[Resolved]  Tata Docomo — TataDoCoMo charging twice for two different data packs plan and activating only one

However, Once the pack is activated and the benefits are provided, the same cannot be refunded or converted to the other offer. Suresh, Customer Care -TATA DOCOMO ____________________________ Dears, Yet again, I am typing this email with sheer disappointment with Tata DOCOMO mobile services to highlight an issue that I recently encountered with your Mobile Data Pack and Recharge facilities. I called up your TATA DOCOMO call center to get my issue resolved and the response that I received from your call center rep (Shariff) is "Our systems are not working at the moment, please call back after 3 hours", is not the kind of response that I expect from one of the India's largest Mobile telecommunications service provider. I called up again after 3 hours twice-thrice and got disconnected on each occasion, as if no one at TATADOCOMO is interested to hear me out / or rather hear out my concerns, and so, I adopt this mode to write to you... Here is my concern: On 7th November 2013 (around 10 pm), I recharged my prepaid mobile connection with Rs.251 recharge online via Tata DoCoMo website and as per the plan I opted for I am supposed to get Rs 200 worth Talk Time and 1 GB 3G data free for 1 month, which happened successfully, post which my prepaid account balance was Rs.200.65 and I was able to use my phone without any issues. Later, on 8th November 2013 (around 10 am), I made a call and after the call ended, it showed up my prepaid balance as Rs.104 and I was SHOCKED! to notice that my balance was reduced from Rs.200 to Rs.104. I immediately checked the BAL by sending msg to 121 and noted my last 3 deductions. I was charged Rs. 95 for GPRS subscription (1 GB for 21 days), I was even more surprised, coz my previous months GPRS was slated to end on 8th Nov 2013 (midnight). Now, here are my questions: 1. Why do you think a customer would be interested in paying Rs, 251 (for TT + 1 GB Data pack for 30 days) and Rs.95 (just for 1 GB for 21 days) at the same time???? It is quite obvious that you think your customer is a fool to do so... :), if not, please address this issue ASAP and get the Rs.95 credited back to my prepaid account balance. 2. Why wasn't I asked for a confirmation before the balance deduction? (Is it because you think profits are meant to be minted at every given opportunity even if the customer gets cheated???) I am sorry if I am being a little perceptive in my email, however, please understand this, for a valued customer (the one who is loyal to Tata DoCoMo for several years already now), the kind of service he receives matters a lot, and I am being very vocal and candid about the kind of service I have received and wish that you can take an appropriate action towards addressing my issue. I would like to get the amount of Rs.95 (that you charged for GPRS data pack) credited back to my prepaid mobile account. If you fail to do so, I would like to get this escalated and I would not use this connection anymore. As per the Consumer Protection Act, 1986 following are my rights as a rightful customer:

In general, the consumer rights in India are listed below:
The right to be fully informed about the performance and quality of all goods and services
The right to free choice of goods and services
The right to be heard in all decision-making processes related to consumer interests
The right to seek redressal, whenever consumer rights have been infringed
The right to complete consumer education

The amount of Rs. 95 were deducted without my notice (I never signed up for that), also, please check your records, the last 2G data pack Rs. 95 was supposed to expire on 8th Nov 2013 (midnight), however, it was done on 8th morning itself, without notifying me. This was never told to me before signing me up for this service.
Neither I have a free choice of services, nor, do I have been heard in all decision making processes. Furthermore, I wasn’t even educated that my main balance would get deducted as my 2G datapack is set for autorenewal…

Therefore, I urge you to address this issue with due diligence and ensure that my issue is heard and appropriate action is taken. I have a right to be heard.
