Respected Sir,
This is to bring to your notice that on 6th April, 2021 we had placed an order for a Tata Nexon EV, XZ PLUS LUX, in signature Teal Blue with TC Motors Pvt. Ltd., Chinar Park branch, Kolkata, West Bengal. It is pertinent to mention here that we had placed the said order after relying on the great reputation and goodwill of your company in the market and we were certain that you will provide us with one of the best products available in the market in the electronic vehicle segment. An amount of Rs. 51, 000/- was paid by us as the initial booking amount on the very same day.
The said car is thus being purchased by us through car loan facility provided by HDFC Bank. A down payment of Rs. 1, 78, 240/- has already been paid by us and remaining Rs. 15, 00, 000/- is to be paid through monthly EMI from our end. Moreover, the car insurance has been approved and the premium for the same has already been paid. We further state that the EMI of the said loan has started to deduct from our account and we have also started to incur interest upon the same. A copy of the tax invoice along with the insurance policy cover is hereby attached to the said mail.
The details of the said car is given as follows:-

The delivery of the said car however, was constantly delayed due to the second wave of COVID-19 and consequential Lockdown in the state of West Bengal. Finally, we were informed that the said car would be delivered to us on 18th June, 2021 and that we were to come and collect it from the showroom, TC Motors Pvt. Ltd., Chinar Park branch, Kolkata, West Bengal
However, on 18th June, 2021 when we went to the showroom to collect our brand-new Tata Nexon EV, XZ PLUS LUX, in signature Teal Blue car, with great enthusiasm and excitement, to our utmost shock and surprise we found that there were several defects in the car, including painting defects etc, details whereof are given below:-
1. Paint mismatch on the bonnet which appeared as a distinct huge patch
2. Rough painted surface on the roof
3. Rough painted surface on the side wall of rear left
4. Numerous scratches on side looking mirrors
5. White patch on the plastic trim of the rear left wheel
6. Difficulty in closing the boot
7. Fuel lid is not functioning properly
Please find attached copies of photographs evincing such defects to this mail.
It is also vital to mention that apart from being defective in nature, the said car has already been driven for 124 kms before delivery and the seats are also dirty. It appears as if the said car is not a brand-new vehicle, but rather a second-hand used car.
When the said defects were brought to the notice by us to the person concerned at TC Motors Pvt. Ltd., Chinar Park branch, Kolkata, they duly acknowledged about the said defects and told us that the said car would be repainted and delivered accordingly. However, the same is unacceptable to us and we had thus refused to take delivery of the said car.
Therefore, in the said circumstance, we write to you, hereby requesting you to provide us with a new car. We have duly complied with all payment requirements needed to purchase a brand-new car and are in no way willing to accept a defective/repainted so-called second-hand used car. Furthermore, it goes without saying that as a customer we are extremely disappointed with our experience with your well reputed company.
We are hoping that you will pay heed to our complaint/request as soon as possible or else we shall be compelled, as helpless consumer, to resort to legal means.
