Xiaomi India — Xiaomi redmi MI note 3 not activated and i want refund my money

Hello Sir,
I bought Radmi note 3 from Jaiswal Agencies (E-4, Butler Plaza, Bareilly - 243001).
The handset was not working properly so I took DOA from services center within 3 days of purchasing.
But shopkeeper is neither refunding my money nor he is giving me new handset while it is under refund policy.
So please help me.
I want refund because I am tired of all those thing, now I can't bear any more.

NOTE :- Handset is not activated.
