On 02/04/2018, at 01:13 pm - i, vivek malu was stopped in the middle of road (Outside uttarpara ps), by a person “a” in t-shirt and jeans. On asking reason for stopping, i was asked to show vehicle documents (Ktm rc 390). At the moment, there were no police personnel in uniform at the spot, and i asked the person “a”, that i’ll agree to produce and show documents to only someone in uniform. Upon stating this, person “a” shouts to a person “b” (Who was in uniform), to come by since i insisted for a police in uniform. The person “b” was inside a tea shop (Opposite uttarpara ps), and wasn’t even aware why was i stopped for. He then speaks to person “a” and then asked me to go inside the police station and produce my documents. I asked him –
• “reasoning why i was stopped, as it is my fundamental right to understand why am i being stopped”
• “why do i have to enter a police station to produce my vehicle documents, when i was caught for no offense” (Helmet present – no overspeed – no rash – all documents present), by someone who is not legally authorized to stop and execute law & order on behalf of officers.
Person “b” and person “a” stays busy in their conversation and just asked me to go inside.
Upon stepping inside the station, i asked a lady at the counter about “where do i need to produce my vehicle documents?”. I was then re-directed to an officer-in-charge, who was sitting on the reception desk. He asked and checked the following documents:
Vehicle rc smart card – valid and produced at time
Driving license – valid and produced at time
Pollution check paper – valid and produced at time.

During this process, of checking my documents, person “b” (Who was in uniform) comes inside and interrupts the officer-in-charge saying “now on, it seems we should sit outside if we want to check vehicle papers, as this person (Me) wants it to be in proper legal way”
Upon hearing this, the officer-in-charge asked me what was the issue. I stated him, “i was stopped by a person in tee and jeans, when no officer was in sight/neither a formal barricade or check post existed.” i also, stated “in this way, anyone could pose in any dress and stop anyone, and this is risky, and should be carried out in proper uniform, as vested in the legal rules”.
The officer-in-charge, instead of accepting the fault, simply asked me “go ahead, and try to stop anyone. You cannot. Only our persons can”

With this, i exited the ps, and as i stepped out, the officer-in-charge, came out and started discussing with person”a” (The person with no uniform)

Charges against uttarpara police station
Harrassment :
• i was duly harassed at a time of travel, even when i followed all traffic rules, and carried every detailed valid document for the vehicle.
• i was stopped by a person with no identification (Not in uniform).
• i was even asked to stop vehicle, park it, get down, and go inside a police station for showing and verifying documents, even when i had not broken any rules.
Abuse of power :
• civilian posing without uniforms, to help and assist the police officers, in collecting bribes and money.
• people in no uniform, are leading the law & order, and people in uniforms were busy eating and sitting inside the office.
• under, no circumstances, can i be forced to enter a police station, without any conflict or damage to rules by me.in this case, the entire process worked by someone in no uniform.
• biased attitude towards people of connection.

I trust, strict and duly reasoned action is taken against persons mentioned above. Law & order is under the constitution for the benefitting of people and order in society.in the above highlighted instance, it seems law & order is back to days of connection and bias attitude and working with no legal adherence.

All the above mentioned details, are closest to the event. Event has taken place outside uttarpara ps. And the same can be verified with cctv from ps for 02/04/2018 ; 13:15 hours. I also have photographs and initial video recorded on my helmet camera.

*person “a” - a person without uniform or any other association to being a police
*person “b” – with uniform, not present at initial event. Was called by person “a”, when i demanded for someone in uniform
*officer-in-charge – sitting on reception desk – checked all my vehicle documents. And unapologetic about the incident. Dares me to go and do the same.
