Subject : Marketing Fraud by Car Dealer on sale of BEAT car

Dear Sir,

I need to bring to your serious notice the pathetic customer service and fraud marketing tactics used by Ashtavinayak Auto Pvt Ltd.

I had booked the BEAT LS model from Ashtavinayak by making an advance payment of Rs. 25,000/- on August 27, 2010 and then balance payment of Rs. 3,98,713/- on August 30, 2010.

The dealer had agreed to give a cash discount of Rs. 5000/- on the sale of car if booked on the same day (Aug 27th 2010) and CPCO (car maintenance policy value of Rs. 13,500/-) at Rs. 6000/- Alternatively, they suggested a discount of Rs. 13,200/- (converted into an insurance free) but to pay the full value of CPCO of Rs. 13,500/- I opted for the second option by considering the discount of Rs. 13,200/- and paying the full amount for CPCO. The CPCO payment was paid separately by me on the date of delivery i.e Sept 7th 2010.

On the date of delivery, to my surprise, I was given the insurance cover note policy of Future Generali carrying premium amount as Rs. 7800/- instead of the published Rs. 13, 188/- which reflects a complete marketing fraud of taking away the agreed discount of Rs. 13,200/- from the customer who has trusted and relied on the commitment made by the dealer and having made all payment in advance before delivery. When I bought up the issue with the sales executive Mr. Hanif and his boss Mr. Vipin at their showroom and asked them that the discount has been camouflaged by fraudulently stating the insurance amount as 13,188/- instead of 7800/-, they quickly took back the cover note and cancelled the premium amount of 7800/- on the cover note with white ink and hand wrote the amount of Rs. 13,188/- realizing that I had discovered the marketing fraud. They did not have any clarifications and after I debated this issue with them, they agreed to refund the difference of Rs. 13,188/- and 7800/- to me vide cheque to be given to me 3 days later. On that assurance I took the delivery of the car and have been following up for the refund. I also did a cross check with ICICI Lombard for the insurance premium if I did the insurance cover on my own and the quote they gave me was approx Rs. 7800/- which actually means that I have been tricked by the committed discount from Ashtavinayak and they have been publishing a wrong insurance amount using it as a marketing fraud to customers to give a discount that never exists.

Now as I follow up with them for the refund, they have denied any such commitment and state that there is no refund due to me for the difference in the insurance amount. I would request you to take up this matter seriously with such tricksters car dealers and bring them to shame by exposing their marketing fraud. I am also writing a copy of this complaint to them and to the Indian Consumer Complaint forum and to the media – Mumbai Mirror.

I demand that the discount due to me of Rs. 5400 (Rs. 13,200 less 7800) be refunded to me at the earliest and although this is a small amount, it is a question of principle and I do not want other customers to face the wrath of such fraud car dealers.
