I had bought a phone (samsung j1 ace), from spice hotspot, pacific mall, ghaziabad on 6 december 2015. while i was purchasing the phone i was asked to take this insurance policy provided by appsdaily, worth rs. 1200 which covers "theft" too. On 17 july 2016, the phone got stolen at the market place from my father's pocket. when i contacted appdaily for the claim the customer care executive namely (shiraz, karan and ramesh, who is the team leader) told me that my claim is not covered under the insurance because it is pick pocket and negligence act on my part (how is it a negligent act on my part i fail to understand, which person keeps the phone at home and waits for the thief to come and steal it?). When i asked the customer care executive what according to their company is theft, they failed to reply and kept on saying please read our policy document, which states pick pocketing is not theft. I am a lawyer, myself and i know the definition of theft as per the ipc, 1908. i know what they are doing is cheating on the customers and misleading them. they are taking money on the pretext of insurance but to denying the claims on ridiculous basis.
