A prepayment of Rs 551659/- was deposited vide ch no. 008980 on 14/06/2012 towards instalment against milestone 6th roof slab which was not due yet for property details : M905, Memory Tower, Seven lamps, Vatika India Next, Gyrgaon sector 82F. The instalment became due on 25/10/2012 (after 133 days) and the above payment was adjusted against the same.As per the letter issued by you to the allottee simple interest @ 12% pa on this amount for 133 days was to be credited to the ledger account on flat no . M905.Now when I received the account statement dated 23/12/2015, I found this interest amount against prepayment has not been credited. Now when I contacted the company, they flatly refused to pay the interest amount

    I have been given possession of flat F-2, plot 02, 2nd floor in independent floor one month ago. More than 65%tiles are hollow fitted and making sound. Showed to vatika team, they accepted the construction fault, said they would rectify, but now since two weeks they are silent and not responding to my phone calls and emails. Please help

      We have invested in GROUND FLOOR, 9, G-52, VATIKA INDIA NEXT, GURGAON and wish to exit from the property. We were assured by the Vatika Group that there is no lock in period for the same. As per the BBA we are entited to a refund on the project until the issuance of the conveyance deed. So far the Sales & Client Services is refusing to honour our request and claiming that the Vatika Group can not provide us a refund. This is a clear breach of the BBA contract and is seen by us as ann attempt to defruad us. Please suggest a recourse or else we will be forced to take legal action.

        I was alloted a 2bhk emilia floor in VIN sector 82f in 2009, paying 35% of cost of property, despite of 6 yrs till now has not given possession of it and now telling construction could not happen due to GAIL Pipe line, farmers agitation and HUDA apathy. This is regarding a flat booked to me by vatika group as Offer Of Allotment O[censored]nit In ``Independent Floors’’ At ``Vatika India Next’’For Priority No Emilia/GF/131 allotted on 8/1/2010 (Ref no.5) with colorful layout of a colony in pamphlets, selling like a dream to own a house in NCR which has turned out to be a nightmare to me and 100 sufferers who invested in it, for which I paid 35 % of cost of flat on a short notice, I paid initial installments more than (35%) 952323/- of the flat whose total sale consideration was Rs 26, 95911/- as on booking (Ref no.36 dt 9/11/2012) which they increased later to 29, 91785.09/- (Ref no.37 for so called increased carpet area from earlier committed 781 sq ft (Ref no. 34, 35 ) to 920 sq ft taxes extra, it includes booking amount 248000/- through a broker (Ref no. 1 and 23/10/2009), 293448/- (Ref no.9, 10 dt.20 and 21/01/2011) amount collected on allotment and 410875/- (Ref no. 18, 21, 23 ) on their so called commencement of earthen work at site(Ref no.12 dt. 16/2/2011) with taxes extra till year 2011 (attachments 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 18, 20, 21, 23) to them in their planned housing colony Vatika India Next, Gurgaon which was promised to be completed by end of 2013 habitating big 700 acres of planned township (Ref no 60.) Foremost, the builder changed the earlier allotted sector to me from Emilia, GF, Plot 34 Sector 83e-15 (Ref no.8) to 15/GF/ST 82F-14 in Sector 82F (Ref no34, 35 as addendum to tripartite agreement and Ref no. 39 in amendatory tripartite agreement, mentioned by HDFC Ltd reason quoted being ``for unavoidable reasons’’) on the pretext due to alteration in sector layout told on telephone. Then demanded excess payment on the pretext of increased carpet area from 780 to 920 sq ft of the flat (letter dt 11 jul 2013 Ref no.32 ) which I agreed to, since after having paid booking amount and allotment money Rs. 541448/- (Ref no. No 1, 2, 3, 9, 10) had no option but to pay. After 4 years of so much correspondence builder mentioned that due to farmers agitation, acquisition of sector roads by HUDA and GAIL pipeline of govt (Ref no. 58, 60, 63, 67, 77, 81, 83) no construction could take place in sector 82F and not giving any firm assurance of completion of project which should have happened by end of 2014(Ref no.47 ), Till now actually no construction has taken place even no foundation has been dug in, in the plot allotted to me, for which they took installments in the name of earthen work (Ref no. 17, 18, 23). When this project was launched in 2009 the builder allocated priority numbers to buyers which was 131 (Ref no.8) in my case and I was told that I am part of phase 2 (Ref no.13) of the project which will be finished by end of 2013. After 6 years of booking, I neither see any definite word from this builder nor is there any transparency about these so called priority based possession as to how are they giving and whom are they considering to be given the flats? (Ref no.72, 74). Due to agitation by a few of buyers amongst us the builder has realloted few units to a handful of them to places which are remote from site and yet to develop, without any funding from nationalized banks. But I have not been given any such option, even be given an option it will be turmoil since those places will again have farmer and other Govt. related issues probably will see day of light after 5 years. Recently, I came to know from other buyers that the land in sector 82F or 83E does not belong to Vatika. When asked, no reply came from the builder, whereas on their permission to mortgage (Ref no. 43 ) they have clearly committed that Title of entire property is with them. HDFC Ltd. provided 20 lacs loan to me (Ref no. 24 ) for this flat (God knows how they approved loan?) Buider has submitted permission to mortgage to HDFC (Ref no.43 ), where they have written that ``entire property is free and marketable and they have the title of it ‘’ it clearly implies ????intentions that if the land belonged to them then why did they fail to hand over the units to sufferers like us who had been waiting since 6 years? Reasons could have been either better prices which they got from investors who joined later to us after the appreciation of land there, or they were all the time completing phase 1 from money collected through phase 2 buyers, I always got the same verbatim that, `` the construction is happening in phases and we will inform when next milestone would be launched, ’’(Ref no.45, 47, 48, 49, 58) which never happened till date. The Builder has a devoted team of youngsters as Customer Relation Management (CRM) it is referred to as email id [protected]@vatikagroup.com in all the mails attached as reference 15 onward but instead of helping out the customers like me they act like barriers not allowing sufferers like me to meet their actual bosses (management) who have never till date interacted with me despite of so many queries. . Now whereas our Esteemed Government is working towards housing for all, here is a situation where a citizen has paid hard earned money in a hope to get a flat in city for children education and better life, paying high EMI to HDFC Ltd. and also paying for high interest rate without tax rebate for home loan and suffering the tortuous uncertainties. Every passing day is a kind of forcing me to believe that I have been cheated right under the nose of Haryana and Central government. I have copies of email chain and property documents to show that how the builder has been using delay tactics?

          Hi Team, I have purchased and taken possesion of 2 BHK Flat in Vatika G21 ( F2-602, Vatika G21, Sector 83 Gurgaon) in September 2014 . There is continuous seepage of water through walls, doors and windows in rainy days and damaged our furniture and electronic items. Moreover they are charging a hefty 4000/- per month for maintenance for this pathetic services. I am tired following up with Vatika's project team and maintenance team but they don't bother to even respond back and provide a resolution. Please help me in this. Regards, Puneet. [protected]

            I am pankaj from E1.1 11, second floor Sorry to say we are not secure in d society. Last week some tress Passer did offensive behavior to my wife n today same incident happened n my son is blooded. Security staff don't know anything about both d incident happened near e1.1 Park. Wow moment for vatika n hell for us who are paying money.               SUMMARY: I had booked my flat (Emilia Floor FF/230) apartment no 12FF- ST82F - F12) in Vatika in 2009.I had paid 35% of my hard earned money. But since then no construction has started on the allotted plot. ISSUES : 1. NO CONSTRUCTION WORK PROGRESS AT SITE. NO OFFICIAL COMMUNICATION FROM VATIKA TO MEMBERS REGARDING THE CONSTRUCTION WORK COMMENCEMENT DATE AND COMPLETION DATE 2. DENIAL OF THE REALLOTTMENT OF ANOTHER CONSTRUCTED FLAT ON WHICH THEY AGREED BEFORE, FOR WHICH THEY GAVE THE WRITTEN APPROVAL/COMMUNICATION ON MAIL. 3. DELAY IN PROJECT SINCE BEGINNING 4. NO RESPONSE FROM VATIKA TO E-MAILS INDICATING NO VALUE TO CUSTOMERS DETAILS As on date (06 May 2015) there is no progress in the construction work on the site. To add to this, in the span of past 70 months, none of the activities have been performed as per the proposed time-lines (construction linked payment) in the application form. In other words there is a delay in project since starting. There is no clarity as when the construction will be started and when will the project get completed.There is no written commitment/communication regarding time line of possession. Besides above, Vatika-CRM has stopped responding to e-mails which shows the kind of care they extend to the customers.

                Hi, I purchased an Emillia Floor in Sec 82 F block in resale in 2014. First buyer bought it in 2009 but there is no progress in its construction. I am following up with them from last 2 years and every time I call them they say that construction would start in another 2-3 months. This time when I called them, they said that there is an illegal encroachment on the land, hence the construction can not start untill the land is out of the legal issues. This pushes the construction in infinite wait time. I feel cheated as a customer. Has anyone else faced such an issue? Can anyone help me understand how can Vatika sell property on a land which is not even aquired by them? Also, how can I claim penalty from Vatika as my pocession is delayed for infinite time? Thanks

                  Vatika has no policy to visit their customer to visit their property which they bought.The demand upto final payment with out sharing govt. approvals with owner.They never fulfill their obligations like delay penalty . You never know till final payment of your property is built or not.

                    This is with reference to my flat no.602, vatika seven lamps, Vatika India Next, Sec 82A, Gurgaon. I bought this flat with construction linked plan which states milestones & accordingly builder can raise demand letter for each milestone. Vatika has raise demand letter for "completion of flooring" without completing it for apartment. On raising a concern from my end, vatika replied bedroom (2 Nos.) & kitchen will be installed at the end, but you have to pay full amount of this demand other wise interest will be charged.                       I had booked a flat in April 2007 with Vatika in URBAN WOOD Infortech city Jaipur.. I used downpayment plan since they had advised this flat will be ready by Aug 2008. In fact they had provided literature showing different milestones and shown Aug 2008 as the last day. In the apartment buyers agreement they had mentioned they pay Rs 5 per sq ft per month as penalty charges in case this apartment is not delivered for possession for 3 years. Now I had finally received the possession letter which is 7 years months from booking. Now Vatika is not willing to pay the penalty.In final letter for possession they are demanding various extras like Administrative charges, conversion, various deposits etc not covered by Buyer Agreement, charges I will appreciate any help you...

                        Breach of Agreement

                        Delay in possession of plot and change of project plan

                        In 2006, I have booked a plot in Vatika Infotech City Jaipur and till last year made a 75% payment for a 360 square yard plot. I made a payment of Rs.18,50,000 till date.

                        Now Vatika group has changed the plan and offered a different plot, which they have said, will be delivered to me in 2011. I refused to take the new plot and asked for refund of my paid amount along with interest. They have refused this...

                        Illegal reallocation of plots in

                        Vatika has started another scam.. They are forcing the legitimate plots owners in their jaipur project to either shift to a new location or give up their plot at 2004/ 2005 prices... All this is happening discretely and without any paper work... They are telephonically informing the customer to accpet or their land ownership will be cancelled... What is most surprising is that this project which started way back in 2004 has stil not handed...
