I, Ex Subedar Major Birender Singh S/o Late Shri Bhola Ram, am permanent resident of Village : Dhani Chitter Sain, PO : Bhora Kalan, Tehsil : Pataudi, Distt : Gurugram (Haryana). Sir I am a retired Army person. I retired from army service on 30 Jun 2012 after serving the nation for 30 years with dedication, loyalty and honesty. 2. After my retirement, I had purchased plot No 003/2/K-16/83K/180/Sector 83 in July 2015 in re-sale at sector 83, Gurugram belonging to Vatika Group in the name of my wife Mrs Urmila Devi to enable me to settle down after retirement. After protracted correspondence, the possession of the said plot was given by the company on 15 Oct 2015. At the time of purchase of plot, I was assured by the company that registration will be done within next six months. However, about three years have passed and despite my best efforts, registration of the plot has not been done by the company as yet on one or the other pretext. In the absence of registration, construction work can not be started until unless that house plan is passed by HUDA. 3. The plot was purchased from its original allottees, ie Mr Anupam Prakash and Mrs Shubre Prakash in re-sale in July 2015. The plot was booked by the original allottees in 2010. More than 8 years have passed from the date of booking and the company has failed to execute of Conveyance Deed till date. Prior to the possession, the location of the plot was changed by the company twice at their own in their interest as earlier location of plot was very best than the present location. Thus the company has violated the mutual trust and terms and conditions of the Builder-Buyer Agreement. 4. In spite of sending number of e-mails (total 23 e-mails) and my personal visits (about 20 visits) to the company office, Conveyance Deed for registration of above plot has not been executed by Vatika Limited on one or the other pretext. Every time, when we visited the company office, they say that registration is being done in phased manner and it will take 5-6 months time but their 5-6 months time has not ended from 2015 to 2018. It is brought to your kind notice that construction work is going on in 2 many plots in surrounding area of our plot. Every time, they make us to meet with different person saying that he is dealing with the registration process and the earlier person whom we had met last time is not part of registration team now. Even though, the company representatives are not picking up our phone calls. The reason behind this is that a large number of plots are being sold in resale and the transfer charges on account of re-sale (about 3 lakhs per plot) are going in the company’s account. That’s why the company is earning a huge amount through transfers every month. This is the main reason, the company is delaying the registration process intentionally. If registration is done, the registration charges will go in Government account. Thus, the company is fraudulently cheating the government also and this is great loss to the government. This fact can be verified from the company’s account. 5. Sir, I have spent my whole life hard earnings including loan from relatives in purchasing of the said plot. I also had a dream to have my own house to settle down after retirement, but Vatika Group has cheated me and ruined my dream drastically. Without registration, I can not start my construction work. Currently, I am staying on rent since last three years and I am finding it difficult to pay the rentals from my meager pension. I am at great loss. The company has grossly violated the terms and conditions of the Builder Buyer Agreement by delaying the registration process intentionally for their own benefit. This is a case of cheating, fraud, breach of mutual trust and violation of terms and conditions of agreement on the part of company. 6. Sir, In view of the above, it is earnestly requested that strict action may please be taken against Vatika Group for cheating, fraud, breach of mutual trust and violation of terms and conditions of the agreement. It is requested that fair justice may please be given to the veteran ex-serviceman as I have devoted most of my life in serving the nation in extremely inclement weather conditions, insurgency and far flung areas. The following is requested please ;- (a) Vatika Group be directed for immediate registration of plot No K-16/2 without any further delay. (b) Interest @18% per annum may please be paid on the amount paid by me in purchasing of the plot from the date of possession to the date of registration as compensation as I am paying interest on the loan amount taken for purchase of plot. (c) Rentals from 01 July 2015 till date of registration may please be paid to me @ Rs 18000/- per month. 3 (d) Rs 2 lakhs may also please be paid on account of mental agony caused to me by the company in last three years. 7. Hi. I was informed that the cumulative rent for my unit F9 - 946 Vatika INXT city center will be paid by March . I have not received any communication yet.
