DEGRADATION IN PENSION AND PENSIONERY BENEFITS AFTER 6TH CPC AND ISSUE OF CORRIGENDUM PENSION PAYMENT ORDER AND REMOVAL OF DISPARITY IN MILITARY SERVICE PAY OF ARMED FORCES AND ALSO NON DEPRIVING OF EARNED PAY COMPONANT FROM PENSIONERY BENEFITS


Respected Sir,

1. With due honour and regards I bring following into your notice and hope for an action on priority.

2. There is degradation in pension and pensionery benefits of PBORs those retired after 01 Jan 2006 even after implementation of the recommendation of 6th central pay commission. If we calculate the pension of a PBOR who has retired pre 01 Jan 06 for maximum benefits with minimum criteria (i.e. 28 years of service) it comes around plus minus 70%. But presently PBORs those retired post 01 Jan 06 are being paid only 50% of their last emolument drawn at par with civilians. Generally the condition of pensioners improves after every pay commission but this time it is vice-versa.

3. As per PCDA (Pension), Allahabad, circular No. 430 dated 10 Mar 2010 and Government Of India letter no. No PC 10 (1) / 2009 - D (Pen / Pol) dated 08 Mar 2010 table No. 124 in the appendix, the basic pension of a master warrant officer of 'X' group who has put-up 28 years of service and discharged before 01 Jan 2006 is Rs 13, 590/=.

4. I am a Master Warrant Officer of 'X' group and have put-up 38 years of regular service and discharged on 31 Jul 2006 after completion of term of engagement. As per my Corrigendum Pension Payment Order No. 08/14/B/CORR/53231/2009 dated 20 Nov 2009 my basic pension is only Rs 12, 245/=.

5. As I understood and conclude, the Government of India in order to bring the improvement in the pension to bridge the gap in pension of pre 01.01.2006 and post 01.01.2006 discharged personnel below officer rank (PBOR) of armed forces has issued the said letter. Since there are various new components in the present pay structure, which were non existing previously, so there has to be a little difference between the pension of post 01.01.2006 pensioner little higher side and pre 01.01.2006 pensioners little lower side.

In my said complain, the pension of a master warrant officer of ‘X’ group who has put up 28 years of service and discharged pre 2006 might have been fixed in comparison with pensioners discharged after 01 Jan 2006. In the present scenario, if I compare myself, after putting up 38 years of regular service and discharged after the implementation of 6th Central Pay Commission, it could be possible only if I am granted 70% pension of my last emolument drawn or 50% of the highest pay in pay band including other pay components since I have attained the highest rank of PBORs.

7. As per recommendation of 6th Central Pay Commission, the classification pay which was being paid to the personnel below officer rank (PBOR) of Indian Army has not only been increased but also has been recommended to be paid to the personnel below officer rank (PBOR) of Indian Navy and Indian Air Force as well. But the same has been implemented partially in Indian Air Force. I request your kind favour to look into the matter so that what ever earned by an individual in the entire span of service career should not be deprived of the same up to the last rank and should be included in the pensionery benefits. Such as flight charge allowance, classification pays etc. This will also affect me in my pension.

8. I would like to draw your kind attention towards the socially unjust discrimination between the officers and personnel below officer rank in the Military Service Pay of armed forces which is in the ratio of 3:1 (that is Rs 6000.00 : Rs 2000.00) at present. In my opinion it is a social component which is not related with education or status. It should have been same for officers and personnel below officer rank (PBORs) since the social and physical suffering are same for every human being even many times personnel below officers rank are worst hit than officers. This is also evident from the fact that the ratio of PBORs seeking discharge after initial engagement itself is more than that of officers. If MSP made equal then I will also be the beneficiary of the same.

9. In view of the above facts I request your kind favour to look in to the matter and do the needful at the earliest.

Sir,

Going through so many view points and issues posted on this platform, I felt I have a different issue to be put up. I retired as a JWO Radio Fitter trade on 30 Sep 2002. I was promoted to JWO rank on 01 April 2002 and thereby was pensioned for SGT rank and accordingly was drawing the pension of Group X SGT till the implementation of 6th CPC. All the problems commenced from there on. As I was entitled to the pension of the last rank held my basic was calculated by my PDA as Rs 6402/- (based on Appendix C of GOI Ltter dated 11 Nov 2008). But when the Revision in pension for Pre 2006 retirees was announced, the table 116 to circular 401 mentioned the Basic pay of JWO Gp X as 7100/- and the revised pension as Rs 8704/- Now my PDA is confused in giving me my arrears. They are now planning to recover the pension already paid for the rank last held stating that I am entitiled for SGT Gp X pension only. Frequent request to PCDA Allahabad, Dy CDA IAF has not resulted in resolution but complicated the issue as they just refer to circulars and orders issued fro time tio time which the PDA is unable to understand. Kindly help me out of this as now I stand to accumulate arrears running in to a Lakh.

Dear Friends,

I gone through the complaints of EX. WO BS Chauhan and Ex. MWO ML Shukla. These are the facts not for PBOR who retired after 1.1.2006 but those who retired before 1.1.2006 will be deprived on next 7th CPC along with the PBOR going to retire after 6th CPC implimentation.
look at glance EX. Lt. Col to Lt. General and equilant of Air Force and Navy officers got a jump of more than Rs. 10, 000 per month in their pension on 1.1.2006 and who retired after 1. 1.2006 are to get more pension than their same rank pre- 2006 retiree fellows. Some grievances of officers are still pending for the solution.
Whereas in case of PBOR, what is in complaint of above named EX. WO BS Chauhan and Ex. MWO ML Shukla is not hidden one and is true for all serving PBOR on their retirement.
It is matter of concern to all the PBOR to think and jointly bring the injustice to newly consituted Grievance Committee under the direction of the honourable Supreme Court of India.

It is to inform u that GoI MOD has tried to remove certain disparities eg.post 2006 pensioners getting less pension that pre2006 pensioners by issuing order no.17(3)/2010/D(Pen/Pol) dated[protected] the tables will be available soon.For other problems like commutation, calculating pension @70% of pay last drawn, double? family pension etc. the stuggle is on.Kindly strengthen yourself by joining hands together.

Sir,
1 I have the honour to request the followings for your kind consideration.

2 I was enrolled in IAF on 19 Jun 1980 and was promoted from time to time and finally promoted to the rank of JWO w e f 01 Feb 2000. My date of discharge is 30 June 2000. I held the rank of JWO for the period of five months at the time of retirement.

3 I am presently receiving the pension of SGT Gp ‘X’ ‘Diploma Holder’ where as I am authorized to draw the pension of JWO as per the Govt Circular dated 09 Feb 2001. Ministry of Defense, GOI has issued a Circular implementing the Govt decision on the recommendation of Fifth Pay Commission relating to pensionary benefits in respect of commissioned officers and Personal Below Officer Rank. And in that it has been clarified that all armed forces pensioners irrespective of their date of retirement shall not get less than @50% of the minimum revised scale of pay introduced w e f 01.01.1996. Though the rank is held less than 10 months at the time of retirement. Therefore I should be paid the pension of the JWO rank, which was held at the time of retirement and the incidental arrears due to be paid to me with relevant amendment to my PPO.

I have read all the comments on the website. As I feel by given these comments on the website only, the matter can not be resolved. we should be united together and should file the case in honorable court & to Armed Forces Tribunal to get the justice. please remember no officer of Indian Army, Air force & Navy will be in your fever, because they all ( retired or Serving) are fighting for their own interest.They have got every thing by pressing the govt by including the PBORs for their own demands, but they can not solve even a single query of the PB ORs. And after retirement some officers are engaged to united ex serviceman on the name of ex serviceman union etc. and clearing their own issues. so be careful from the activities of these officers. we should press all of them to fight for the issues related to PBOrs. first, then we will co operate them .Then we can get our rights.

the arguments posted by wo b.s. chauhan, gk nair. jagat pal sihag & many others speak clearly of the dicrimination done in implementaion of the 6th cpc recommendations.
no senior, retiring after the 6th cpc report should get less pension than the person of same rank, gp and service retirnig after him form the same service, i.e. army, navy or air foce.
the g.o.i should look into this matter and sort out the problem at the earliest to keep the moral of all the ranks in good spirit.

i am kazi aejaz ahmad amanulla. service no. 622624N ex -sgt my ppo no. is 08/14/B/08958/1993.. served in IAF from 16 aug 78 to 31 aug 93.
Till date i am not getting revised (one rank one pension) and also the erriors for the same is not credited in my SBI Nashik( treasury Br, ) Acct NO. [protected].
when contacted SBI pension cell in Navi Mumbai, it was informed to me that they have not received the ppo for my regular 15 Years of service..
It is requested to kindly look into the matter and please issue fresh ppo to SBI,
