What is max. amount of penalty that can be charged for delay in monthaly maintenance charges?

I am the person living in the hsg soc in thane.actually we play cricket on every sunday and on public holiday from 4.00 pm to 7.00pm.Two member of our society has problem of our playing.First we use to play cricket on saturday, sunday and on public holiday at 3.00 pm to 7.00 pm but looking at THIER PROBLEM we stop playing on saturday.But they still have problem with us and they have warned us that they will take a legal action against us.So please tell me that can they take legal action against us and what kind of action they can take.please do email me on my email address. And our society comes under mhada.

society-kalyan — Penalty for Playing Children in Ground-

I would like to bring to your consideration of the following:

Our Society consists of 143 Flats having three Building Connected. There are around 20 such Societies are located under the banner of Apex Body who is having the rights for the maintenance of Roads, Grounds and gardens in the Complex.

Our Society is Eight year old society got it registered in the Registrar under the purview of Thane Jurisdiction. Two years back they have restricted the Childrens to not to play/or walk at the Front Portion of the building where grass grown. This was objected by the residents/parents of the Small Childrens considering the fact that the Childrens of the Office Bearers of the Society grown up and they made the restrictions to small childrens in the Society not to play. This ground is the property of Apex Body and residents was confirmed about this.

Inspite of this, the Society imposing the Penalty of Rs.10000/- voluntarily for small childrens playing the ground.
This is the viloation of rights of Childrens who have no place to play.

Pls. let us know whether the Society can impose this huge penalty and pls guide us how to go about this.

For keeping flowerpot also they are impositing penalty.

I was just going through the article
"maharashtra-co-op-societies-act-amended" which i found it vey helpful.

My query is We have just formed our society after 4 years of battle in May 2009 Kharghar navi-mumbai.

In first general meeting held in Aug 2009 there was proposal From BPL company for installation of Mobile Anttena tower on our Residential Terrace.
In that meeting we just discussed about the issue and asked BPL Service provider to get some document related to the same and after going thru it we will discuss and let u know.

But from past few days we have seen that BPL people have started their work and full swing.
I just want what is the procedure how can this installation take place without our society mebers concern.
I feel that Managing Committe member has given permission for doing so without taking concern of members if i am not wrong.

Do they Manging Committee have full rights to give NOC without others society members sign / concern as BPL paying some huge amount to society.

Pls help me as we all know Mobile Towers and radiation coming EMR coming from it are not safe for our helath and i have enough materials realated to this on health.

Pls guide me in proper direction how can i stop them from doing so i belive if there is health than there wealth. They have already begun with work and MC says that it is immposible bnow to remove.

Pls let me know the Society by-laws for stopping all this.

BACHELORS ARE STAYING/OCCUPING A FLAT IN OUR CO OPERATIVE SOCIETY AS TENANTS, THE OWNER HAS NOT INTIMATED OUR SOCIETY.
NOW THE SOCIETY(COMMITTIE MEMBERS) WANT TO TAKE OBJECTION ON THEM/OWNER.
(SINCE THEY ARE CREATION PROBLEM TO THE SOCIETY)

I have purchased 1100 Sq.Fit ownership flat in Kolhapur, We have 6 nos. flat owners, We have done sale deed registration from builder.Now 2 months was completed but builder not interested to open terrace lock.And we knew that he is interested to rent terrace for mobile tower.
Pl.suggest :-
1. Building terrace is commen for all members.?
2. Can builder rent terrace for mobile tower without consent of member?
3. I have also my separate car parking but I have not given proper access to easily park my car in my parking place & to go out from my parking place, also purposly nearby place alloted for 2 wheeler courtesy parking, what are the proper solution.
4. Builder treated us like tenant and even not interested to listen any comments from flat owner.

Ours is a co-op housing society in Ghatkopar.
In our society we dont have any fixed parking.But due to recent fights on parking issue committe members have decide to make fixed parking.The problem is that the committee members are going to take all feasible parking spaces while rest of all will get areas where theres no proper cleanliness.So wat should be our course of response to them

I want to know if police officer who is retired, he use to stay in police headquaters and even after his retirement he stayed there for more 3 months finance department of maharashtra has deducted his rent from his gratuity.
so my question is :-
Money that is deducted is in lumsum is it possible to deducet that money in installment

our building not get oc and it cons tract under development and dived in two wing tenant wing and salable wing but problem is from salable wing some members start collecting payment as maintenance and property tex without issuing the receipt or bill for the same few member oppose it so they told that your name will display on notice board and they force to pay us an unregistered firm can do that pls advice.

Dear Sir,
I have purchased a flat in Aundh Pune alonwith 130 sq ft car parking. The society has also issued me an allotmant letter for that parking. There is one person in our society who did not purchase car parking. As I was not staying in the flat so that person was parking his scooter in my car parking. When I came to stay there, he refused to remove his vehicle and statered me threatening. When I told him I will approach to police, he removed his vehicle. As my parking is near to walk way 0.625m, he parks his scooter in that walkway for which society secretary and chairman supporting him. It is very difficult to open my car door due to his scooter parking. He has also damaged my car while turning his scooter while parking and removing. Please suggest me whether I can file a complaint against him. If so which forum.

I have purchased a flat in July 2008 and the Possession of the flat was received in August 2008. In oct committee members decided to collect defict for previous six months saying they have charged less. Am i liable to pay the deficit amount ?

Who & how much % has to bear the cost of repairing work if there is leakage from our bathroom of 4th floor to the flat owner of 3rd floor? ( as per Maharashtra co-op. housing society’s rules).

Also advise if the owner of 3rd floor flat has verbally committed to share the repairing cost & twist as per his/her commitment.

What steps is to be taken OR what we can say to the society?

i have own flat, comittee members given notice to me saying about bye laws. i don't know about it. if i asked them, they says bye laws are common to co-op hsg society. do i have right to get bye laws of my society. if i complaint about security, they are saying, we telling lie. facing many problem with this soc.

we are registring our buiding on 1st week of jan 2010 under housing society act. Request you to guide us what rule regulation, maintenance etc we need to make/charge and what all minute details and process we need to follow.

I am the member of registered housing society, I have a question that is a non-member of a society can become a chairman or an accountant for society.
Such cricket and outdoor games nuisances are to be controlled by filing police complaint and getting the police to issue strict orders to stop playing cricket and asking police to take action against the people who are violating the earlier police orders to stop playing outdoor games in society premises. Police can collect some good amount of fine from the offenders to serve them as a warning.
From your side you should stop all the payments like maintenance etc to the society till the time your problems are not resolved by them. If you do this the society may warn you of some legal action for which you should readily be prepared as the society will be framing themselves by complaining against you as you have a reason that since the society is not co-operating in solving your concerns why should you co-operate with the society.
