Amazon India — Ordered new mobile, Delivered old mobile, Fraud, Cheating

I am Amit On the 05/03/2022 i ordered one Brand new mobile phone of realme 8 (Cyber Black, 8GB RAM, 128GB Storage) with No Cost EMI/Additional ExchangeOffers | B094ZK37JS ( 5H-U9BK-SCF9 )HSN:8517
I paid Rs. 18, 888 against order no.[protected]. I was given Invoice Details : DL-PNQ2-[protected]-2122 Invoice Date : 05.03.2022. Now few days back My mobile was not working properly. I went to Realme service centre. where i was informed that this mobile is out of warranty as this is a DAP mobile. I was also informed that DAP Means it is a used mobile and they can't repair it under warranty.

This is a serious fraud the Amazon and mobile seller committed fraud as they have taken the prize of New mobile and delivered the old/ used phone. I want my mobile a new mobile as they amazon and vender sold me old mobile. The Mobile is sold by Balaji Enterprises* Plot No. 33, Block A, Mohan Cooperative Industrial Estate New Delhi, Delhi, 110044IN
PAN No: GUSPS0515L GST Registration No: 07GUSPS0515L2ZY.

I want to initiate legal action against them of fraud. I want my money back and FIR to be registered against all of them

My prayer is that
Kindly take legal action against them.
A new Mobile phone or money refund.
