[Resolved]  Maruti Suzuki — booking of car

sir.i have booked a swift dzire zdi on 29.03.2009 and they had given time of 3 months.after i booked my car they are saying that car will take 6-8 months bcoz maruti is now doing production of maruti swift dzire.

Dear Sir,
It is with extreme disappointment and distress that I write to you, but I have been left with no choice. I booked a Maruti Swift VDi on May 3rd 2009. The booking was made through Vipul Motors Pvt. Ltd. (NIT Faridabad, Mathura Road). At the time of booking, I was told that the approximate wait time will be 12 weeks.

I tried to call them & asked for the status of the booking. Everytime, either they had no clue of this or made the meaning less excuses like Maruti is closed for some time etc etc.

This is just to inform you that i have been working with one of your A-Class vendor i.e Sanden Vikas India Ltd & very well know that Maruti hasn't been closed except on weekend since inception of FY'09.

I strongly feel that there is lack of transperancy in their system. Either they are intentionally not giving us the booking to use the same some where else or for the means of harrasment. We should atleast know the status of our booking or pendency of booking over there enabling us to track the same.

What makes the delay all the more disappointing is the level of service (or the lack thereof), during this period. At no point, not even once, has anyone from the dealer to Maruti called me to inform me of the delay or explain plausible reasons for the delay. Every single time, I have had to call and find out about the delivery update (if any).

Someone known to me booked the SAME car (Swift), SAME model (VDi), from a dealer in Punjab on the date later than my date of booking . He has received delivery of the car with in couple of weeks or maximum three to four.

Even at this point, neither the dealer nor the Maruti is able to tell me a date by which I can expect the car. Not receiving the car is bad enough, but it is completely ridiculous if I can't be told when I will receive the car, after so much of waiting. When I contacted the dealer, I was told that they have no information from Maruti about this. The dealer has forced me to speak directly to Maruti, and hence this email.

After so much time of waiting, with no sign of the car or even a firm date by which I will receive it - is this the treatment one expects from 'India's leading car manufacturer'? This can hardly be described as 'just-in-time' supply chain management, which other Japanese car manufacturers are known for.

Your website claims that your vision is 'creating customer delight' - I can assure you that this customer is far from delighted.

I realize that my situation may not be unique, but I find this level of service completely unacceptable. The least I expect is to be regularly informed and compensated adequately for the delay.

Please let me know if Maruti Udyog Limited finds this request unreasonable.

I have booked Swift Dezire VXI on 31/07/09 but till now I have not received the delivery. Is the production so slow ?. I booked the car with 4 wheel world Chembur mumbai. Who has further book the car with fort point mahalakshmi Under booking no SOB0900162. They commited me 1 and half month but they are still not clear about the delivery and blaming the company. I booked by the name Maganlal S Jain . Can you help me regarding the same.

I am not sure how Maruti Udyog, which is the market leader in automobile and has proved so at every step by introducing new models and variants, is unable to deliver vehicle in time that are booked by your loyal customers.

I booked Suzuki Baleno on July 13th at the Nexa Dealership Andheri West Mumbai. Now after 3 months i have been told that I am at number 3 in the waiting list ..., There is no other option left for the customer except to believe the dealer. Maruti being such a reputed brand should have a tracking system made accessible to customers who have booked the cars to track the status of their booking.

In the absence of such a system there are opportunities for foul play, and playing around with the order of allotment

I have booked Swift Dezire VXI (O) on 24/03/17 but till now I have not received the delivery.I was told by dealer Bimal Auto second week of April that the old model has been stopped by Maruti and New 3rd generation can book will start soon so wait for that.I had no option but to wait.After the launch of the vehicle 16th May I was told by the dealer that only Diesel version has come so pay 1lakh Amount more and take the vehicle. I refused saying, first of all, I do not have 1lakh more to shell out Moreover I want only the petrol version of the Car.
I was told that the dispatch of the vehicle from Maruti will commence from last week of the May month today 2nd of June I still got no answer from Dealer or any commitment that I will get the delivery on this date.

I want to ask the Maruti Company that they are taking their customer for granted Well in advance they have stopped the production of the old generation and yet they have not come up with good planning for the smooth delivery of the vehicle to the customer.Why the production so slow ?. Dear Sir,

i am very sad to write this message that i have booked one Dezire car on 7th, June, 2017 at Popular Vehiles and Service PVT.Ltd Civil Station Po, Wayanade road, Kozhikode Showroom, that time executive told current waiting period of Dezire is 10 week, as per my booking they will deliver 21st of August, as per the delivery date 4 days back i was visited the showroom and executive ask me have you receive any letter from their showroom because maruti reduce the production some vehicle are call back due to manufacturing issues abnormal sound is coming on the steering wheel also rear wheel suspension. also july month onward govt declared GST due to this maruthi increase the waiting period 19 month,
same issues i was sent a mail to dealer and maruti customer care, as per the mail i receive cool from Popular and informed they already sent letter for me that is due to GST booked vehicle will get September 20th only, this letter is issued by Popular after my escalation,

LEGAL NOTICE

Sir,
Under the instructions of our client Mr. Mrigank Shekhar, s/o Raj Kumar Singh, A-301 Sagar Sadan Apartments, IP Extension, Plot no. 113, Patparganj, New Delhi- 110092, we do hereby serve upon you legal notice as follows:

1. That on September 8th, 2017, our client booked a Maruti Suzuki Alto 800 car LX model of Granite Grey colour with the Noticee No. 2, and paid the booking amount of Rs. 5, 000/- by cheque, which has been duly encashed.

2. That before booking the above said car, there were some rounds of meeting and negotiations with Noticee No. 4. Our client had even approached M/s Competent Motors for purchase of the same car model with the same colour. In order to induce and win over our client to book with Noticee No. 2, the notice No. 4 represented and offered that if he booked the car during the “sharaad period” :

• there would be a special discount of Rs.20, 000/- plus Rs.15, 000/- (in lieu of gold coin) and a buffer discount of Rs.1, 000/- (total Rs.36, 000/-).
• the car would be delivered during the Navaratra (ie., any time from 21/09/2017 to 30/09/2017).
• That he could choose any color given in the Maruti Suzuki brochure.

3. That at the time of booking on September 8, the Noticee No. 3, after meeting the Manager re-confirmed that the car would be delivered before September 30, 2017.

4. That thereafter our client kept in regular touch with Noticee No. 4, who even assured that the car could be delivered before 25/09/2017, and later on said before 30/09/2017 .

5. That however, after 30/09/2017, the Noticee No. 3 and 4 started avoiding our client’s calls and when finally, he could contact him on 4th October, 2017, he was informed that the delay was caused due to the low demand of the LX model of Granite Grey colour of the car and that because the production had not yet been initiated for it by Noticee No.1, though the indent for the car had been made and the entire price of the car paid to Noticee No.1. Now Noticee No. 4 started making excuses for non-delivery of the car and when our client insisted on a specific date, he was unable to give any specific date of delivery. When Noticee No. 4 could not give a plausible explanation for non-delivery of car, our client contacted the Noticee No. 3 the Team Leader Mr. Chandan Kumar and subsequently the Bagga Link, Patparganj Showroom Manager, Mr. Abhishek Nadda and even the Bagga Link customer care Manager, Ms.Deepti Singh. But all that they could say was that they will not be able to give any specific date for delivery. They were even unwilling to share any information about the date of indent placed with the Noticee No1-company. Now suddenly, they started expressing helplessness in giving information on the status of the car and informed the client that the factors delaying the delivery of the car were outside the control of the showroom and its employees and that the company i.e Maruti Suzuki India Limited and not the dealer was responsible for the delay. They even hinted that Maruti Suzuki company is likely to stop manufacture of LX model of any colour.

6. That our client then contacted the Maruti Suzuki India Limited helpline No.[protected] and was informed that any sort of delay was the responsibility of the dealer and that the company Maruti Suzuki India Limited always acted on the indent made by the dealer and initiated production accordingly. The client registered a complaint No. [protected] with the Maruti Suzuki company against the Sales Executive Mr. Parvinder Singh and Team Leader Mr. Chandan Kumar for making false promises to the client on the helpline. Our client has recorded all the conversations with Noticee No.4 and other executives.

7. That after our client registered his complaint with the Maruti Suzuki India Limited helpline, on 8th October, 2017, the Team Leader Mr. Chandan Kumar and the Sales Executive Mr. Parvinder Singh (Noticees No. 3 & 4) visited our client at his residence and tried to persuade him to withdraw the complaint as they were in no way responsible. They even said that all the promises were made on the advice of the Showroom Manager. Both of them told our client that they themselves were not privy to the information exchanged between Noticees No. 1 & 2, and thus were unable to furnish any details. The client however refused to withdraw the complaint and demanded delivery of the car within a week. Both Mr. Parvinder Singh and Mr. Chandan Kumar then assured our client that they would have some update on the status of the car by the end of the day.

8. That on the next day, ie., 9th October, 2017, our client was informed by Noticee No. 4, Mr. Parvinder Singh that the Granite Grey colour of the LX model was not available and that the same may not be available for an indefinite time as the company Maruti Suzuki India Limited has stopped producing it due to lack of demand. He then tried to persuade our client that he should instead opt for a higher priced model LXI in Granite Grey colour or for the LX model in Silky Silver or white colour. He was told that if he confirmed the model in Silky Silver or white colour, it would be delivered by the end of the month of October or in the beginning of November 2017 (but still no definite timeline for delivery). The client however refused to change his choice as already a delay of over a month and half had been caused. He felt cheated for being forced to change the choice of colour he had opted for in the beginning.

9. That our client states that he feels completely deceived and cheated by Noticees No. 2 to 4. It seems it has become the trade practice of Noticee No. 1 and their dealers to persuade all customers to make advance booking of any model or color by making false promises of sure delivery within 1-2 weeks. The modus operandus of the the dealer Bagga Link Motors, Patparganj (Noticee No.1) through its employees is thus :
• To somehow snare all customers coming to the showroom to book and and consequently pitch sales over and above other competing Maruti Suzuki Showrooms by making all kinds of false and fraudulent promises of quick delivery of any model or color.

• Once snared in their net, to keep on promising further, week after week, to wait. After the customers are wearied out, to come out with bizarre explanations, even blaming the Maruti Suzuki India Limited Company for the delay and non-delivery of the booked car, and to persuade the customers to change over to different model or color, which they have either overbooked and are not able to sell. What is most intriguing is their refusal to show proof or details of indenting the booked car with Maruti Suzuki Company, as if they are “top secret official secrets”.

• Now that special discounts period (of Rs.36, 000/-) is over, the customer would be, willy nilly, forced to come to the terms of the dealer and take delivery of whatever car model or color that they are willing to offer.

• Till today, Noticees No. 2 to 4 are unwilling to give a timeline for delivery of LX Alto 800 model of Granite Grey color.

10. That our client has been advised that the above described conduct on the part of the Noticees No. 2 to 4, is tantamount to defrauding and cheating the public, besides gross “deficiency of services” and unfair trade practices. It is also grossly anti-consumer, monopolistic and anti-competition and violative of the Anti-competition law. There is no semblance of any fair dealing at all, in their conduct. By their conduct, they have made themselves liable for being prosecuted for the offence of cheating and also being sued for compensation and damages before the Consumer Disputes Redressal Forum, besides being hauled up before the Competition Commission.

11. That our client has been further advised that since Noticee No. 2 is the agent of the Noticee No.1, the latter is liable for the acts and deeds of the former, and hence Noticee No.1 is also liable to pay damages and compensation for deficiency of services by Noticee No.1. By this legal notice, the Noticee No.1 is called upon to deny or confirm whether they have received indent/order for delivery of the above specified car from Noticee No.2, the date of indent/order, the amount paid and also whether the Company is capable of manufacturing and delivering Maruti Suzuki Alto 800 model car of Granite Grey colour as published in their Brochure.

12. That although the mental torment and harassment suffered by our client at the hands of Noticees No. 1 to 4, cannot be measured in terms of money, our client has modestly assessed the damages and compensation at the token rate of Rs. 1, 000/- per day from 30/09/2017 onwards till the date of actual delivery of the car booked by him. All the Noticees are jointly and severally liable to pay such damages and compensation to our client. Besides, the Noticees are also liable to punitive damages of Rs.50, 000/- for their tortious attempt at fobbing of car of any model and color, not of his choice.

In the above circumstances, you are hereby served with this legal notice and requested to deliver the Maruti Suzuki Alto 800 model car of Granite Grey color within a week of receipt of this legal notice, alongwith damages and compensation at the rate mentioned above, ie., @ Rs.1, 000/- per day beyond 30/09/2017 till delivery of the car (plus punitive damages of Rs.50, 000/-, failing which our client shall be constrained to initiate criminal prosecution for the offence of cheating and criminal misappropriation of property, as well as initiate appropriate proceedings and sue you for damages and compensation at the appropriate forum/court at your risk and costs.
