complete and possession will be given with in 12 months. The executive ther at the site Mr Sukesh Sharma very clearly wrote on the paper while explainig the project details that possession will be gien in an year or so and there is no need to go for construction linked plan as more then 60% installment is already given. It would be benefitial if you go with full down payment option. From past 2 year i have to pay interest on the full loan amount that i have taken.

                2. Secondly an assurance was given that if possession will not be given my July 2009 the Omaxe will make a payment of RS 5 per Sq feet. This fact was never highlighted that in agreement time period mentioned is 36 month. We bought the flat after 2 years of project start even then agreement we signed was the one which was given to the customers at the launch time.

                3 We have to bear the extra income tax burden as we cannot claim Home loan benefit until we have the possession. If false facts have not been told to us that possession will be given in 2009 then we may have not invested in this project because we had plans to live in our own flat. Now i have to bear my house rent , extra income tax and the loan interest
                .
                4. To some of the customers a discount was given to existing customer when they escalated the matter. Also other fact that i came to know id the prolect paln has been changed alot since starting. Initially the project was for luxury housing and now changed to budget housing.Initially it was planned in 50 acres and only 16 towers wer planned . But on later stages 2 more towers added and the land area reduce to 23 acres. The amount taken from us was for luxury housing but in return we are getting a flat of budget housing scheme which is too much

                I want to present these facts to senior mangment and want to renegotiate the flat price/ get some discount for the losses i have to bear for the false facts produced by your employee. Please tell me the way how to go about it. How can i escalate the matter and reach to the managment?

                nobody in omaxe is ready to reply, thre exectuives were assuring posession this year may 2010 plater on thye extended till sept, but seing the construction in progers itseems it will be tough to get in next 6 month .

                Plus now they are not even reposndinmg, even quality of construction sems to be very average.whats the point of just laucnhing and not delivering what u promised .
                Omaxe has now hired the hackers and sending the complaint removal request throught them...

                  I have booked 2BHK flat in Omaxe New Heights Faridabad Sector 78, I have been alloted a flat & I have paid 320k now I want to go for bank loan. I have already submited loan sanction letter...but no updates from Omaxe..even their official persons are not clear one project's map will be approved by HUDA.. I HAVE DONE MAY FOLLOW UPS WITH DEALER ALSO BUT ALL IN VAIN... every month I am told that I will take 2 to three months... Now I have started feeling something milky...
                  Omaxe will become such a unprofessional I never thought of. No clear on project status, payment and future.
                  Omaxe new Heights is not approved for bank loan, but Omaxe is still asking for money, by saying pay from your pocket...even they don't know when project will approved, very unprofessional behaviour...brand name and all is crap...

                    Division Bench, consisting of the Hon'ble Acting Chief Justice and Hon'ble Mr. Justice Rajiv Sahai Endlaw of the High Court of Delhi, on a public interest litigation WP(C) 5324/2012 filed by an investor, have issued directions to the Reserve Bank of India and Securities & Exchange Board of India to investigate against real estate companies who are inviting booking of property from the public with assured returns. The Hon'ble High has also further issued directions to take further remedial steps not only in restraining inviting booking on assured returns but also to take other action as permissible under law as well.

                    ORDER / 29.08.2012

                    1. This petition is filed in public interest. The petitioner has brought to the notice of this court that respondents no. 7 to 10, real estate development companies are inviting deposits from public with assured returns with buy back options. The submission is that the same amounts to banking activity within the meaning of Section 45-IA of the Reserve Bank of India Act, 1934 as applicable to non-banking financial corporations and is without the permission of the Reserve Bank of India as well as SEBI and cannot be undertaken by respondents no.7 to 10. It is further pleaded that not only are the said activity illegal but it is possible that small time investors having limited funds would be duped by such companies.

                    2. We find that the petitioner had sent a representation to the Reserve Bank of India and SEBI only on 10.7.2012. Learned counsel for SEBI has appeared on advance notice and has submitted that on the representation of the petitioner, action has been initiated and the matter is under investigation. He has produced copies of letter dated 06.08.2012 addressed to respondents no.7 to 10 asking them to submit required documents to take further action.

                    3. Since the matter is already under examination by the concerned authorities, it is not necessary to entertain this stage except for directing the RBI and SEBI to conduct and conclude the probe at the earliest and if it is found that respondent no.7 to 10 are not eligible to undertake such activities, take further remedial steps not only in restraining these respondents but also to take other actions as permissible under law as well. Petitioner shall be intimated about the outcome of the proceedings of the SEBI.                         1. Omaxe, vide letter dated 23 Mar 10, has intimated that instalment number 11 of Rs 2,38,562.50 is due on 08 Apr 10 for Omaxe Heights, Faridabad.

                        2. As per Agreement, instalment number 11 was to be paid only on completion of Flooring. However, during my visit to the above mentioned site on 21 Mar 10, I found that Flooring work has not started. Further, internal plaster has also not been completed, which was linked with completion of instalment number 10.

                        3. Also, marketing representative at Omaxe Heights was very pessimistic about the progress. He did not arrange the site visit and told me to speak with the security guard to take me around; while he was reclining in the Sofa. I had to plead repeatedly for the site visit and only after major altercation, I was successful in visiting the work-site. Also, I observed that the pace of work at the site was very slow and hardly any manpower was being employed. This proves that the Project is heading towards further time-overruns, and Omaxe is totally non-committal.

                        4. In view of the above, I am doubtful of the progress of the Project.

                        5. I requested Omaxe to provide me proof of completion of Flooring to enable me to make the payment linked with this stage of completion. However, the same has not been provided. In these circumstances, I should not be responsible for any delay in payment and associated interest.

                        Omaxe heights is already delayed and going to be further delayed.
                        Omaxe has demanded the 2nd last installment which will make 95% payment. When I visted the site, I was surprised that flooring is not all done and lot of shortfallswere also there.

                        So I had given a letter but no response even after 2 weeks.

                        Site conditions and current state of the project suggests that it will take another 1 year (atleast) to offer possession. May be I am too optimist to mention 1 year.

                        Don't know if they will adjust or pay penalty as per the buyer-seller agreement or not? Since only 5% payment will be left on possession which will be not enough to adjust penalty amount.

                        May consumer court can help in this regard.
                        Lat week I also visited the site and representative told me that it will take atleat a year to complete the work. Few months back, I noticed that work had almost stopped but now atleat I saw labourers working :).

                        What will be the penalty on the omaxe management? I think, as per the agreement, they should have given the possession within 30 months.
                        I fully agree with the above post, i do have a flat in omaxe height marc tower.

                        when i visit the site few month back i didn't see any progress in the project.

                        I do take the update of project regulary on phone and every time they told me
                        that they are about to start the flooring and it is the same answer since last 2-3 month.

                        Shame on you Omaxe.
                        i want to know the name of that employes in omaxe who is basically from indore and did their m.tech from banglaore and lives in sector 21-c. actually its is not complaint but i am trying to know that person he is my friend and lost some where and a good human being
                        I agree - Since almost an year Omaxe rep on phone kept saying that the possession will be given in next 3 months and the three months never completed. Again they have given the tentative date on the email as below

                        With reference to your under mentioned mail, This is please to inform you that the possession of FNP/PACIFIC/XXX/XXX would be released in the month of March Tentatively ". Lets see. (I removed my flat number from the copied email)
                        Lets us make Omaxe Heights Community..I am Prashant Sharma..I am also holding a Flat in Petronas Tower..They are making us fool. If anybody want, I can launch a website also wherein Omaxe Heights people can join and we can discuss the concerns there and probably we can supress Omaxe to give the possessions ASAP and fasten the work in township.

                          I had booked a flat in Omaxe's Bhiwadi project in the year 2005. Till date they have not started construction of the same. While contacting they are always giving false statements and are offering some other projects.

                          As we do not trust this builder any more we donot want their any other project. Upon asking refund they are saying that we are accepting refunds. And also they boasting that they are not scared of any court or law. We may go to any court according to them.

                          I have sent numerous letters and mails regarding the same but they do not even bother to respond.

                          I request if this consumer forum can take up this matter and we can get our hard earned/tax paid money back from this fraud builder.

                            Dear Sir
                            This is regarding a real-estate company Omaxe Ltd. which I thought to be one of the best names in the real estate market.But the episode which happened with me totally blew my good perception about the company and has made me to believe that these agents are no less then fraudsters when it comes to money.
                            O maxe comes out with a pre-launched offer for a group housing scheme in Sec-78 Faridabad “Omaxe New Height” with written terms and condition to launch and allot the flat maximum with in 30 months of time, though I was told by the representative that the project will be launched within 2 months with very lucrative offers for pre-launched buyers.
                            On listing so many promising aspects I booked a flat and paid a sum of Rs. 2.5 lacks through the NRE cheques dated 4th of Sept. 2009 on booking amount.
                            As per the Omaxe Sales executive Ms. Shivani Chadha confirmation after 15 days Omaxe will send me the agreement paper of the project for official signature.

                            But after passing 18 days Omaxe do not send me anything .After so many follow-up calls company send me only the receipt of 2.5 lacks which I had paid by cheque at the time of booking.When I asked about for agreement paper Omaxe response is agreement paper can only be send by the Omaxe if I will pay 25% BSP of the project.
                            I explained him that as per the agreement by the omaxe , the Omaxe shall send me the agreement paper first and after that I will pay 25% of BSP of the project. But Omaxe is firm in his position and looses his faith in front of me.
                            Due to the twisted situation I totally loose my faith in omaxe and requested to the Omaxe marketing executive Shivani chadha to cancel my flat and return my booking amount.
                            After 4 month follow-up one day shivani chadha told me that the company has accepted your request and ready to return the amount after 20% cut of the booking amount.I ready to accept the Omaxe proposal. She told me that as per the company procedure for returning I will give omaxe the affidavit copy and original receipt of the booking amount.

                            On faith I given the original receipt and affidavit copy to the Omaxe company, shivani told me that you will receive your amount only after one week.
                            But every week when I call her she is telling me that the work in process and I will receive the amount in next week and by doing so 8 months has passed and till now Omaxe has not returned my money, and telling me the same response.
                            Sir, I should request you please help me in getting our hard earned money back from the omaxe .i and my wife have worked tirelessly for better and secure future.
                            Your quick response for future course of action will be highly appreciated.

                              Till now menas after passing 8 month he is only giving the promise and not returning the money.

                                I was booked a flat in faridabad "Omaxe New height" Sector -78 with booking amount of Rs.2.5 lacks and as per the agreement with the Omaxe, the Omaxe will give me the agreement paper after 2 weeks only. But after passing 3 weeks he do not give me any paper and demand for the next installment. I tell him that first you give me the agreement paper of the booked flat and after that I am ready to give you the next installment. But he was not ready to do so and therefore I request him to cancel my flat booking and return the booking amount.
                                Till now after passing 8 month he do not returned my booking amount and in response always telling me that the returning is in process.
                                In the mean time I gave him the affidavit and original receipt of the booking amount as required by omaxe in hoax promise with me to return the booking amount.
                                Presently in back-up I have only booking amount Xerox receipt and the bank check copy with signature of receiving the amount by omaxe.

                                Sir, could you please guide me what I will do with omaxe so that I will receive my booking amount.

                                  otherwise we can sit for hunger strike and call to media and expose them (omaxe builder). They are cheating to poor people. We should raise our voice ther in consumer court and parliament house.

                                    Non Proper Service of DTC bus at route No. 764
                                    I am a resident of Nazafgarh , Delhi. Since last three months we are facing a very big transportation problem from this area. The DTC Route No.764 buses are not available in the morning time (from 8am to 10 am) whcih results the commuters couldn't reach office in time. After several complaints to the DTC complaints cell there is no action has been taken till date to solve this problem. The depot incharge is also not doing anything in these route. He doesn't bother to hear the commuters complaints. We also doubts that he or the drivers are taking bribe from Blueline bus owners & playing game with public. But from last three days we are unable to get the AC buses also and at first the difference of time between the two buses were 20 minutes gap as told to us by the conductor but last three days we are getting the buses after 45 to 50 minutes differences . and talking to the DTC authorities on their telephone no they are giving different numbers to contact for the further complint .You are requested to kindly look into the matter & do the needful for the proper services 764 bus routes on time.

                                    DTC — routes not followed

                                    Non - compliance of bus route by bus no. DL1P C 7709 (route 770 A ) as on 22 august , 2011 @ 330 pm

                                    the above said bus was supposed to enter palam village when coming from Dwarka but the driver just avoided that route . we followed the bus by own bike n stopped the bus after the palam railway stn . bus stand by stopping the bike in front of bus in the middle of road. when we boarded the bus n asked the driver why he didnt follow the route. he gave a very rude answer that its his own wish , he will take the bus from wherever he wants. we also asked for the complaint book from the on duty conductor , for which he refused and said that he doesnt have one.
                                    as every one knows that each DTC bus has a complaint book , also they are supposed to follow the proper routes. this behaviour of the on duty driver & conductor was very un-social . strict actions should be taken against them so that others shall follow the routes properly.

                                      I have booked one three bed rm flat in omaxe Chocolate Palm green Sector - Mu, Greater Noida. I want to cancel the booking, but the company is not refunding the money. I have been trying for it for past one year, but the company is not accepting my application for the cancellation.

                                      I would like to bring to your kind notice harassment through which I am going through due to Omaxe Builder.

                                      1. In 2006, I booked an apartment with M/s Omaxe Buildhome Pvt. Ltd., and till now have made payment of Rs. 29, 84, 828/- without any delay in installment.

                                      2. In 2007, I was allotted Flat No. 202, in Tower Peach Palm A, 2nd floor in Palm Greens project in Sector MU, Greater Noida, vide Allotment Letter dated 21/09/2007, having reference no. OBPL/COMM/MU/GN/584

                                      3. I have been paying Omaxe regularly, without delay even during recession and have paid approx 30 L till noe.

                                      4. Even after 4 years, I am surprised to see that still not even structure of towers are ready. It has been 4 years since that flat was booked and till date, the company has not been able to erect even the structure of apartments.

                                      5. At the time of booking of this project and in Builder Buyer Agreement, the project size mentioned is 50 Acre. But Omaxe reduced the size of plot drastically by more than 50% to only 23 Acres, without even informing their customers.

                                      6. After reducing size of the project, Omaxe added future projection towers in between the under construction towers, making the overall project too cluttered with buildings. Omaxe also reduced Project features in the new layout thus reducing it from 16 features to only 8 features. What was supposed to be the USP of this project, is no where in the new layout.

                                      7. The builder is also forcing me to sign the Builder Buyer Agreement of 50 Acre, which I believe, is drafted very heavily in Builder’s favour. I have registered my protest against this with various officials but nothing has been done in this regards.

                                      8. I have written several mails to them, visited their office many times and wasted complete day just to discuss my case with the concerned person. I gave them option to switch me to any other ready to move project and I will pay the differential amount right now. But non one listens to my request.

                                      9. Omaxe has now come up with Orchid project in same area, where in cost of the project is further deuced and is all inclusive of parking, club facility etc, for which I am being charged in tune of 7 L approx. Since this project has kicked off, means Plam greens project wil be further delayed.

                                      With support of your services and in the light of the aforementioned facts, and that the builder is not doing construction to complete this already delayed project, I request you to take appropriate actions against the builder and help me in complete refund along with interest.

                                      I am also in the same boat. Deposited all their demands and now they say they want to shift me to another tower. I am prepared to join together to fight this injustice.I am asking for refund of my money but to no avail.

                                      I have similar experience with this builder having invested in the same project. I never expected this from a reputed company whose chairman is the President of National Real Estate Development Council (Naredco.

                                      I have paid Rs. 21, 00, 000 so far. It is a hard earned money and it pains to see this being in the grabs of an affluent builder.

                                      This company has no customer ethics. They do not pick-up calls, would not keep promises to call back, will arise voice at their customers, will deny saying things they ahve said. I have all the details of email communications with them. Unfortunately, no details of telephone communications due to obvious techinical reasons, which could exposed their appalling behaviour with customers.

                                      I fully support Mr Singh’s complaint and hopefullly it brings justice to us.

                                      I am having the same problem.

                                      Had booked 4 bhk in Gold Palm -B. Paid booking amount 1.5 years ago.
                                      Now The building is not going to be constructed. Instead ORCHID will come up there. This all being done without our notice.While on phone they are telling that they are starting construction in a few days!

                                      Let us get together. Higher a known Lawyer who is really known or relative of some one known. I am ready to contribute money for the fees. Let us get our money back. This project is in mess. And perhaps
                                      will take another 5 years to get delivered. They are just cheating us!

                                      Complaint against Omaxe Ltd for refusal to refund booking money

                                      I had booked a 3 BR flat with Omaxe North Avenue II at bahadurgarh and paid an amount of Rs 2, 80, 000.00 towards booking amount for the said flat whose ref no. is OL/3BR/BHF/P/569. I had got a bank loan approved for the same but after my loan got approved and the bank asked for various documents from the builder, Omaxe ltd. kept dragging the amtter but did not provide the loan and finally after checking with the bank, i came to know that In 2009 I came to know that the Omaxe had scrapped the plan for construction of 3BR towers. after this I started asking the builder for the details of the project through various wrriten and verbal communications but they kept delaying teh matter on one or the other pretext but did not provide me with any concrete details. After waiting for long for company’s response, i decide to take a withdrawal of my booking amount and applied for a refund.

                                      Now, after about a year of application for refund, the company fails to give any response on the same and is also denying to make any refund. Since I am in need of the money urgently to support my old parents and my family, with the help of my legal advisor, I have sent three legal notices to the company for refund of money. Till date, the company is not responding to any of my communications and on the refund money, which clearly shows their wrongful intentions of dishonestly misappropriating the booking money and convert the said money for their own use. I request to the members of the forum to support me in getting the refund amount back from Omaxe ltd., if possible.

                                      I had paid Rs 300, 000(Rs Three lacs Only) towards pre-booking amount of flat for Omaxe’s Ajmer Road, Jaipur project thru second purchase from Mr. Vishal Gupta vide receipt No 7700088 dt 27/06/2006. The title & assignment was duly registered by Omaxe in my & my wife Mrs RUCHIRA SRIVASTAVA’s name. The builder did not even acquire land for the project. On enquiry about status of project Omaxe employee’s always gave false assurance of project getting started soon.

                                      Fed up with their lies, finally on 12/03/2009, I applied for refund of money alongwith interest and deposited all necessary documents alongwith original receipt. So far neither Omaxe has refunded money nor any satisfactory reply is given by their employees. On telephonic enquiry they say that Company does not have money and as & when Company has money- refund will be processed. I complained at their web-site twice but nothing happened. On calling telephonically at their H.O- Delhi- line is put on hold for long.

                                      Despite mails to Mr. Rohtas Goel, Sunil Goel MD & ED- no response from company.

                                      Omaxe refuses to refund money on Omaxe Heights, Bhiwadi project

                                      I invested in project “Omaxe Heights (G+9) at Bhiwadi” in 2006, paid Rs2, 50, 000.00 as advance registration amount in 2006, receipt# 55002882 dated 9th June 2006.

                                      Paid second installment of Rs1, 32, 950.00 receipt# 309866 dated 27th May 2008 against the allotment letter of flat No. 305, Tower Carnation A, in Residential Township Project “Omaxe Heights (G+9) at Bhiwadi” dated 29th April 2008.

                                      I was alloted flat No. 305, Tower Carnation A, in Residential Township Project “Omaxe Heights (G+9) at Bhiwadi” on 29th April 2008 and post that no communication on further status to till date.”

                                      But there is no progress in project till date and there is nothing on ground for that project, the project is inconclusive and appear to be abundant till date. As on date because of extra ordinary delay I am not in position to cope up further with this unreliable company. Hence I requested them to refund my money. In response to my refund request, they don’t respond to my emails and also they made me visit multiple times to there Head Office in Kalkaji, New Delhi and to add on to my suffering they don’t behave properly to a Senior Citizen.

                                      To add to my irony, the refund formalities they have given to me are not as per the realty of there extraordinary delay but are actually required for the cancellation of allotment in case the customer is at fault which is not the case here.

                                      I am Senior citizen and Heart patient and cannot follow up any more as I was doing in past. Hence I request ICF body to help me in getting refund of my investment with interest from this fraudulent company. With due regards it is to submit that I shall be greatful if given a chance to present myself with complete records available with me to the competent authority in NCR region.

                                      Omaxe Heights Cheating

                                      1. Omaxe, vide letter dated 23 Mar 10, has intimated that instalment number 11 of Rs 2, 38, 562.50 is due on 08 Apr 10 for Omaxe Heights, Faridabad.

                                      2. As per Agreement, instalment number 11 was to be paid only on completion of Flooring. However, during my visit to the above mentioned site on 21 Mar 10, I found that Flooring work has not started. Further, internal plaster has also not been completed, which was linked with completion of instalment number 10.

                                      3. Also, marketing representative at Omaxe Heights was very pessimistic about the progress. He did not arrange the site visit and told me to speak with the security guard to take me around; while he was reclining in the Sofa. I had to plead repeatedly for the site visit and only after major altercation, I was successful in visiting the work-site. Also, I observed that the pace of work at the site was very slow and hardly any manpower was being employed. This proves that the Project is heading towards further time-overruns, and Omaxe is totally non-committal.

                                      4. In view of the above, I am doubtful of the progress of the Project.

                                      5. I requested Omaxe to provide me proof of completion of Flooring to enable me to make the payment linked with this stage of completion. However, the same has not been provided.

                                      In these circumstances, I should not be responsible for any delay in payment and associated interest.
