Facts of the Case:
I enrolled in Y-Axis Job Search Service on 29/05/2025 (₹2, 526/-) and further paid ₹17, 701/- on 05/06/2025, totaling ₹20, 227/-.
At the time of enrollment, I clearly communicated that I required 45 days to complete the pending payment, which was mutually understood.
Despite this, Y-Axis suspended the service prematurely, without honoring the agreed timeline. This amounts to a breach of agreed terms.
Further, there was contradictory communication regarding LinkedIn optimization. Initially, I was asked to provide login credentials, but later instructed to optimize it myself. This inconsistency shows lack of professionalism and loss of trust.
I raised these issues via four (4) separate emails, explaining the breach and requesting resolution. Despite repeated reminders, Y-Axis did not address my core grievance.
On [insert date of last mail], I sent a final legal notice email, clearly stating that I would be compelled to approach the National Consumer Helpline, District Consumer Forum, and other grievance platforms if the matter was not resolved.
Even after this final notice, Y-Axis failed to respond at all, which shows complete disregard for consumer rights and accountability.
Refund Policy & Applicability:
Y-Axis claims fees are non-refundable under specific conditions (e.g., client failure, fraudulent documents, visa refusal, etc.).
None of these conditions apply to my case. The failure here is entirely due to Y-Axis’s premature suspension of service and mismanagement, not my default.
Therefore, the “non-refundable” clause is arbitrary and not enforceable, as per consumer protection law.
Legal Grounds:
Deficiency in Service under Section 2(11) of the Consumer Protection Act, 2019.
Unfair Trade Practice under Section 2(47) for enforcing one-sided, arbitrary “non-refundable” clauses despite service lapses.
Breach of Contract – failure to honor mutually agreed terms.
Failure to Respond to Legal Notice – deliberate negligence despite repeated communications.
Relief Sought:
I request the Hon’ble Forum/Authority to:
Direct Y-Axis to refund ₹20, 227/- (₹2, 526 + ₹17, 701) paid by me.
Award compensation for mental harassment, financial loss, and inconvenience caused due to non-response and service failure.
Direct Y-Axis to discontinue unfair practices of misrepresenting refund terms and ignoring consumer grievances.
