[Resolved]  Oriental Insurance Co. Ltd. — Forced to settle the claim against policy

My car had an accident on 15.9.07. It is currently lying in the workshop awaiting decision from the insurance company. The estimated repair cost of approx Rs 2.6 lacs exceeds the IDV of car which is 1.8 lacs. After depreciation the gross liability of repair cost to the insurance company exceeds 75% of the IDV. In this case I should get a total loss claim. The surveyor took more than 45 days to give the report. Now I am stuck with the company officials who are negotiating with me to settle the claim on repair basis. I am the lawful owner of the car and the insurance policy and reserve the right to get the Insurance due as per policy. It has been gruesome experience to deal with the surveyor and insurance company to the extent that I feel harassed and exploited due to the illicit, ambiguous and unjust process of settlement of Insurance claim. I don't know their individualistic expectations out of this case. I only know that they are defying the policy. Right now I am at their mercy. But I have decided to fight for my right in the best possible way. Pls guide.
