* Builder has given us this statement while selling the flat in written performa
- Ashiana Dwellings Pvt Ltd will provide the facility of subvention till offer of possession or 36 months from date of first installment disbursement (whichever is earlier) (Document attached)
- We go ahead with PNHFL as it was preferred for Loan application was forwarded to PNB for the flat.

* PNBHFL started deducting Pre-EMI
* Start if EMI should have been around June 2019
* We connected with PNB their answer is this
- Email1 - As per our agreement subvention was till 04/12/2018, post that next EMI was to be charged from builder . Request you to please check with your builder for your query .
- Email2 - The EMI has to be charged from customer's account once subvention End date is over . In the case of your Loan A/c End date is of 04/12/2018, post that all EMI to be paid by you .
* Responses from builder
- Email 1- Refer to your reply mail dated kindly find attached the Subvention Schedule as received on your case where in the disbursement as per them is captured 12.05.2015. We have got this schedule from the Bank. In case of any discrepancy where in they have captured the dates wrong, kindly contact your bank.
- Email 2- Refer to your email dated 13.12.2018 please note as per the Subvention Agreement the T&C stated- "Subvention Period : 36 month or till offer of possession which ever is earlier". Based on which the subvention period has got over. The first disbursement came on dated 05.12.2015 and 36months from this date comes to 04.12.2018, thus this closure.
* Everything got discussed back and forth with no conclusion, we kept on following, with both builder and PNBHFL.
- PhoneCall - Builder had convinced us that project has started earlier and will be delivered in next 6 months, so we can discuss this when settlement happens, as promise of subvention period was made by Ashiana not PNBHFL. (Only verbal no email )
+ Feb 2021 - Loan Close/Transfer
* After Covid we decided to move from PNBHFL to SBI as PNBHFL was charging us very high ROI
* We closed the account with PNBHFL, paid the full settlement to PNBHFL.
+ Nov 2022 - Possession
* We got intimation letter from builder and balance amount to be paid, where has communicated date for project start
- First time we came to know the date of project start (official date as per RERA), as builder wanted to minimise the penalty to be paid
- We discussed with builder and builder’s response
- - Everything was settled between you and bank, we have NO role in this. Subvention is as per MOU. You can discuss with bank, why they started with subvention period earlier, as per MOU, please ask MOU from bank.
- We connected with bank their response (PNBHFL)
- - EMAIL As discussed regarding your queries of subvention period.we would like to inform you, as per our record subvention period is dec 2015 to dec 2018. Please discussed with builder for your queries.
- - PhoneCall - We cannot share MOU with you. Account is closed.
- - PNBHFL shared one document which is their INTERNAL DOCUMENT with no signature from Customer or Builder with start date and end of Subvention (Document attached)
- As we can see there is word play, both BANK and PNBHFL are playing with words, still reluctant to answer why subvention started earlier than it should have been. Why customer was charged with extra 6months EMI amounting to around more than 3 lacs

Here we are NOT expecting bank to pay us back, but we would like to bank to share some document with us which we can show to builder to make our case, and PNBHFL seems to completely ignore our request under pretext of closed account.
