Tamil Nadu Electricity Board [TNEB] — request for removal of meters and boards includes power cable

I Mr. K.Mohan S/O kaliaperumal, residing at No 36A, First Floor, Dr.Ambedkar Street, Arumbakkam, Chennai – 600 106 to issue the following Legal Notice for removal of Meters and Boards includes power cable has installed in our premises for the Plot No 36B and Door No 37 of Dr Ambedkar Street, Arumbakkam Chennai 106.
1. I had purchased the vacant land o[censored]ndivided share of 562 Sq ft out 1124 Sq ft (995 Sq ft Plot with 129 SQ ft right of common passage) altogether measuring about 1124 sq ft situated at Arumbakkamvillage, Egmore – Nungambakkam Taluk, Chennai District, comprised in Survey No 244/1, T.S.NO59, Block No 1 Plot No 36A, Door No 36, Dr. Ambedkar street, Arumbakkam, Chennai – 600 106 by a registered sale deed dated 31.05.2010 from One Thiru P.Anbazhagan S/O Late Ponnan who was residing at D.No. 36 of Dr Ambedkar street, Chennai- 600 106.
2. The above said P. Anbazhagan had aquired the property through the Family Partition Deed among his three brothers Anbazhgan, swaminathan and the Legalheirs of Late P. Chellappan. The property was sub-divided in to three parts by a registered partition deed dated 30.06.2009.
3. Further Mr P. Anbalagan, Swaminathan and the Legalheirs of Chellappan jointly applied to the Chennai corporation for the sub-division of the property, comprised in Survey No 244/1, T.S.NO59, Block No 1 Dr. Ambedkar street, Arumbakkam, Chennai – 600 106 total to the extent of 3347 Sq ft and had obtained the Planning permission from the Chennai corporation in ref PPA NO SD NO D5/0162/2009 DATED 08.06.2009 and the property was sub divided into 3 individual plots numbered as Plot No 36A, 36B and 36C. The Plot No 36A belongs to my vendor Thiru Anbazhagan, 36B belongs to Thiru Swaminathan and 36C to the Legal heirs of Late P.Chellappan.
4. Thiru Anbazhagan had entered into an agreement with One Thiru M. Manimaren Proprietor of M/S WIN ENGINEERING AND PROMOTOR on 01.07.2009 to develop his property as residential Flats and also to get the Planning Permission from Chennai Corporation and to get the connection of TNEB and CMWSSB from the concerned authorities to develop his property.
5. Thiru M.Manimaren had obtained the Planning permission from Chennai corporation to construct two residential Flats (FIRST AND SECOND FLOOR) with Stilt Floor (GROUND FLOOR)) for car parking in Ref No PPA NO 4195/2009 and B.L.NO 0052/2009 dated 05.01.2010 and also had obtained the power supply of TNEB, Service No: [protected] for the Premises Door No 36A, Dr. Ambedkar street, Arumbakkam, Chennai – 600 106.
6. Thiru Manimaran had approached my client as a (50%) owner of property and expressed his desire to do the civil work for the construction of the First Floor. I also accepted the offer and entered in to an agreement with him for the construction of the First Floor and similarly he approached Thiru velayudham and Mrs Jothi (50% owner) and got the work to construct the second Floor. Both parties have requested the contractor Thiru Manimaren to construct the building as per the Plan approved by Chennai Corporation with car park in the ground Floor to be shared equally.
7. I had purchased the 50% of the undivided share directly from One Thiru P.Anbazhagan (Principal) and Thiru Velayudham and Jothi had purchased remaining 50% of the property from M. Manimaren power of attorney of Mr Anbazhagan. Since entire extent of 1124 Sq ft of the property owned by Anbazhagan was purchased me and Mr Velayudham & Mrs Jothi, nobody shall claim ownership of any part or parts of the plot No 36A. Even the Vendor may not have any right over the property after the sale.
8. Further the construction was completed in all respects and handed over to me in 2011 and velayudham and Mrs Jothi in the year 2012.
9. It has been ascertained that the said Manimaran had entered into an agreement with Thiru Swaminathan and Mrs Rajeshwari the Plot owner of Plot NO 36B, Door No 37 to construct the residential flat in his Plot No 36B Door No 37 of the sub-divided property Dr Ambedkar Street. Arumbakkam, Chennai 600 106.moreover, Manimaran had constructed of Ground floor and First floor as per approval and also constructed of the second Floor unauthorized.
10. Since the property Plot No 36A ( numbered as Door No 36) was separated from Plot No 36B (number as Door No 37) I had obtained the power supply from you separately on payment of charges and deposits for Plot No 36A Door No 36 and obtained the power connection for my property.
11. Unfortunately, the TNEB Department (Section-176-Nerkundram East, koyambedu, Chennai.) has drawn the power Lines wrongly and mistakenly through our property at Plot No 36A, Door No 36 of Dr Amdebkar street, Arumbakkam, Chennai-600106 and has laid the power cable and installed the Meters and Boards for the owners of Plot No 36B, Door No 37 within the premises owned by us which is illegal. This was noticed by us recently and sent a complaint two times to the third of you but you have not acted upon on that till this date.
12. Therefore you are called upon to remove the Meters and Boards and power supply of the premises Plot No 36B and Door No 37 of Dr Ambedkar Street, Arumbakkam Chennai 106 which was installed wrongly and illegally instructed by Thiru Manimaran in our Premises at Plot 36A, Door No 36 of Dr Ambedkar street, Arumbakkam, and Chennai-600106. This complaint was submitted as a Legal notice to below following address on October; 2017.Moreover, Inspection has also done by Assistant Engineer of TNEB Department (Section-176-Nerkundram East, koyambedu, Chennai.) thereafter, No action taken to remove the Meters and Boards includes power cable from TNEB Department so far, after discussed with Thiru Swaminathan, Thiru Manimaran and Mrs Rajeshwari.
13. Therefore kindly request you take appropriate action against the complaint within 7 days from the date receipt of this notice failing which I regret to say that I will be inclined to approach the Hon’ble court to get the appropriate relief through the court of Law.
