Respected Sir/Madam,
I, Atul Pund, hereby file this complaint against Amazon Seller Services Pvt. Ltd., seeking redressal for the unfair trade practice and deficiency in service.
FACTS OF THE CASE
1. I purchased a Redmi 13 5G mobile from Amazon on 07.03.2025, with a warranty period till 06.03.2026 (Invoice No. BLR7-46993], copy attached).
2. The mobile was supposed to be a new device, but when I visited the Xiaomi Authorized Service Centre at Sharanpur Road, Nashik, to address some technical issues, they checked the IMEI activation date and found that it was activated on 10.09.2024 (Snapshot of IMEI activation date, copy attached).
3. This clearly indicates that the mobile sold to me was a refurbished device, not a new one, which is a clear case o[censored]nfair trade practice and deficiency in service.
RELIEF SOUGHT
I request the Hon'ble Commission to direct the Opposite Parties to:
1. Provide a new Redmi 13 5G mobile, or
2. Refund 100% of the amount paid, as per the invoice.
I am willing to return the refurbished device to the Opposite Parties.
GROUNDS FOR COMPLAINT
The Opposite Parties have committed unfair trade practice and deficiency in service by selling a refurbished device as a new one, which is a clear breach of the Consumer Protection Act, 2019.
PRAYER
I pray that this Hon'ble Commission may be pleased to admit this complaint and grant the relief sought, in the interest of justice and fair play.
