We got a home loan done from Axis bank worth 3200000 apprx.( Loan NO. PHR[protected]. While the cheque got ready, We got into fight with the seller and requested bank to hold that cheque for some time. We agreed to pay the nominal charges for some time. Bank started deducting the full EMI, and later on request after 6 months, they stopped charging the same. Even after repeatedly writing on their Online portal, bank has not reverted so far, HOw could they deduct a full EMI for a cheque which was never encashed? However, as per Indian Tax code, my company is not bound to provide me with a TDS certificate or form 16 since my income is not taxable and there are no deductions at the end of the financial year. I earn 19, 000 a month.
Though I've told the representative that I've PAN details and IT returns, he is not willing me to offer the regular rate of 9.90% and keeping on telling that I've to provide form 16 for a loan. He is saying it's mandatory.
Can they do it legally?
