Amazon India — wrong product delivered by seller ny craze of amazon india

I had ordered online Dr. Scholl's liquid Corn & Callus remover Liquid Kit- 1/3 Fl Oz. Order ID was[protected]. I have received delivery for this order but after opening the package found different product and packing. Much to my dismay, it was looking like very old pack and back side instruction page found torn half due to which expiry and instruction cannot be readable . It was paid delivery and i had paid 1310/- through my debit card. Please note i had clicked /ordered on one red color product packing and what i received in delivery was blue color pack of same drug company with different description on the package. I have communicated my disappointment to Amazon.in site and seller Ny Craze and asked them take back product delivered notifying me pick up day and refund my money INR 1310/.
I have registered complaint on Amazon site and seller NY. Craze on date 20.09.2018 verbally and via mail and in response promptly sent snaps of product received via mail and on whats app number. I have provided snaps mentioned hereafter 1) product snap. 2) product with its packing, 3) outer box with Invoice no.4) back side of pack with torn instruction and expiry page. to both amazon and NY.Craze . Both they have confirmed receipt of snap via mail and verbally and assured me refund within 48 hours.

Despite of submission of above mentioned material facts about mismatch of product delivered and ordered via email and their whats app account and after speaking with customer support of Amazon.in and seller NY craze not less but 5-6 times by now and wrote mails after speaking with them I am still craving for refund thus realized both they gave false promise resolve and refund within the 48 hrs . This is 10th days now and when Y's day I had spoken with amazon customer support they notified me a new development that the claim has gone with A to Z guarantee team and thus it would take another 7 to 15 days for resolution. whilst mail received from seller that when amazon chosen go for A to Z claim, it gone to their another team handling such matters . Thus it was Shocking to me when all the material facts available, then why they need additional time for refund after penalizing me 10 days in past.
My request to you to kindly intervene and ask Amazon and their seller NY.Craze for instant refund of my 1310/- hard earned money .

mail dated 04.10.2018 received from Amazon .in that seller NY. Craze agreed for refund but the condition is i have to send product to the place mentioned in that mail . this is really painstaking thus i had replied to their mail I await their reply.

This is regarding my order no[protected] for product Dr. Scholl"s liquid corn and callus remover placed on 16th September, 2018 and delivered on 20th September, 2018. In response to your mail dated 04.09.2018 informing me that seller NY craze have agreed for refund (although after 14 days )and to that seller NY craze have requested me return the product at the address provided therein.

Which means I have to spend another man hours in doing these activities for none of my fault. Had it been known about such a penalizing conditional return and refund policies before purchase, then I would have not opted for purchase it online this product is available offline as well. Thus Seller had clearly cheated with me by sending different product which appears old and instruction page half torn from back side.

My legal source advised me not to surrender to such pressure for refund of money for the reason communicated "conditional and painstaking procedures and policies" which dosen't seems protecting consumers interest and merely made for penalizing consumer for none of his fault.

Thus I am advised send notice to seller and approach consumer court for above said product refund Rs.1310/- and Rs 2000/- for all the trauma I had gone through all these days For chasing refund and provide material facts, snaps etc. Also I have spent minimum 15 man hours. on mail and phone for chasing which financially costs around 4000/- which I can prove in court. Thus I will have to demand total refund and compensation not less then INR 7310 + notice charges and court fees. I will submit the product in court and seller can take return of product from court directly. I hereby request seller to refund product refund in 4 days in my account failing which I will consider file a case in consumer court.
