[Resolved]  Bata India — misbehavior of bata representative and replacement of damaged shoes during repairing

I have purchased ladies shoes from bata stores (Lower ground, pheonix market city, kurla, west, mumbai, india) on 8th oct, 2017. The pasting of the shoes got loose, so i went to the bata store (Lower ground, pheonix market city, kurla, west, mumbai, india) on 21st nov, 2017 and showed them the problem. Shoes were within warranty period, but i did not had cash memo, so told the bata representative date of purchase from my pass book entry (As payment was made using debit card). The person accepted my shoes for repairing.

Today, on 26th nov, 2017 (Around 8.30pm) i went to get my repaired shoes back to bata stores (Lower ground, pheonix market city, kurla, west, mumbai, india) and found that the shoes were partially repaired.in fact one of the shoe was damaged during repairing. I showed this to the bata representative mr, husain morchant (The person on cash counter). He saw the shoes and said if you are not happy with the repairing then write a mail to customer care. I showed him the damaged part then he said there is no proof that it got damaged during the repairing. So i explained him the nature of marks at damaged part is same as the marks at repaired parts. Then he told me to keep the shoes with bata so that he can get it repaired and ask the cobbler about the damage. He even said that you may get replacement as well. Then he asked if i have cash memo of it, i said no, i don't have cash memo but i know the date of purchase and i have passbook entry too for the same. As soon as he came to know that i don't have cash memo, his tone changed and started arguing with me. He asked me my mobile number and i told him. He checked in his system but he could found entry of 30th sept, 2016 (Which was my earlier purchase from bata). I told him i have purchased these shoes on 8th oct, 2017, please check entry of that date. But he refused. He said have you not told your mobile number at that time, i said if you would have asked i might have told. But again he started arguing saying that you should have told on your own, we don't ask customers for the number, our customers themselves tell the mobile number. I said this is not possible. So i waited there to check how any customer can tell the mobile number on his own. The next customer approached the desk for payment so the same representative ask her for the mobile number. Then i told him see you are asking for the mobile numbers, so you must have asked me and i had told you. But he said there is no entry in his system on my mobile number on 8th oct, 2017. He said now nothing can be done, you take your shoes back. I asked him his name so he told me his name but i could not understand so i asked to repeat, then his answer was 'likh ke du..?' i said yes please. He wrote his name on piece of paper which was kept with my shoes on 21st nov, 2017 while accepting my shoes for repairing. Of course the person who accepted my shoes for repairing was not mr. Husain.

This is very bad impression of bata. Being indian i prefer indian brands but people like husain morchant are responsible for demotivating customers and defaming brands as well by not valuing the customers. I request bata to train their representatives how to behave with customers and give replacement of my damaged shoes.

As I am resident of Mumbai and I have purchased the article from BATA stores (Lower Ground, Pheonix Market City, Kurla, West, Mumbai, India) and had sent for repairing to the same place. So I have requested Mr. Nitesh to provide me with address of BATA office in Mumbai, so that I can take my shoes their personally. Now waiting for BATA's reply..!

With reference to your concern and in line with our company policy, we provide 100% replacement in case a major manufacturing defect is identified and highlighted to us along with the Cash memo within 90 days from the date of purchase.
However, in case of non availability of the Cash Memo or bill, it would not be possible for us to consider any request.
Due to unavailability of cash memo in this case, we regret to inform that the product cannot be considered for a repair or replacement.
We value you as our esteemed customer and look forward for your continued patronage.

Dear BATA,
I had done payment using Debit Card and I have entry for the same on my Passbook.
If cash memo was your criteria then why you accepted the shoes for repairing..? And further damaged my shoes during repairing..!

On 10th December, 2017, I have forwarded a video of damaged shoe to BATA to explain how spillage of sole pasting liquid has damaged top peripheral portion of my shoe.

I am continuously receiving E-mails from BATA from 10th Dec, 2017 that my contact no is not reachable.

I have provided alternate contact number to BATA and have also asked to provide me BATA's contact detail, Date and time so that I can call BATA representative, if still I am not reachable.

As per telephonic discussion held yesterday (i.e. on 12th Dec, 2017) with BATA representative at 4.52pm (call received from [protected] to +91 [protected]), I have submitted my pair of damaged shoe to BATA Stores (Lower Ground, Pheonix Market City, Kurla, West, Mumbai, India) on 12th Dec, 2017 at 9.30 pm for BATA's further evaluation.

Mr. Gaurav accepted the shoes. I have also submitted a letter along with the shoes, which describes BATA's as well as Jago Grahak Jago's Customer reference complaint numbers. A copy of which is signed by Mr. Gaurav as acknowledgement of receipt of shoes.

I am attaching copy of same letter here.

BATA is sending me E-mail saying that the purchase was made more than 14 months back.

My reply to BATA's mail :

Dear BATA,

I have been telling that the purchase is made on 8th Oct, 2017 from BATA Stores (Lower Ground, Pheonix Market City, Kurla, West, Mumbai, India.

14 Months before I had purchased another pair of shoes. This case is of new shoes purchased on 8th Oct, 2017.
I have been telling in all my previous E-mails that cash memo is misplaced by me but since I have made payment through debit card, the passbook entry is there.

Please recheck your system..! You have data of 14 months back but not the data of 3 months back..?
Even after writing so detailed emails, you are again and again saying about the cash memo. This is nothing but the harassment..!

Please study my emails in detail..!

Dear BATA,

I do not have cash memo for the purchase on 8th Oct, 2017. But I do have pass book entry for the same, since the payment was made using debit card.

14 Months back I had purchased another shoes, this is a case of new shoes.
Please study the case in detail..!

How come you have last 14 months data available with you but not the data of last three months..?

If you want I can send you the scan copy of my passbook which shoes debit amount to BATA on 8th Oct, 2017.

I received call from BATA on 9th Jan, 2018. Mr. Vivek (a BATA representative) confirmed that I will get a gift voucher of worth Rs. 1000 as compensation. To re-deem the voucher I need not to pay extra money. I have mailed my address for sending me the voucher. Now waiting for voucher..!
