[Resolved]  BPTP Park Elite Floors Faridabad — FRAUD BY BPTP

I HAVE BOOKED ONE FLOOR IN BPTP PARK ELITE FLOORS, NEHAR PAR AREA, FARIDABAD, HARYANA AT A COST OF RS.16.08 LAKHS WHICH IS TO BE PAID IN INSTALLMENTS. THIS IS A CONSTRUCTION LINKED PAYMENT PLAN. I WAS TOLD BY THE DEALER THAT I JUST HAVE TO PAY THE BOOKING AMOUNT (RS.2 LAKHS, NON REFUNDABLE) AND THAT REST OF THE AMOUNT IS TO BE PAID IN INSTALLMENTS WHICH WILL BE EASILY FINANCED BY BANKS. NOW THE PROBLEM IS THAT NONE OF THE BANKS OR FINANCIAL INSTITUTIONS ARE GOING TO ADVANCE ANY HOME LOAN ON THE PROJECT BCOZ THE PROJECT HAS NOT BEEN APPROVED BY THE HARYANA GOVT. THE COMPANY HAS OVERSUBSCRIBED ITS BOOKING BY ABOUT 10-20 TIMES, A ROUGH ESTIMATE IS THAT FOR ONLY 800 ODD FLATS, THE COMPANY HAS BOOKED ABOUT 4000+ APPLICATIONS AND IS ASKING FOR PAYMENTS AS SCHEDULED. EVEN I HAVE PAID THE 1ST INSTALLMENT OF RS.2.02 LAKHS FROM MY OWN POCKET. NOW THE BANKS ARE NOT FINANCING THIS PROJECT AS IT IS NOT APPROVED. THE COMPANY DOES NOT HAVE THE LICENCE FOR ITS CONSTRUCTION. IF I DON'T PAY THE NEXT INSTALLMENT WHICH WILL BE DUE IN ANOTHER 60 DAYS. THE COMPANY WILL CANCEL MY BOOKING AND WILL GIVE ME BACK THE AMOUNT OF ISNTALMENT PAID MINUS THE BOOKING AMOUNT. IS IT POSSIBLE TO TAKE THE COMPANY TO THE CONSUMER COURT AND GET MY MONEY BACK. Hi All,

I have booked flat (Park Elite Floor) in May 2009 in the initial booking. I have paid 85% money plus their additions I.e. area increased and money for treatment plant as well. Till date, I have noticed that there is no construction going on. My floor is in E Block, my floor is completed till the plaster. Also when I visited to the construction site, very poor quality of material has been used for construction. Brick used was very poor quality kind of class third material used and when I put my hand on wall whole of plaster come out, when I put my feet on corners of walls they were just broken. I was very surprised to see the poor quality of construction.

Also I am not sure, by when building is going to complete the project. What will happen for poor quality of material used. Also I would like to ask whether the builder is going to pay late construction penalty charges to us as per agreement. If you have any update on these issues, please share your thoughts, what should we do in such case.

I have an elite floor property situated at sector 85. And my situation is similar to the other buyers. I have paid 85% of the unit. And builder notified that they will offer the possession in 2017. BPTP FRAUD
I have booked a BPTP Park Floors 3BHK Flat at Sec88 in 2009, after few months they have conducted 2nd draw and they shifted my flat to Sector-77 because they said we can't give you flat in 88 bcz of all units full. They commitment of giving the possession of the home within 2 Years but still in dark and home price is also increased by giving the other legal excuses. I have paid almost the amount of 90% payment and i am still in dark don't know that what to do, even they always said in coming next 6 month or 12 Month. When I have asked about the penalty clause they didn't reply anything. BPTP is fooling us and not giving us any valid reason for delay, They are big cheater. I didn't get my home possession and they asked for more one year. I don't know their intension.
Please let me know some lawyer contact number, with whom I can liaise and file case. Let's do something!
(Kindly advise me how I get flat from BPTP)

I also have a Floor booked with BPTP in Sec 77 PE block since 2009 and have submitted more than 80% payment and still we are not getting any news about the Project. From past 2 years there has been no construction is going on the site. Customer Support of BPTP is not able to give any date for project completion or anything related to Penalty clause. I am ready to go Legal against such fraud Builders. You People can contact me on [protected]

Dear Sir / Madam,

In connection to our telephonic conversation had today up to the level of Assistant Manager Customer Care BPTP.

I appreciate the patience shown by the team in line to the instructions passed on down the line by their supervisor advisor.

Accordingly, have received the trailing mail, wherein there is no firm indication as to when the aboundent project site will resume construction and subsequently the date of giving Possession to the allotted residential house will be made!!!

On our repeated request to BPTP via their Customer Care services, we are being mislead and wrongly informed about the real facts and figures related to the above cited subject in question.

We have been literally pleading to BPTP through Customer Care to provide us the alternate solution to the indefinitely delayed Project.
Unfortunately, all is in vein as if we are speaking to pre programed deaf ears.

Till date we are yet to receive concrete reply from BPTP authorities towards their Intentions pertaining to their obligations towards the commitments made to us at the time of Pre construction agreement. And there of changing the agreed parameters at their own sweet will to safeguard their personal interest hence unethically playing with our sentiments.

I as a customer, once again ask the BPTP authorities to seriously look into my sincere plea and provide me with immediate solution by allotting me READY TO MOVE IN RESIDENTIAL ACCOMMODATION AT PAR WITH THE WRITTEN DOWN AGREEMENT O[censored]NDERSTANDING.

Will appreciate your well justified response in line to my long due customer satisfaction and hence to keep up the goodwill and faith in Customer Client relations.

Dear Customer

At the outset, we are thankful for your continued support. The Real Estate Sector is undergoing multiple reforms and our company is also putting its best efforts to deal with the situation and match up to the expectations and commitments made to our customers.

Over the past few years the real estate markets all across India and in particular the NCR have been going through a major lull. The sale volumes across all developers and projects have plummeted to unprecedented levels.

We want to inform you that we have successfully settled our prolonged dispute with our institutional investor shareholders. Adverse market conditions coupled with prolonged litigation with our institutional investor shareholders restricted our ability to raise debt which severely impacted the delivery of our projects.

We are deeply concerned to meet our obligations to deliver your dream home as per our commitment and would like to share that we are putting in our best efforts and are hopeful that we shall be able to meet your expectations. We have taken lot off measures which shall enable us to do what we always promised to do.

- BPTP has a net worth of over Rs.2200 Crores as on 31st March 2015.

Customer Centric Measures

- In order to optimize our financial and management resources to complete and deliver our ongoing projects, we did not launch any new project for past three years despite having large zoned land parcels spread across Faridabad and Gurgaon.

- We conduct regular customer camps on matters such as Unit handing over, Project update, Registration process, Taxes etc.

- We shall remain committed to abide by the terms & conditions of our agreement.

- We have delivered over 1200 units in the last Calendar year which we to intend to exponentially enhance in the next 2 years with endeavor to handover the existing projects in the shortest possible time.

- We now maintain designated accounts for a number of our projects for better Cash flow management and to ensure faster deliveries.


Financial Measures – 2 pronged strategy

a) Raise Debt Capital

o We have successfully availed sanctions for construction financing loans of Rs.140 Crores for two of our projects namely Discovery Park (Faridabad) and Park Generations (Gurgaon).

o We have got another in principle sanction of Rs.280 crores for project loans and are working towards closure of the same.

o We are further engaged in discussions for raising construction loans on our other projects as well and shall keep you posted on the same.


b) Sale of assets

o We have identified over 70 acres of licensed land on which we have not launched any projects and have put it in the market for sale. We are already in talks with a few investors and are hopeful of closing multiple deals in the coming few months.


With this two pronged strategy i.e. of raising construction loans and selling o[censored]nlaunched land parcels as stated above we are very hopeful that we shall be able to complete all our existing projects at the earliest to your satisfaction and as per the specifications agreed by us.
