Axis Bank — Home loan Processing Fees refund

Hi, I was in the process of the Home loan with Axis bank, Bank representative misguide me regarding the same. He just took the Processing fee and never mentioned about the Legal documents from the builder and when i asked in case my loan is not approved will my processing fee will get refund, he assured me that the loan fees will get refund. Now when my loan is sanctioned by the bank builder is refusing to provide the necessary documents required by the bank stating that we don't have those documents and when i am asking the loan fees refund he is saying that u will not get it back now.
