LEGAL NOTICE
Under Section 2(10), 2(34), and 2(47) of the Consumer Protection Act, 2019

Dear Sir/Madam,

Under instructions from and on behalf of my client, Mr. Jaydev Giri, resident of BLOCK C/22, HPHS KALINDI HSG ESTATE, I hereby serve upon you the following legal notice :-

1. That my client purchased two (02) units of Logitech G502 Wireless Bluetooth Gaming Mouse via your e-commerce platform Amazon India under Order ID :- [[protected]] on [05/08/2025], for which due payment was made.

2. That the said goods were delivered on [06/08/2025] in grossly inadequate packaging, i.e., only a plain brown box without any cushioning or protective material, in violation of basic packaging and handling standards. Upon unboxing, both products were found damaged, defective, and unfit for their intended use.

3. That such supply of damaged goods constitutes :-

Deficiency in Service under Section 2(11) of the Consumer Protection Act, 2019

Product Liability under Section 2(34) of the said Act

Unfair Trade Practice under Section 2(47) of the said Act

Breach of implied condition under Section 16 of the Sale of Goods Act, 1930

4. That my client has photographic and video evidence taken at the time o[censored]nboxing, clearly proving that the damage existed prior to delivery and was not caused due to any mishandling on my client’s part.

5. That my client is entitled under Section 14 of the Consumer Protection Act, 2019 to :-

Replacement of the damaged goods with new, defect-free products, OR

Immediate refund of the full purchase price along with incidental expenses.

6. I hereby call upon you to, within seven (07) days from receipt of this notice, either :-

Replace both damaged units with brand new, sealed, and defect-free products, OR

Issue a 100% refund of the purchase price to my client’s original payment method.

7. Take notice that failure to comply within the stipulated time will compel my client to initiate proceedings before the District Consumer Disputes Redressal Commission, claiming :-

Refund of purchase price :- Rs. 21, 990.00/-.

Compensation for mental agony, harassment, and loss of time

Litigation costs

Penal damages as deemed fit by the Hon’ble Commission

8. This notice is issued without prejudice to my client’s other legal rights and remedies, all of which are expressly reserved.
